 2                             Article VII Kennels, Catteries and Pet Shops
 3
 4   § 142‐23 Licensure Requirements and Restrictions.
 5
 6      A. The Animal Care and Control Authority may refuse to issue or may revoke any license if
 7         the person holding the license refuses or fails to comply with this chapter or any law
 8         governing the protection and humane keeping of animals. Fines will be levied as set
 9         forth in the applicable section(s) and no part of the license fee shall be refunded.
10
11      B. Any person whose license is revoked may, within 14 days of the decision revoking such
12         license, appeal the decision to the Animal Care and Control Oversight Commission. A
13         date and time will be set for a hearing at which those wishing to be heard concerning
14         the revocation of the license will be heard. The Animal Care and Control Oversight
15         Commission shall make a final decision affirming or reversing the decision of the Animal
16         Care and Control Authority. The person whose license was revoked will have the right of
17         appeal to the Circuit Court of Cecil County in accordance with the Maryland Rules of
18         Procedure.

20      C. It shall be a condition of the issuance of any license that the Animal Care and Control
21         Authority shall be permitted to inspect all animals and the premises where animals are
22         kept at any reasonable time and shall, if permission for such inspections is refused,
23         revoke the license of the refusing owner.

25      D. If the applicant has withheld or falsified any information on a kennel, cattery or pet shop
26         application, the Animal Care and Control Authority shall refuse to issue a license or
27         permit and shall revoke any existing license or permit.

29      E. No person holding an ownership, manager or board interest in any kennel, cattery or
30         pet shop who has been convicted of cruelty to animals shall be issued a license or
31         permit. An exception may be made for shareholders of an incorporated pet shop with
32         multiple shareholders; however, no exception will be made for that corporation's
33         managers or board members.

35          F.      In order to obtain a kennel, cattery or pet shop license, the kennel, cattery
36          and/or pet shop shall pass an inspection as specified IN FORMS DEVELOPED BY THE
37          COUNTY EXECUTIVE, WHICH ARE ON FILE IN THE OFFICE OF THE DIRECTOR OF
38          FINANCE AND AVAILABLE ON THE WORLD WIDE WEB AT WWW.CCGOV.ORG {by
39          Appendix 3, Kennel Inspection Report, Appendix 9, Pet Shop Inspection Report, and
40          Appendix 15, Cattery Inspection Form.{4} Three failed inspections within a license or
41          permit year shall result in a denial or revocation of the license or permit. Revocation
42          shall result in the animals being placed in the care of another licensee within 14 days or
43          seizure of the animals by the Animal Care and Control Authority, with the kennel,
44          cattery or pet shop owner(s) being responsible for all necessary veterinary costs and all

45          applicable fines and fees. If a license is revoked, the license holder(s) shall not be
46          granted another license for a period of up to three years from the revocation date.

51      G. Any kennel, cattery or pet shop requiring a re‐inspection will be charged a re‐inspection
52         fee. A SCHEDULE OF RE‐INSPECTION FEES IS ON FILE IN THE OFFICE OF THE DIRECTOR
53         OF FINANCE AND AVAILABLE ON THE WORLD WIDE WEB AT WWW.CCGOV.ORG. {as
54         set forth in Appendix 1, Fines and Fees Schedule.{5} Failure to comply with a kennel re‐
55         inspection shall result in a fine of up to $500. Failure to pay any fees or fines may result
56         in the denial or revocation of the license and an additional fine of $300.

60        H. All kennels, catteries and pet shops shall maintain a copy of any completed
61            kennel/cattery inspection performed by Animal Care and Control Authority for a period
62            of one year and shall display it in a prominent place.

64      I. Any critically ill animals in a kennel, cattery or pet shop not treated by a licensed
65         veterinarian within a reasonable time, not to exceed 48 hours, may be seized by the
66         Animal Care and Control Authority and provided with proper veterinarian care. The
67         kennel, cattery or pet shop owner(s)/operator(s) will be held financially responsible for
68         all incurred expenses, and the animal(s) may be returned to the kennel or retained by
69         the Animal Care and Control Authority. Additionally, the kennel, cattery or pet shop
70         owner/operator may be charged with animal cruelty and fined as set forth in § 142‐18.

73   § 142‐24 Commercial Kennels and Catteries.

75      A. A commercial kennel or cattery shall comply with all state and County regulations. A
76         kennel or cattery inspection shall be performed annually by an Animal Care and Control
77         Officer UTILIZING FORMS DEVELOPED BY THE COUNTY EXECUTIVE, WHICH ARE ON

219      E. The inside ambient temperature shall be regulated and cannot exceed 80° F., or a
220         temperature considered safe for the animal's health as determined by the breed and
221         condition of the dog. The boarding kennel shall be kept clean and free of any debris that
222         could endanger the animal and in good repair at all times. Animal Care and Control will
223         use a guide such as the Tufts Animal Care and Condition (TACC) Scales for Assessing
224         Body Condition, Weather and Environmental Safety, and Physical Care in Dogs in
225         determining the safe temperature. This guide can be referenced online or at a public
226         library.

228      F. Construction must be such that the security of the dog is ensured and kennel wall areas
229         are a minimum height of five feet.

231      G. The floors of kennels and individual exercise areas shall be constructed and maintained
232         in such a condition as to prevent ponding of any liquefied substances.

234      H. Only one dog shall be housed per kennel unless the dogs are from the same household.

236      I. All dogs shall have access to outdoor exercise areas.

238      J. The facility shall be maintained and repairs carried out regularly.

287            dog that has been declared dangerous by the Animal Care and Control Authority which

309      C. All pet shops, including pet shops run in conjunction with any other business, shall, in
310          addition to all other requirements of law, comply with the minimum standards for
311          maintaining satisfactory sanitary and housing requirements established by the County
312          and State Departments of Health and the Animal Care and Control Authority. The annual
313          licensing fee shall be established by the COUNTY EXECUTIVE {Cecil County
314          Government.}

316      D. Additional minimum pet shop standards are:
317
318          (1) All animals shall be treated humanely.
319
320          (2) All animals shall be provided with nutritious food in sufficient quantity, proper drink,
321              air, and space appropriate to the age and type of animal, as well as necessary
322              veterinary care. All mammals under three months of age shall be fed at least three
323              times per day.

325          (3) All animals shall be fed, watered and provided with clean bedding every day of the
326              week, including Sundays and holidays.
327
328          (4) All food shall be served in a clean container, mounted so that the animal cannot
329              readily tip it over or defecate or urinate therein.
330
331          (5) Fresh water shall be available to all animals at all times. All water containers shall be
332              mounted so that the animal cannot readily turn them over and should be removable
333              for cleaning.

335          (6) The temperature of the animal enclosures shall be maintained at a level suitable for
336              the animal contained therein.

338          (7) There shall be sufficient clean, dry bedding to meet the needs of each animal.
339
340          (8) Hot water with a commercial disinfectant shall be kept at a minimum temperature of
341              110° F. and shall be available for the washing and disinfecting of food dishes, water
342              dishes and cages.

344          (9) All cages and enclosures shall be constructed of a nonporous material for ease in
345              cleansing and disinfecting. Each cage shall be of sufficient size to allow the enclosed
346              animal to stand, turn and stretch to its full length and height within the enclosure.
347
348          (10) If a mesh or screen‐type material is used as a suspended cage floor, 1/2 of the mesh
349              surface is required to be covered with a removable, flat, nonporous material. This

350               material will be required to be in place in the cage while occupied, with the
351               exception of cleaning and disinfecting time.

353            (11) All fish shall be contained in a clean, algae‐free tank in which the water
354                temperature shall be maintained at a constant, healthful level, with the exception of
355                the species of fish that needs algae to survive in its environment. Dead fish shall
356                immediately be removed from the tanks.

358            (12) Pet shops selling psittacine birds shall comply with all Health Department
359                requirements for psittacine birds, including completion of the required State of
360                Maryland application for an exotic bird permit, UTILIZING FORMS DEVELOPED BY
361                THE COUNTY EXECUTIVE, WHICH ARE ON FILE IN THE OFFICE OF THE DIRECTOR OF

370        E. The Animal Care and Control Authority may suspend, revoke or refuse any license issued
371           under this section if the licensee has secured such license by misrepresentations or has
372           failed to maintain the standards required by this section.

377    Section 142‐29 Kennel, Cattery or Pet Shop Closure.

379        A. A kennel, cattery or pet shop closure application shall be submitted to the Animal Care
380           and Control Authority prior to closure of a licensed kennel or pet shop, UTILIZING

384           application, a closure inspection shall be performed before the kennel or pet shop may
385           officially close. Kennel, cattery and pet shop owners who voluntarily close their kennel
386           should feel free to consult with the Animal Care and Control Authority for assistance in

393       B. Any pet shop, kennel or cattery closure prior to receiving Animal Care and Control
394           Authority approval shall result in the assessment of a fine of $500. This fine shall be in
395           addition to any other applicable fines provided in this chapter.

399   Section 142‐30 General Licensing.

401       A. No person shall own, keep or harbor a dog over the age of four months within Cecil
402           County unless it is licensed. The application for the license shall state the name and
403           address of the owner and the name, breed, color, age and sex of the dog. A valid

455           (1) Any individual(s) or organization operating a kennel, cattery or pet shop without
456               obtaining the proper license: $500 per animal found on premises.

   678        B. Every dog owner is required to see that the license tag is securely fastened to the
   679             animal's collar or harness, which shall be worn by the animal at all times, unless the
   680             animal is engaged in supervised hunting or other activity where a collar might endanger
   681             the animal's life or safety.

   683        C. Lost hunting dogs shall be reported lost to the Animal Care and Control Authority within
   684             72 hours of the hunt or field trial to be exempt from wearing a collar.

   686        D. In the event that a license tag issued for a dog is lost, the owner shall obtain a
   687             replacement tag upon payment OF A LICENSING FEE, WHICH WILL BE SET ANNUALLY
