JIM BEAM BLACK BECOME 6% FAMOUS PROMOTION (ON-PREMISE) CONDITIONS OF ENTRY 1. Information on how to enter, mechanics of entry and the Prize form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet or premium SMS (short messaging service) only. 2. Entry is only open to residents of Australia aged 18 years or older who are able to participate in the Prize, as set out in Condition 17. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.

3. Entrants acknowledge that this promotion is being conducted in conjunction with the „Jim Beam Black Become 6% Famous Promotion (Off-Premise)‟, which has its own Conditions of Entry available at www.jimbeam.com.au and is operating independently of this promotion in respect of Entrants and Prizes. 4. The promotion will be conducted in participating on-premise licensed venues Australia wide (Participating Venues). Entry into and continued participation in this promotion is subject always to the Participating Venue‟s licensee‟s liquor serving policy. It is a condition of entering the promotion that Entrants obtain admission into the Participating Venues. Participating Venues reserve the right to refuse entry into or eject an Entrant from a Participating Venue for any valid reason (including but not limited to applicable age restrictions, inappropriate behaviour, inappropriate dress standards, or intoxication). The Promoter in its absolute discretion reserves the right to deem any or all entries of an Entrant invalid if the Promoter reasonably believes the Entrant did not obtain official admission into any Participating Venue. These Conditions of Entry apply to each Participating Venue except where context indicates otherwise. 5. The promotional period for the promotion in a Participating Venue will be displayed on a promotional poster in that Participating Venue and is the period from when entry into the promotion commences until entry closes (Promotional Period). The earliest that a Participating Venue‟s promotion may commence is 12:01am (AEST) on 29/8/2011 and the latest that entry into a promotion may close is 11:59pm (AEDT) on 28/10/2011 (excluding Participating Venues in SA where the promotion starts at 12:01am (AEST) on 29/8/2011 and ends at 11:59pm (AEDT) on 28/10/2011).

6. To enter the promotion, Entrants must, during the Promotional Period, purchase any one (1) Jim Beam Black product (Eligible Purchase) from a Participating Venue to receive a promotional card containing a six (6) digit unique code from sales staff at the Participating Venue; and a. send an SMS in the required format to 1978 2777. 7. Maximum of one (1) entry per Entrant per day. Each entry must be based on a separate Eligible Purchase, must be submitted separately and must independently comply with these Conditions of Entry.

2 8. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. 9. Each Entrant must retain and may be required to present proof of each Eligible Purchase in order to claim the Prize. An Entrant may be required to provide to the Promoter proof of purchase for all entries made. If an Entrant is unable to provide proof of purchase for all entries made within the required timeframes, then all the entries of that Entrant will be ineligible and deemed invalid. Proof of purchase includes providing the original, copy or scan of the store receipt for each Eligible Purchase made during the Promotional Period. Purchase receipt(s) must clearly state the Participating Venue and indicate that the Eligible Purchase was made during the Promotional Period but prior to entry.

10. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. Entrants must have the bill payer‟s permission to enter the promotion or their entry will be deemed invalid. Maximum SMS cost $0.55 (including GST) per message sent. Standard carriers' SMS costs may apply. Standard carrier SMS costs remain the responsibility of each Entrant and are dependent on the carrier used and an Entrant‟s mobile phone plan. If a SMS entry is not successful because it is not in the required SMS format or the unique code submitted is not recognised by the Promoter as an eligible unique code for the promotion, an “invalid code” message will be sent to the originating phone number. The “invalid code” message will prompt the Entrant to re-enter the unique code and resubmit their SMS entry in the required form. If an Entrant elects to resubmit their SMS entry via premium SMS, the Entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.

12. If a SMS or online entry is not successful because the Entrant has already submitted one (1) entry that day, a “maximum entries exceeded” message will be sent to the originating telephone number of the Entrant or the mobile telephone number nominated in the Entrant‟s online entry (as applicable) to notify the Entrant that the maximum number of entries permitted has been exceeded for that day. The “maximum entries exceeded” message will prompt the Entrant to re- submit their SMS or online entry on the following day. If the Entrant elects to resubmit their SMS entry via premium SMS, the Entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.

13. If an online entry is not successful because the unique code submitted is not recognised by the Promoter, the Entrant will be prompted to try again. The “try again” message will prompt the Entrant to check their unique code and resubmit their online entry in the required manner. 14. Costs associated with accessing the Promotional Website remain an Entrant‟s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Promotional Website by an Entrant will deem an entry invalid.

15. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. 16. The draw to determine the winner will take place at 12:00pm (AEDT) on 15/11/2011 at MessageMedia Interactive, Level 22, 385 Bourke Street, Melbourne VIC 3000. Winner will be notified by telephone and in writing (by mail or email). Winner‟s name and locality will be

The first eligible entry randomly drawn from all entries received will win one (1) „Become 6% Famous‟ experience for the winner and up to five (5) companions aged 18 years or older, valued at up to $6,000.00 (Prize). The Prize will take place in the capital city closest to the ordinary residential address of the winner (Capital City) from the time of check-in at a hotel nominated by the Promoter in the Capital City (Hotel) to the time of check-out at the Hotel the following day during the period 15/1/2012 – 15/6/2012 (inclusive) (Prize Period). The Prize comprises of the following elements: a. one (1) night minimum three (3) star accommodation at the Hotel (twin share) (or similar); b. one (1) dining experience at a restaurant nominated by the Promoter in the Capital City, valued at up to $500.00; c. entry into one (1) nightclub nominated by the Promoter in the Capital City; d. one (1) transfer in a stretch hummer from the restaurant to the nightclub only, for a maximum of up to one (1) hour duration; e. one (1) security guard to chaperone the winner and their companions (if any) during the Prize Period, for a maximum of up to five (5) hours duration; and f. $1,000.00 spending money for the winner only.

18. The Promoter may draw five (5) additional reserve entries in the draw and record them (in order) in case an invalid entry or ineligible Entrant is drawn or the Entrant is unable to accept or participate in the Prize. In the event of an invalid entry or an ineligible Entrant, or if the Entrant is unable to accept the Prize or declines to participate in the Prize, the Prize will be awarded to the first reserve entry drawn. If the Prize cannot be awarded to the Entrant drawn, the Promoter will continue the process until the Prize is awarded. If after this process the Prize has still not been awarded, the Promoter will hold an unclaimed prize draw in accordance with Condition 25. 19. The precise dates for participation in the Prize will be subject to reasonable notice given to the Promoter of the availability of the winner and their companions (if any) during the Prize Period and will be determined by the Promoter in the Promoter‟s sole discretion. The times for check-in and check-out at the Hotel are dependent upon the Hotel‟s policy and will be confirmed by the Promoter in the Promoter‟s sole discretion. Once the Prize and Prize Period (including the schedule of activities included in the Prize) is confirmed by the Promoter with the winner, no changes may be made to any scheduling of the Prize by the winner. No extension or variation of the times and dates nominated by the Promoter permitted. In the event suitable times and dates for participation in the Prize cannot be reached between the winner and the Promoter, or the winner is unable to participate in the Prize during the Prize Period (on the times and dates determined by the Promoter in the Promoter‟s sole discretion), their winning entry into the promotion will be deemed invalid with no compensation payable and the Promoter may award the Prize to another entry in accordance with Condition 18.

20. Redemption of the Prize is subject to availability and may be dependent on the availability of the accommodation/restaurant/nightclub/transfer/security or any other applicable Prize suppliers or representatives of the Promoter and any „blackout‟ periods applying (including but not limited to public holidays and the periods 26/1/2012 – 29/1/2012 and 5/4/2012 – 10/4/2012 (inclusive). All components of the Prize must be taken together and when offered or are forfeited. The winner and their companions (if any) must participate in the Prize together at all times. Participation in the Prize and any passes or vouchers issued as part of the Prize may be subject to prevailing terms and conditions of use. The Prize cannot be used in conjunction with any other special offers. All components of the Prize are to be arranged by an agent nominated by the Promoter in its sole discretion.

21. The winner and their companions (if any) are responsible for all additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize. Such additional costs include, but are not limited to additional meals, beverages, room service, telephone calls, laundry services, additional spending money, and any other transfers. The Prize must be taken in the

4 Capital City closest to the winner‟s nominated residential address. The winner and their companions (if any) are responsible for transport to and from the Hotel and their ordinary residential address. The winner may be required to present a credit card at time of accommodation check-in. 22. The winner and their companions (if any) must conduct themselves in a friendly, courteous and respectable manner at all times during their participation in the Prize. Acceptance of and participation in the Prize (including but not limited to entry into any Prize venue) is subject to any prevailing terms and conditions of the Prize suppliers (including any applicable age restrictions and dress standards), and in particular, health, behaviour, and safety requirements. The winner and their companions (if any) must follow all reasonable directions given by the Promoter and any Prize supplier (including but not limited to the security guard) during the course of their participation in the Prize, including all directions in relation to health, behaviour, safety or responsible consumption of alcohol. The Promoter and any Prize Supplier reserves the right, in their sole discretion, to disqualify, sanction, eject and/or refuse entry of the winner or any companion(s) and/or terminate the Prize on the grounds of inappropriate behaviour, for health or safety reasons, or for any breach of these Conditions of Entry generally, during the taking of the Prize or at any other time in respect of this promotion. If the winner or any companion(s) fails to participate in the Prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry into this promotion and the balance of the Prize will be forfeited with no compensation payable.

23. The Promoter reserves the right to disqualify the winner or any companion(s), prohibit the winner‟s or any companion(s)‟ participation in the Prize or any component of the Prize, or otherwise cease to provide any Prize benefit to the winner or any companion(s) (as applicable) if the winner or any companion(s) acts in a way, or causes material to be published, which the Promoter in its sole discretion deems to be inappropriate, aggressive, defamatory, offensive, or contrary to law, to diminish the good name or reputation of any Prize supplier or the Promoter, its products or any of its related bodies corporate, or otherwise is not in keeping with the spirit of the promotion. For the avoidance of doubt, the winner can be disqualified after the winner is notified and published if the winner is found to have not acted in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 24. Total maximum prize value is up to $6,000.00. The Prize is not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize value. The Prize value is the recommended retail price including GST.

25. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 15/12/2011 in order to distribute the Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of a winner in the unclaimed prize draw, the winner will be notified by telephone and in writing (by mail or email) and the winner‟s name and locality will be published in The Australian on 22/12/2011. 26. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter‟s satisfaction, at its sole discretion) in order to confirm the

5 Entrant‟s identity, age, residential address, eligibility to enter and claim the Prize, that the Entrant obtained the bill payer‟s consent to enter by SMS before submitting their entry (if applicable), that the Entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the Entrant in entering the promotion, before issuing the Prize or as and when required during participation in the Prize. A free reply SMS will be sent to an Entrant submitting an entry by SMS immediately after their entry has been received confirming their entry has been successfully received and advising that their entry has been entered into a draw. If a SMS entry is not successful because it is not in the required SMS format or the unique code submitted is not recognised by the Promoter as an eligible unique code for the promotion, an “invalid code” message will be sent to the originating phone number. The “invalid code” message will prompt the Entrant to re-enter the unique code and resubmit their SMS entry in the required form. If an Entrant elects to resubmit their SMS entry via premium SMS, the Entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.

12. If a SMS or online entry is not successful because the Entrant has already submitted one (1) entry that day, a “maximum entries exceeded” message will be sent to the originating telephone number of the Entrant or the mobile telephone number nominated in the Entrant‟s online entry (as applicable) to notify the Entrant that the maximum number of entries permitted has been exceeded for that day. The “maximum entries exceeded” message will prompt the Entrant to re- submit their SMS or online entry on the following day. If the Entrant elects to resubmit their SMS entry via premium SMS, the Entrant will be charged again at a maximum SMS cost of $0.55 (including GST) per message sent.

13. If an online entry is not successful because the unique code submitted is not recognised by the Promoter, the Entrant will be prompted to try again. The “try again” message will prompt the Entrant to check their unique code and resubmit their online entry in the required manner. 14. Costs associated with accessing the Promotional Website remain an Entrant‟s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Promotional Website by an Entrant will deem an entry invalid.

15. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. 16. The draws to determine the winners will take place at 1:00pm (AEDT) on 15/11/2011 at MessageMedia Interactive, Level 22, 385 Bourke Street, Melbourne VIC 3000. Winners will be notified by telephone and in writing (by mail or email). Winners‟ names and localities will be published in The Australian on 22/11/2011. The Promoter‟s decision is final and no correspondence will be entered into.

The first eligible entry randomly drawn from all entries received in each State Group will win one (1) „Become 6% Famous‟ experience for the winner and up to five (5) companions aged 18 years or older, valued at up to $6,000.00 (Prize). Each Prize will take place in the capital city closest to the the Participating Outlet where the winner‟s Eligible Purchase was made (Capital City) from the time of check-in at a hotel nominated by the Promoter in the Capital City (Hotel) to the time of check-out at the Hotel the following day during the period 15/1/2012 – 15/6/2012 (inclusive) (Prize Period). A Prize comprises of the following elements: a. one (1) night minimum three (3) star accommodation at the Hotel (twin share) (or similar); b. one (1) dining experience at a restaurant nominated by the Promoter in the Capital City, valued at up to $500.00; c. entry into one (1) nightclub nominated by the Promoter in the Capital City; d. one (1) transfer in a stretch hummer from the restaurant to the nightclub only, for a maximum of up to one (1) hour duration; e. one (1) security guard to chaperone the winner and their companions (if any) during the Prize Period, for a maximum of up to five (5) hours duration; and f. $1,000.00 spending money for the winner only.

18. The Promoter may draw five (5) additional reserve entries in the draws and record them (in order) in case an invalid entry or ineligible Entrant is drawn or an Entrant is unable to accept or participate in a Prize. In the event of an invalid entry or an ineligible Entrant, or if an Entrant is unable to accept a Prize or declines to participate in a Prize, the Prize will be awarded to the first reserve entry drawn. If the Prize cannot be awarded to the Entrant drawn, the Promoter will continue the process until the Prize is awarded. If after this process the Prize has still not been awarded, the Promoter will hold an unclaimed prize draw in accordance with Condition 25. 19. The precise dates for participation in a Prize will be subject to reasonable notice given to the Promoter of the availability of a winner and their companions (if any) during the Prize Period and will be determined by the Promoter in the Promoter‟s sole discretion. The times for check-in and check-out at the Hotel are dependent upon the Hotel‟s policy and will be confirmed by the Promoter in the Promoter‟s sole discretion. Once a Prize and Prize Period (including the schedule of activities included in a Prize) is confirmed by the Promoter with a winner, no changes may be made to any scheduling of the Prize by the winner. No extension or variation of the times and dates nominated by the Promoter permitted. In the event suitable times and dates for participation in a Prize cannot be reached between a winner and the Promoter, or a winner is unable to participate in the Prize during the Prize Period (on the times and dates determined by the Promoter in the Promoter‟s sole discretion), their winning entry into the promotion will be deemed invalid with no compensation payable and the Promoter may award the Prize to another entry in accordance with Condition 18.

20. Redemption of a Prize is subject to availability and may be dependent on the availability of the accommodation/restaurant/nightclub/transfer/security or any other applicable Prize suppliers or representatives of the Promoter and any „blackout‟ periods applying ((including but not limited to public holidays and the periods 26/1/2012 – 29/1/2012 and 5/4/2012 – 10/4/2012 (inclusive)). All components of a Prize must be taken together and when offered or are forfeited. Winners and their companions (if any) must participate in a Prize together at all times. Participation in a Prize and any passes or vouchers issued as part of a Prize may be subject to prevailing terms and conditions of use. A Prize cannot be used in conjunction with any other special offers. All components of a Prize are to be arranged by an agent nominated by the Promoter in its sole discretion.

21. Winners and their companions (if any) are responsible for all additional costs not expressly stated, but which may be incurred in acceptance and use of a Prize. Such additional costs include, but are not limited to additional meals, beverages, room service, telephone calls, laundry services, additional spending money, and any other transfers. Each Prize must be taken in the Capital City closest to where the winner‟s Eligible Purchase was made. A winner and their companions (if any) are responsible for transport to and from the Hotel and their ordinary residential address, including any applicable airfares to the Capital City so that the winner and their companions (if any) can

10 participate in a Prize. A winner may be required to present a credit card at time of accommodation check-in. 22. Winners and their companions (if any) must conduct themselves in a friendly, courteous and respectable manner at all times during their participation in a Prize. Acceptance of and participation in a Prize (including but not limited to entry into any Prize venue) is subject to any prevailing terms and conditions of Prize suppliers (including any applicable age restrictions and dress standards), and in particular, health, behaviour, and safety requirements. Winners and their companions (if any) must follow all reasonable directions given by the Promoter and any Prize supplier (including but not limited to the security guard) during the course of their participation in a Prize, including all directions in relation to health, behaviour, safety or responsible consumption of alcohol. The Promoter and any Prize Supplier reserves the right, in their sole discretion, to disqualify, sanction, eject and/or refuse entry of a winner or any companion(s) and/or terminate a Prize on the grounds of inappropriate behaviour, for health or safety reasons, or for any breach of these Conditions of Entry generally, during the taking of a Prize or at any other time in respect of this promotion. If a winner or any companion(s) fails to participate in a Prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry into this promotion and the balance of the Prize will be forfeited with no compensation payable. 23. The Promoter reserves the right to disqualify a winner or any companion(s), prohibit a winner‟s or any companion(s)‟ participation in a Prize or any component of a Prize, or otherwise cease to provide any Prize benefit to a winner or any companion(s) (as applicable) if a winner or any companion(s) acts in a way, or causes material to be published, which the Promoter in its sole discretion deems to be inappropriate, aggressive, defamatory, offensive, or contrary to law, to diminish the good name or reputation of any Prize supplier or the Promoter, its products or any of its related bodies corporate, or is otherwise not in keeping with the spirit of the promotion. For the avoidance of doubt, a winner can be disqualified after the winner is notified and published if the winner is found to have not acted in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 24. Total maximum prize value for each State Group is up to $6,000.00. Total maximum prize pool value Australia wide is up to $30,000.00. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize value. All Prize values are the recommended retail price including GST. 25. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 15/12/2011 in order to distribute any Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner(s) will be notified by telephone and in writing (by mail or email) and the winner(s)‟ names and localities will be published in The Australian on 22/12/2011. 26. 27. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request an Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter‟s satisfaction, at its sole discretion) in order to confirm the Entrant‟s identity, age, residential address, eligibility to enter and claim a Prize, that the Entrant obtained the bill payer‟s consent to enter by SMS before submitting their entry (if applicable), that the Entrant has a clear relationship with the end mobile device used to enter via SMS (if

11 applicable), and any information submitted by the Entrant in entering the promotion, before issuing a Prize or as and when required during participation in a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter‟s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid. 28. The Promoter reserves the right to request a winner‟s companions (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter‟s satisfaction, at its sole discretion) in order to confirm the companions‟ (if any) identity and age before issuing a Prize or as and when required during participation in a Prize. 29. It is a condition of accepting a Prize that a winner and their companions (if any) may be required to agree to a code of conduct and/or sign a legal release or releases in a form determined by the Promoter and/or any Prize supplier in their absolute discretion.

30. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter‟s legal rights to recover damages or other compensation from such an offender are reserved. A Prize will only be awarded following any winner and/or unique code validation and verification that the Promoter requires in its sole discretion. 31. Any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

32. If a Prize or element of a Prize becomes unavailable, for any reason beyond the Promoter‟s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation. 33. If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize to the same value as an original Prize, subject to any written directions made under applicable State or Territory legislation. 34. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, Prize claims or Prizes; and/or (iv) acceptance and/or use of any element of Prizes. 35. As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant‟s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.

If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner‟s name and locality in any media, as required under the relevant State or Territory lottery legislation. By participating in the promotion, an Entrant also acknowledges that a further primary purpose for collection of the Entrant‟s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way.
