is? Great weather, community events, shopping, schools, elder ser-

from the we get stuck in 5 minutes of traffic. For those of us with roots up North, it’s

Whale of a Tale
   By Diane and Catherine Barile,
   South Brevard Historical Society

A black shadow skims the sea surface near the beach. An
explosion of a V-shaped mist rises before the vision
disappears. Sometimes you see the arch of her back
with a miniature offspring at her side.
The North Atlantic Right Whales and their ancestors for
centuries have regularly come to our shore. Although these
behemoths remain unchanged by time the shoreline certainly
has. When seawater was encased in glaciers, the beach was
thirty miles to the east of today’s coast. In later millennia the
melted ice raised the sea level as far west as Orlando.
An ancient indigenous group, and their descendants the
Ais, took whales by canoes, spears and ropes. These people
lived solely on the harvest of the sea, with no agriculture.
Whale bone and baleen were useful for not only daily life but
also trade. Ambergris from sperm whales was also traded by
the Ais.
Right Whales, second only in size to the blue whale,
measures an average of fifty-five feet in length and
weighsapproximately seventy tons. They feed all summer
in New England and Nova Scotia. Mother Whales, like
“snowbirds” head south to Georgia and Florida between
December and March accompanied by a few males and some
juveniles. The females come to the only known calving area
                                 in the world, their instinctual
                                 maternity ward.
                                      In the eighteenth
                                 and nineteenth century
                                 commercial whaling provided
                                 today’s equivalent of
                                 petroleum and plastic. Whales
                                 seemed to be an unlimited
                                 natural resource, suppling a
                                 precious commodity. Right
                                 Whale blubber, forty percent
                                 of its body weight, was
                                 processed into fuel for oil
lamps. Baleen, the flexible strands dangling in the whale’s
mouth, sieved food from sea water. This strong easily bent
material was turned into the plastic of the time. This “whale
bone” was found in the frames of spectacles and hoop skirts,
buggy whips and collar stays and of course those waist
cinching corsets. At times, these fixable sheets were the most
marketable and lucrative of whale products.
With the thriving market and amicable character, these
black whales were the “right” whales; the easiest whales
to hunt and the biggest money maker. They were surface
feeders in coastal waters and seldom sounded or dove after
harpooning. With high fat content, they even floated after

determination of testamentary capacity, they can
be very helpful.
     Separate from general testamentary capacity
is the legal concept of insane delusions. This
occurs when someone believes something that is
not factually true. A person can possess general
testamentary capacity and yet suffer from an
insane delusion. If the insane delusion impacts
only a portion of the estate plan, only that
portion is void.
Even a partial loss of mental capacity can
increase the risk of a challenge to the estate
plan based on “undue influence”. The law
recognizes a person may be persuaded by trusted
individuals to do things that he/she would not
otherwise do. Although lack of capacity and
undue influence are separate issues, the potential
for undue influence increases as capacity
diminishes.
Under Florida law a Will or Trust is null
and void when obtained by “undue influence”.
The law presumes there was undue influence
anytime the person exercising the influence: 1]
substantially gains as a beneficiary 2] occupies
a confidential relationship, (like a child or
caregiver) and 3] was “active in procuring”
the gift, which includes involvement with the
attorney who is preparing the estate plan.

Greetings,
After nearly ten years of existence, I would like to tell you why
we started this organization. After founding the Brevard Alzheimer's
Foundation in 1995, I saw the need for a helpline that would inform,
publicize, and help connect seniors to community resources. Although
we did this for some time at the Foundation, I saw a gradual move
away from this service that could help not just Alzheimer's clients but all seniors in Brevard.
To continue what was started at the Foundation, we founded Helping Seniors, aligned
ourselves with John Frederiksen of Senior Scene Magazine, and began serving seniors
throughout Brevard. Most importantly, once we identified a resource to a caller, we followed up to
make sure they got the help they needed. At the same time, we began a media program that is
continued today, including a monthly newsletter in Senior Scene Magazine, weekly radio show,
articles in local publications, and television shows broadcast daily on SCGTV and social media.
We are a small organization yet advocate for many. Our staff includes Education Specialist
Kim Bernard, who can be contacted at 321-473-7770; Media Director Kerry Fink; Business
Manager Marti Upton; and our new Executive Director, Rick Broderick, a retired financial person,
active Deacon in the Catholic Church, and a person completely adamant about serving seniors.
Until recently we were located in the Senior Resource Center at Zon Assisted Living, but
with Zon’s decision to close the Center we are again "homeless" and seeking space in central
Brevard. A good way to welcome our new Director might be with reliable leads on office space.
Finally, I want to thank Curt Smith and his fellow Brevard Commissioners for awarding us a
CARES grant that will keep our doors open and serving seniors in need. To all who financially
helped us in 2020, the Board of Directors of Helping Seniors extends a grateful THANK YOU.
