                                 2019 Plot Rental Agreement
By executing this Plot Rental Agreement and being invited and accepted for Membership by WFA, the
Gardener agrees to abide by all the rules, policies and practices set forth herein and those posted
throughout the Community Garden grounds. The gardener understands and agrees that these rules,
policies and practices may be subject to change at any time at the sole discretion of the WFA Trustees.

Membership
Membership in the Community Garden is by invitation only and considered on a year to year basis.
The invitation is extended at the sole direction and discretion of the WFA Trustees to both new and
returning gardeners. The invitation is to only the named gardener(s) and this invitation cannot be
given, sold, transferred, leased, sublet or in any way transmitted to any other person or party and the
gardener’s only recourse is to return the plot to the WFA. Failure to complete the required
payments, volunteering requirements and/or failure to follow the rules, policies and practices of the
Community Garden will be considered when deciding which gardeners will receive invitations to
return.

Invitations for plot registration and payment will begin in January 2019 for the 2019 season. If invited
for registering, updated Registration Forms, a signed Membership Agreement, WFA membership fee
and plot rental fee must be received by February 19, 2019. Please note, if the agreement and packet
is not received by February 19, 2019, there will be a $10.00 late fee. All unpaid plots will be returned
to the WFA.

Wagner Farm Arboretum (WFA) Membership Fees
In addition to the annual Membership fee for WFA as set forth on the Registration form, Gardeners
are responsible for the annual rental of a Community Garden full plot at an annual cost of $60.00 and
half plot of $30.00.

Service/Support Hours
The Community Garden is a volunteer run organization and all members are required to complete
service/support activities. The Gardener agrees to provide a minimum of four (4) hours specifically for
Brite Nites and four (4) hours at various garden related chores/activities or events for a total of 8 hours
per plot. For those with ½ plots, Brite Nites requirement will be two (2) hours as well as two (2) hours
at various garden related chores/activities or events for a total of 4 hours per ½ plot. It is the
responsibility of the Gardener to sign- up for service/support activities and to report time completed to
the Garden Managers within one week of completion to volunteerhours@wfafnj.org.
 If, for any reason, the hours required cannot be completed, the Garden Manager must be notified
immediately who, in turn, reports to the Board of Trustees for final approval.

Plot
The plot(s) are to be actively tended. This means 80% – 100% of the plot is planted and 100%
maintained throughout the growing season.
     Weeds must be removed from both the plot(s) and the paths.
     Plants cannot obstruct paths (i.e. vines, sunflowers)
     If plot(s) remain poorly maintained after two (2) written requests from your Garden
        Manager to clean-up, gardener privileges may be revoked at any time.

Paths
It is the responsibility of each gardener to lay new wood chips down, provided by WFA by
April 30, 2019 and to maintain a weed free path. The path consists of the entire width on the west
side (silo) of the plot and the south side (Mountain Ave) of the plot including:
       Rows A & B – 3 feet in to the main path
       Row F – up to fence

Organic Gardening
WFAF Community Garden is an organic garden. Non-organic pesticides, fungicides, herbicides
and fertilizers are prohibited. Information on organic gardening is available on the WFAF
website. It may not be organic, even if the label says “natural, ask your garden manager.

End of Season Cleanup
During cleanup, any unsecured netting, fencing, plastic materials, watering cans, etc. must be
removed from all gardening plots. Items such as stepping stones, plant supports and other approved
garden items can remain in the plot over the winter provided they are tied down, anchored and
secured from the weather. Plots must also be cleared of all plants and weeds with the exception of
perennials or winter crops.

Dumpster
A dumpster is provided for the convenience of the Community Garden members. All dumpster
materials are composted! The dumpster is only for plant material from the Community Garden. NO
STRINGS, WIRES, ROCKS, PLANT TAGS, WOOD, ETC. Please remember your garbage must go home
with you.

Gardener Absence
If you are away, it’s your responsibility to find someone to tend your plot. WFA requires all assisting
gardeners to complete and submit a Volunteer Release and Waiver form. The form is available on the
WFA website and must be on file at the WFA office. If you are unable to maintain your plot(s) for any
extended period of time, please contact your Garden Manager.

Visitors, Guests, Children
The Gardener agrees to accompany and be responsible for any guest, visitor and/or children on WFA
property. Anyone unaccompanied by the Gardener must have a Volunteer Release and Waiver form
completed and on file at the WFA office.

Pets
Pets are not permitted inside the fenced Community Garden area with the exception of official service
animals. Pets must be attended to at all times and may not be left unattended in a parked vehicle or
tied up on the WFA property.

Hoses
     Use only the soft retractable hoses supplied by the garden and return after each use. You may
      bring your own of the same type, but it must be removed after each use.
    Gardeners must be present at their plots while watering with a hose.
       Gardeners need to be diligent in shutting the water off after each use.
       Drip irrigation and/or sprinklers are NOT ALLOWED.
       All gardeners should be considerate when watering. If someone is waiting, please limit your
   time to 15 minutes.
       Please respect the surrounding plots. Watering hoses must not cross other plots.
       Make sure hose connections are tight so water is not wasted or cause a problem with soggy
        spots in other plots or common areas. Please report any leaks and/or damages to your
        garden manager as soon as possible.
       Standing water or excessive wet spots are breeding grounds for the mosquito which is a
        health hazard. Please do not have containers filled with water in your plots. Empty all
        containers and store them upside down.
       Please supervise children who are watering with hoses.

Structures
Permanent structures must be pre-approved by the WFA Board of Trustees. Structures not
preapproved will be removed.
There is a 6’ height restriction for all plants, trellises, and framework as measured from the garden path.
Lumber used in raised beds can be treated i.e. no pressure treated wood.

Garden Equipment
The Community garden supplies wheelbarrows, watering cans, retractable hoses, and limited
garden tools marked with orange paint are for members use. All equipment should remain in the
garden and be returned to their holders after use. The Giving Garden equipment stored in the shed
is specifically for use by Giving Garden volunteers.

Parking
Parking is in designated areas only. You may not:
     Drive your vehicle into the Garden
     Block the garden gates or main driveway at Mountain Avenue
     Illegally park in the handicap area.

General Guidelines
Engaging in any of the following activities will result in loss of gardening privileges: Use of non-organic
products, smoking, vandalizing, theft, consumption of alcoholic beverages, gambling, carrying firearms,
use of illegal drugs, cultivation of illegal plants or raising livestock. Warren Township has an ordinance
that prohibits smoking on township property which includes all of the arboretum grounds.

Miscellaneous
The Gardener agrees to hold harmless WFAF and the Township of Warren and for any liability, damage,
loss or claim that occurs in connection with use of the Community Garden by Gardener’s guests or by
Gardener. Further, in no event will the total liability to Gardener by WFAF, the Township of Warren or
any employees or agents for damages exceed the amount of annual Membership and Registration fees.

The Gardener also understands that use of the Community garden is without any warranties as to
fitness for any particular purpose and neither WFAF nor the Township of Warren is responsible for
any acts of God that may prevent use of and access to the Community garden. This Membership
Agreement is governed by, construed, and enforced in accordance with the laws of the State of
New Jersey.
