Exceptional circumstances in support of the application

   The Secretary, NSW Treasury, may only grant an exemption if satisfied that it is, in the exceptional circumstances of
   the case, in the public interest to approve this application.
   Please specifY the exceptional circumstances in support of your exemption application for the shop and restricted
   trading day specified above. "Exceptional circumstances" must be more than "special circumstances" to satisfY the
   requirements under section 10(2) of the Retail Trading Act 2008.

Allowing trade within the Sydney CBD stores would provide those customers here on holiday, or whom do not
celebrate traditional Easter holidays the opportunity to shop within the Sydney tourism precinct.

Very limited opportunities are available to those wishing to shop within Sydney and NSW on Easter Sunday.

Those wishing to shop would have to travel far to a store or shopping area on the Central Coast e.g. Tuggerah, or the
South Coast e.g. Shell Harbour which is an inconvenience if staying within the Sydney CBD area and also costly.

   To enable the Secretary, NSW Treasury, to determine whether the exemption sought is in the public interest, please
   answer the following questions.

    1. What is the nature of the business and kinds of goods sold?

The store Is a part of a global retail clothing company selling ladies wear apparel, menswear apparel, footwear,
accessories.




    2. What is the need for the shop to be open on the restricted trading day?

We believe there is a demand and want for retail trading within the Sydney city area on the Easter Sunday and limited
options are available to those wishing to.

The multicultural demographic that exists within Sydney area means many of our customers do not partake in
traditional Easter Sunday celebrations, and believe they would appreciate an opportunity to shop.

3. What is the likely effect on the local economy, tourism, small businesses and other businesses in the area if the

We believe that the effect on the local economy would be a positive one. Cotton On is a destination store, allowing
trade with us would bring additional people to the Sydney city area, also having a positive effect on those other
retailers and businesses trading within the area on Easter Sunday,




    4. What is the likely effect on employees or persons worklng In the shop if the exemption is granted?
       [In your response indicate the number of employees likely to work on the restricted trading day if an exemption
       is granted, and specify the industrial instrumentls (including agreement numberls), under which employees
       working on the day will be employed]

The Cotton On Group store employees fall under the General Retail industry Award 2010.

It is voluntary for all casual employees to work on Easter Sunday and If they elect to work they are paid their ordinary
hourly rate plus 150% for all time worked.

All permanent employees are entitled to take a day in lieu for working a public holiday which Is mutually agreed by
the employee and Cotton On Group.

We believe that there would be a positive effect on employees as those who chose to work are provided with the
opportunity to earn incremental income.

The Cotton On Group estimates that this would create an opportunity for approximately 5-10 team members.

It Is an offence to fail to comply with any conditions imposed on an exemption by the Secretary.
