2019 Candidate Election Packet
1 TO: Candidates for Mayor and City Council FROM: Jeanine Oosse, Municipal Clerk DATE: January 16, 2019 RE: General Election - May 4, 2019 Thank you for your interest in becoming a candidate for Troy Mayor or to become a candidate for the Troy City Council. This year, we will be electing one (1) citizen to serve as Mayor and two (2) citizens to serve on our City Council. Each member elected will serve a two-year term, from May 2019 to May 2021. Running for office encompasses a broad range of activities. The Secretary of the State of Texas and the Texas Ethics Commission each regulate portions of the election process at the local level. It is your responsibility to familiarize yourself with the laws applicable to running for elective office. As Municipal Clerk for the City of Troy, I will be happy to answer general questions regarding due dates for reporting and filings. I am, however, constrained from offering legal advice or opinions to any candidate. The Office of the Municipal Clerk is specifically limited by law to the acceptance and filing of various applications, affidavits, statements and reports, and noting the date and time of all such filings. These documents become public records upon filing and are available for public inspection. Included in this packet of information is a list of events and deadlines, along with forms and general information. This packet only contains a small portion of the regulations that govern municipal elections, candidates and/or officeholders. It is the responsibility of each candidate to obtain any necessary information regarding relevant laws and to abide by those laws. The Legislature enacts changes from time to time relating to voting procedures, applications, and filing deadlines. TITLE 9. CANDIDATES
CHAPTER 141. CANDIDACY FOR PUBLIC OFFICE GENERALLY
SUBCHAPTER A. ELIGIBILITY FOR PUBLIC OFFICE
Sec. 141.001. ELIGIBILITY REQUIREMENTS FOR PUBLIC OFFICE. (a) To
be eligible to be a candidate for, or elected or appointed to, a public elective office in this
state, a person must:
(1) be a United States citizen;
(2) be 18 years of age or older on the first day of the term to be filled at
the election or on the date of appointment, as applicable;
(3) have not been determined by a final judgment of a court exercising
probate jurisdiction to be:
(A) totally mentally incapacitated; or
(B) partially mentally incapacitated without the right to vote;

has not been pardoned or otherwise released from the resulting disabilities;
(5) have resided continuously in the state for 12 months and in the
territory from which the office is elected for six months immediately preceding the
following date:
(A) for a candidate whose name is to appear on a general
primary election ballot, the date of the regular filing deadline for a candidate's
application for a place on the ballot;
(B) for an independent candidate, the date of the regular filing
deadline for a candidate's application for a place on the ballot;
(C) for a write-in candidate, the date of the election at which
the candidate's name is written in;
(D) for a party nominee who is nominated by any method other
than by primary election, the date the nomination is made; and
(E) for an appointee to an office, the date the appointment is
made; and
(6) satisfy any other eligibility requirements prescribed by law for the
office.
(b) A statute outside this code supersedes Subsection (a) to the extent of any
conflict.
(c) Subsection (a) does not apply to an office for which the federal or state
constitution or a statute outside this code prescribes exclusive eligibility requirements.

Source: http://www.statutes.legis.state.tx.us/Docs/EL/htm/EL.141.htm Eligibility for Public OfficeARTICLE 9.02 CODE OF ETHICS Sec. 9.02.001 Declaration of policy It is hereby declared to be the policy of the city that the proper operation of representative government requires that public officials and employees be independent, impartial, and responsible only to the people of the city; that the governmental decisions and policy be made in the proper channels of the governmental structure; that no officer, employee, or member of any standing committee or board should have any interest, financial or otherwise, direct or indirect, or engage in any business transaction or professional activity, or incur any obligation of any nature which is in conflict with the proper discharge of his duties in the public interest; that public office not be used for personal gain; and that the city council at all times shall be maintained as a representative body. To implement such a policy, the city council deems it advisable to enact a code of ethics for all officials and employees, whether elected or appointed, paid or unpaid, to serve not only as a guide for official conduct of the city’s public servants, but also as a basis for enforcement of high ethical standards. (Ordinance 2305, sec. 1, adopted 1/10/05) Sec. 9.02.002 Definitions In this article unless the context other requires: Employee. Any person employed by the city whether under civil service or not, including those individuals on a part-time basis, but shall not be extended to apply to any independent contractor. Officer. Any member of the city council and any appointive member of a commission or board set up by ordinance or state law on a permanent basis. (Ordinance 2305, sec. 2, adopted 1/10/05) Sec. 9.02.003 Standards of conduct (a) No officer or employee of the city shall: Code of Ethics City of Troy
(1) Accept any gift or favor from any person, firm, or corporation that
might reasonably tend to influence him in the discharge of his official duties,
or grant in the discharge of his official duties any improper favor, service, or
thing of value.
(2) Grant any special consideration, treatment, or advantage to any
citizen, individual, or group beyond that which is available to every other
citizen, individual, or group.
(3) Disclose information that could adversely affect the property,
government, or affairs of the city, nor directly or indirectly use any
information gained by reason of his official position or employment for his
own personal gain or benefit or for the private interest of others.
(4) Transact any business on behalf of the city in his official capacity
with any business entity with which he is an officer, agent, or member, or in
which he owns a substantial interest. In the event that such a circumstance
should arise, then he shall make known his interest, and in the case of an
officer, abstain from voting on the matter, or in the case of an employee,
turn the matter over to his superior for reassignment, state the reasons for
doing so, and have nothing further to do with the matter involved.
(5) Engage in any outside activities which will conflict with, or will be
incompatible with, the duties assigned to him in the employment of the city,
or reflect discredit upon the city, or in which his employment in the city will
give him an advantage over others engaged in a similar business, vocation,
or activity.
(6) Accept other employment or engage in outside activities
incompatible with the full and proper discharge of his duties and
responsibilities with the city, or which might impair his independent
judgment in the performance of his public duty.
(7) Receive any fee or compensation for his services as an officer or
employee of the city from any source other than the city except as may be
otherwise provided by law. This shall not prohibit his performing the same
or other services for a private organization that he performs for the city if
there is no conflict with his responsibilities.
(8) Represent, directly or indirectly, or appear in behalf of private
interests of others before any agency of the city or any of its agencies.
(9) Use his official position to secure special privileges or exemptions
for himself or others.
Code of Ethics City of Troy(b) The foregoing shall not be deemed to deny to such party any right or privilege guaranteed by law or the federal and state constitutions. Where the advocacy of a right or privilege, however, is incompatible with the position held by the advocate, such party shall make an election so that his position with the city and his advocacy will not be incompatible. (c) Where the advocacy of a right or privilege is occasional and infrequent or involves little or no discretion, the advocate shall abstain from any action as an officer or employee that would reasonably appear to influence the outcome of the matter, such as voting on the matter, sitting on a board or tribunal charged with deciding the issue when the issue is to be decided; or in the case of an employee, personally processing the matter. (d) Where the advocacy of the right or privilege is usual and frequent or can reasonably be expected to arise in due course of one’s occupation or profession, then such officer or employee shall remove himself from his position with the city, or so much of such position as may be incompatible, until such position of incompatibility ceases to exist. (Ordinance 2305, sec. 3, adopted 1/10/05) Sec. 9.02.004 Disclosure of interest Any officer, whether elected or appointed, who has either a personal or private interest in any matter pending before his committee or board shall disclose such interest to the other members of the committee or board and shall refrain from discussing the same with any other member of the committee or board and shall not vote thereon. (Ordinance 2305, sec. 4, adopted 1/10/05) Sec. 9.02.005 Penalty The failure of any officer or employee to comply with or who violates one or more of the foregoing standards of conduct, which apply to him, shall constitute grounds for expulsion, reprimand, removal from office, or discharge, whichever is applicable. In the case of an employee of the city, disciplinary action and appeals therefrom must be in compliance with state law. In the case of a city councilman, the matter shall be decided by a majority of the remainder of the councilmen. In the case of members of boards or commissions or officers removable by the council, the matters shall be decided by the city council. The decision of these bodies shall be final in the absence of bias, prejudice, or fraud. (Ordinance 2305, sec. 5, adopted 1/10/05

INSTRUCTIONS
An application to have the name of a candidate placed on the ballot for any election may not be filed earlier than 30 days before the deadline prescribed
by this code for filing the application. An application filed before that day is void.
The filing deadline is 5:00 p.m. 71 days prior to the election day if the election is held in May or November of an odd-numbered year, except in cases
where the law specifies the contrary.
The filing deadline is 5:00 p.m. 78 days prior to the election day if the election is held in November of an even-numbered year.
The candidate must sign this statement indicating his awareness of the nepotism law. The nepotism prohibitions of chapter 573, Government Code,
are summarized below:
No officer may appoint, or vote for or confirm the appointment or employment of any person related within the second degree by affinity (marriage)
or the third degree by consanguinity (blood) to himself, or to any other member of the governing body or court on which he serves when the
compensation of that person is to be paid out of public funds or fees of office. However, nothing in the law prevents the appointment, voting for, or
confirmation of anyone who has been continuously employed in the office or employment for the following period prior to the election or appointment
of the officer or member related to the employee in the prohibited degree: six months, if the officer or member is elected at the general election for
state and county officers.
No candidate may take action to influence an employee of the office to which the candidate is seeking election or an employee or officer of the
governmental body to which the candidate is seeking election regarding the appointment or employment of a person related to the candidate in a
prohibited degree as noted above. This prohibition does not apply to a candidate's actions with respect to a bona fide class or category of employees or
prospective employees.
Examples of relatives within the third degree of consanguinity are as follows:
(1) First degree: parent, child;
(2) Second degree: brother, sister, grandparent, grandchild;
(3) Third degree: great-grandparent, great-grandchild, uncle, aunt, nephew, niece.
These include relatives by blood, half-blood, and legal adoption.
Examples of relatives within the second degree of affinity are as follows:
(1) First degree: spouse, spouse's parent, son-in-law, daughter-in-law;
(2) Second degree: brother's spouse, sister's spouse, spouse's brother, spouse's sister, spouse's grandparent.
Persons related by affinity (marriage) include spouses of relatives by consanguinity, and, if married, the spouse and the spouse's relatives by
consanguinity. These examples are not all inclusive.

CODE OF FAIR CAMPAIGN PRACTICES
There are basic principles of decency, honesty, and fair play that every candidate and political committee in this state
has a moral obligation to observe and uphold, in order that, after vigorously contested but fairly conducted campaigns,
our citizens may exercise their constitutional rights to a free and untrammeled choice and the will of the people may be
fully and clearly expressed on the issues.
THEREFORE:
(1) I will conduct the campaign openly and publicly and limit attacks on my opponent to legitimate challenges to my
opponent’s record and stated positions on issues.
(2) I will not use or permit the use of character defamation, whispering campaigns, libel, slander, or scurrilous attacks
on any candidate or the candidate’s personal or family life.
(3) I will not use or permit any appeal to negative prejudice based on race, sex, religion, or national origin.
(4) I will not use campaign material of any sort that misrepresents, distorts, or otherwise falsifies the facts, nor will I
use malicious or unfounded accusations that aim at creating or exploiting doubts, without justification, as to the
personal integrity or patriotism of my opponent.
(5) I will not undertake or condone any dishonest or unethical practice that tends to corrupt or undermine our system
of free elections or that hampers or prevents the full and free expression of the will of the voters, including any
activity aimed at intimidating voters or discouraging them from voting.
(6) I will defend and uphold the right of every qualified voter to full and equal participation in the electoral process,
and will not engage in any activity aimed at intimidating voters or discouraging them from voting.
(7) I will immediately and publicly repudiate methods and tactics that may come from others that I have pledged not
to use or condone. I shall take firm action against any subordinate who violates any provision of this code or the
laws governingelections.
I, the undersigned, candidate for election to public office in the State of Texas or campaign treasurer of a political
committee, hereby voluntarily endorse, subscribe to, and solemnly pledge myself to conduct the campaign in accordance
with the above principles and practices.
