1. Background                    The subject property is 1.40 acres. The homeowner is requesting to
                                 construct a 432sqft. pavilion. The pavilion will mainly be a covered patio
                                 with a fireplace. The pavilion will be constructed with a steel frame and
                                 stone veneer with a masonry fireplace. The accessory structure is to
                                 match the architecture of the home. The home is located at the end of a
                                 private street surrounded by numerous grown trees. The pavilion will
                                 not be visible from the front of the home.

2. Setbacks                      Section 406.020 “Such accessory structures must be located only in the
                                 rear of the lot and set back from rear and side lot lines the same distance
                                 as the required side yard setback distance for principal buildings in the
                                 zoning district in which the lot is located.”

                                 The side yard setback for Residential A Zoning District is 20’.
                                 The new pavilion would be 54’10.5” from the rear property line.
                                 Distance to side property line is not drawn, but is visibly greater than 20’.
                                 Distance from main structure is not drawn, but is visibly greater than 10’.
                                 Thus, the proposed structure meets all setback requirements.
