When a doctor is on probation by the Medical Board of California or the
Osteopathic Medical Board of California, 276/ 714 states that medical exemptions
written by that doctor are not accepted until probation is complete. There is no RMT
doctor on probation..
I am not aware of any process by which the medical boards tell patients that a doctor
is on probation, but we will certainly keep you posted as soon as we have any notice
from the medical board. It is interesting that the rst word we had of Dr. Sutton being
subpoenaed was from a reporter at Kaiser Health News. The reporter knew before we
did! Media is on the inside track with MBC investigators., moreso than the professionals
being investigated. That is a topsy-turvy world. There are 68 doctors being
investigated at last count.
The Department of Public Health can declare that an exempting doctor creates a risk
to public health, but it is not clear if this begins only in January, 2021, or sooner.

TK / K The most questions I received revolve around starting Kindergarten in 2020.
Kindergarten is a check point, so a child starting kindergarten in 2020 must have
vaccinations or a medical exemption. MEs written in 2015-2019 only apply until the
next grade span. Unfortunately in this case, that would be until kindergarten in 2020,
not beyond.
If your child starts 7th grade in 2020, that is also a gradespan, and ME written prior
to 2020 does not apply.
If your child can legally be registered in kindergarten or seventh grade in 2019, do so
now. Ask your school what is the age limit for starting kindergarten in that particular
school. A child in kindergarten in 2019 with a ME, is grandfathered until the next grade
span which is 7th grade. This does not appear to count for TK. HOMESCHOOL IF YOU
CAN. Find a group of families to work with. Your child is not in the database if you
homeschool and you have vaccine choice. This is your greatest point of freedom
both educationally (higher quality) and medically.
MEs written in 2020 are based on 277 criteria, but are limited to 4 per doctor, and
are by de nition temporary, only good for the calendar year 2020. So MEs written in
2020 will be rare as hens' teeth, unless the doctor has decided to exceed the limit of 5
and endure being reviewed and possibly being refused the option of writing any MEs
for two years. Please assume that you will not be able to get a ME in 2020.
Essentially, now is the best time to get a medical exemption, until the end of 2019,
when it has a chance to be grandfathered in until the next gradespan.
The law is SILENT on whether changing schools requires a new ME. Personal belief
exemptions were transferable in the past from school to school. Personal belief
exemptions are still accepted which were signed before January 1, 2016. There is no

Reviewing schools with low vaccination rates: I do not know when this begins,
though it is to be done annually. There is an appeal process for revoked MEs. This is a
deterrent to the existence of private schools. Please invite your beloved private /
charter school teachers to join you in a homeschooling e ort.
SUBMISSION OF MEs There is no method to submit MEs to the Department of Public
Health until the new database is created,which must be done by January, 2021.
CAIR California Immunization Registry is the registry which every vaccinated child is
entered into today when he/she receives vaccines at a hospital or large group
practice. There is an opt-out form which is new and may be signed to remove or
prevent your child's data from being in CAIR. The CAIR database may not apply to
private schools, because they are not o cially in a school district.
When a child hits the gradespan, K or 7th, and does not have a medical exemption,
the child must receive all vaccines in order to attend school (see below). For a
kindergardener, this is approximately 15 shots. For a 7th grader this is approximately 13
shots. The law allows the Department of Public Health to add to this list any additional
vaccines deemed appropriate by ACIP and AAP.

school with only four shots, but the remainder must be completed fairly soon.
Please consider starting vaccines in advance of the gradespan so they can be SPREAD
OUT. Please use the Vaccine Prep information (info@raphaelmedicine.com). Please
request a vaccine consult with one of our doctors, to assess the particular level of risk
for injury the individual child has, and what is the most likely to be safe schedule, or if
you really need to homeschool / move. We will soon share info on which vaccines are
cleanest, although none are truly clean. The WORST are the combination vaccines
which sometimes include four or ve diseases, a big chunk of aluminum, and fetal
cells. If there is a reaction, be sure to get it documented on the medical record, and
report serious reactions to VAERS.,
Students with an IEP (Individualized Educational Program) do not need to be
vaccinated for the portion of school that is governed by the IEP. Sometimes that is
only 45 minutes four times per week, for example. So in order for the child to remain
less-than-fully vaccinated, the child would need to be homeschooled for that portion
of the school day that is NOT covered by an IEP. If the child's schooling is 100%
covered by an IEP, then the child can attend school full time with less-than-complete
vaccination and no ME.
However, even though the LAW says children with an IEP do not need ME, schools
have acted di erently. There are some aggressive school personnel who do not
follow the law and insist on refusing MEs that are legal, and tell parents of children
with full-time IEPs that the child needs to be vaccinated.

about 276 / 714. Help them realize the complexity, the uncertainty families face
because of it. Help them realize what the rogue schools are doing. Ask for their help.
Then you can also thank them for voting 'no' or abstaining, or tell them that even
though they voted 'yes' we are still living in the same world, and the vaccine choice
movement WILL be bringing legislation in January which we hope they will support.
The legislation will be like a breath of fresh air to clean up the complexity and
confusion.

These vaccine laws are as clear as mud. No one at my child's school knows what they're
doing. The school is trying to implement laws the Gov. just signed which are not even in
e ect. (copy of our best analysis) I need your help to get this mess sorted out today,

Other states, colleges: Each state has its own law. You can look these up at NVIC.org.
Colleges make their own vaccination requirement rules. Large colleges, like UC
system, tend to be stricter than small colleges.
There are many legal aspects which I do not know, such as conservatorship impact on
schooling. and healthcare decisions.
