Illegal gambling occurs when an unlicensed operator offers gambling products to the
public who in turn participate in unlicensed gambling. Illegal gambling usually takes
place in shebeens, taverns, restaurants and shops often disguised as something else.
People who are found offering or participating in illegal gambling shall be arrested and
prosecuted.
Any member of the public who becomes aware of the existence of illegal operators must
report it to the Gauteng Gambling Board or the SAPS at any police station.
Forms of illegal gambling
The following are perceived as forms of illegal gaming:
Ø Fafhee (mochina)
Ø Card games for money (e.g. five cards, poker, blackjack) outside of
casino premises
Ø Dice or Pop-dice
Ø Slot machines (gambling machines) outside of licensed premises
Ø Internet or online gambling
Risk associated with illegal gambling
Ø Games offered to punters have not been inspected and approved by
the Board to show compliance with the technical standards aimed at
ensuring, amongst others, that the games offered are fair.
Ø Illegal operators do not pay tax and as a result they do not contribute to
the economic development of the Province.
Ø Illegal operators do not contribute towards industry initiatives, such
as the National Responsible Gambling Programme, which is aimed at
minimising the risks and dangers of gambling.
Ø Disputes arising from punters cannot be resolved due to the fact that they
do not know where to report and at times their lives may be threatened
by illegal operators.
Ø Gambling debts arising out of these activities cannot be enforced in a
competent courtTYPES OF LICENCES:
Applications for Casinos, Bingo, Bookmakers and Route Operators are closed and only
the Board can issue an invite for further applications/licences. Only Section 38 applications
pertaining to a transfer of license/consent for procurement of interest in licensee maybe applied
for on existing licenses.

Process for a Section 38 application
The application must be submitted as follows:
• 1 original application
• 2 copies of the original application (bound)
• 2 public copies of the application marked as such ( with a letter reflecting the
excluded confidential information in terms of the act)
• The application must be advertised accordingly in the provincial gazette and as
well as a newspaper circulating in the district in which the premises to which the
application relates, is situated.
The application must be submitted in the following format and sequence:
• The application may be submitted in your own reproduction provided that the content
is exactly the same as contained herein. Any reproduction and all accompaniments
must be on standard A4 size paper.
The application must be filed in the following sequence:
1. Section 38 consent application
2. Copies of advertisements required by Section 20 of the Act (in the format as
attached hereto as Annexure A)
3. Copy of legal instruments giving effect to the accusation of interest
4. Relevant declaration and release authorization by the applicant and if a company
the required personal declarations, and personal release authorizations relevant
to the applicant company only
5. Company declarations and release authorizations for companies together with
the required personal declarations and release authorizations in respect thereofThe following should accompany this application:

6. Copies of Tax Returns (excluding supporting schedules) and the assessments
of the individual for the most recent three years
7. Copies of the VAT Returns and assessments if applicable of the individual
8. Two recent passport- sized photographs signed and dated at the back by the
individual
9. Application fee - R 2 780 (KEY EMPLOYEE) and R690 (OTHER)
