The latest annual report, adopted by the Council in June 2020, highlights the EU's leading role in promoting human rights and democracy in 2019, against the backdrop of negative trends globally. The report of Parliament's Committee on Foreign Affairs takes into account more recent developments, such as the impact of coronavirus. It points out that the response to the pandemic has caused a decline in the respect of democratic and human rights standards in some countries. Based on this report, Parliament is expected to formulate recommendations for future EU action in favour of human rights and democracy. Unavoidably the focus will be on the current crisis, more specifically on protecting lives and livelihoods and restoring growth. Given the crucial role it played in tackling the 2008-2009 financial crisis, hopes are high regarding the G20's potential role in proposing a financial and economic solution to deal with the ongoing downturn. Several major G20 members have invested massive amounts of money to keep their economies afloat, in line with the decision of the extraordinary G20 summit held in the spring, but the depth of the current crisis requires additional action. Some critics have argued that the G20 is not up to its perceived role. The lack of US leadership in particular has been seen as an obstacle preventing the group from living up to its full potential. One of the crucial measures adopted by the G20 has been to freeze the official debt payments of developing countries, with the measure recently being extended. Many voices consider that this will not be enough to avoid state defaults however. Saudi Arabia, the first Arab country to hold the presidency, has been eager to use the opportunity provided by its G20 presidency to showcase its ambitious internal reform programme and its economic potential. The Saudis' leadership of the G20 in these times of turmoil has not escaped criticism, first of all because of the perceived inconsistency between stated objectives at G20 level and internal reality in the country, but also because of the role the country played in the oil price crash of 2020. Given the dire human rights situation in Saudi Arabia and in its fighting in Yemen, calls for a boycott of the summit have been multiplying. The European Parliament has suggested that the EU should downgrade its presence at the summit. Mehrere EU-Mitgliedstaaten haben Gesetze erlassen, die den für die Vereinigungsfreiheit auf internationaler, regionaler und EU-Ebene geltenden Standards nicht entsprechen. Einige Regierungen haben die COVID-19- Pandemie dazu genutzt, den zivilgesellschaftlichen Raum weiter einzuschränken. In der Studie wird untersucht, wie die EU die Zivilgesellschaft vor unrechtmäßigen staatlichen Eingriffen schützen könnte, indem sie die Vereinigungs-, Versammlungs- und Meinungsfreiheit sowie das Recht auf Verteidigung der Menschenrechte stärkt. In der Studie werden vier politische Optionen behandelt: Einführung eines europäischen Vereinsstatuts, Festlegung interner Leitlinien für die Achtung vor und den Schutz von Menschenrechtsverteidigern, Entwicklung eines Indizes für die Stabilität der Zivilgesellschaft und Schaffung eines Netzes von zentralen Anlaufstellen für die Zivilgesellschaft in den EU-Institutionen. In der Studie wird empfohlen, die Unabhängigkeit von kritisch eingestellten Akteuren der Zivilgesellschaft zu stärken und die Finanzierung von Tätigkeiten, beispielsweise von strategischen Rechtsstreitigkeiten, aufzustocken, um die Rechtsvorschriften und Werte der EU aufrechtzuerhalten. The report takes stock of all EU action in 2019 in support of democracy and human rights in the world. Parliament will subsequently respond with its own report issuing recommendations for the future. It finds that the Amazonian countries pursue development policies in the region based on the exploitation on an industrial scale of natural and non-renewable resources that have caused and continue to cause deforestation, loss of biodiversity and engender human rights violations in particular affecting indigenous peoples. The analysis acknowledges the measures taken by the Amazonian countries to establish protected areas and support indigenous territories and their rights but concludes that the laws need strengthening and effective enforcement. The analysis argues that the protection of the Amazon biome is an essential part of the global efforts to reduce greenhouse gases and concurs with the view of some scientists that there is an urgency to stop forest loss. The analysis further notes that the most effective guardians of the Amazonian forest and its biodiversity are its indigenous peoples. The analysis concludes by arguing that the European Union has an interest in contributing to the protection of the Amazon and its indigenous peoples. It recommends, among other things, that the EU strengthen its direct support to Amazonian indigenous peoples and environmental defenders and develop effective measures which target EU-based companies whose activities cause deforestation. Defending human rights in countries where they are most under pressure does however come with significant risks for defenders, who are often harassed, persecuted, and deprived of personal freedom. Since its beginning, the Prize has been awarded to human rights defenders, some of whom were behind bars, serving long prison sentences because of their fight, such as Nelson Mandela. This has not changed much today. Several Sakharov laureates of recent years were in jail when they were awarded the Prize and are still not free today. Others suffered new or additional prison terms because of their activity. The Sakharov Prize brings the cause and the fight of its laureates to world attention. On the occasion of awarding the Prize, Parliament, through the voice of its President, usually calls for jailed laureates to be released from prison. Parliament also uses all the means in its parliamentary diplomacy toolbox to protect from state repression those that it honours through the Prize. The steady follow-up by Parliament of the situation of Sakharov laureates and the urgency resolutions which mention those in difficulty regularly help to keep their struggle in the spotlight. EU diplomacy complements Parliament's efforts through statements, dialogues, and démarches, in line with the general EU policy on protecting human rights defenders. While such actions add to international pressure to secure the release of human rights defenders, they do not always succeed in moving repressive regimes. 2019 saw the liberation of Oleg Sentsov, the Ukrainian film-maker who received the Prize in 2018, from a Russian jail, but other countries such as China, Iran, Saudi Arabia, Cuba, and Venezuela have been relentless in their repression of Sakharov laureates, not giving in to EU calls for their liberation. The ongoing coronavirus pandemic puts jailed laureates at particular risk, but none of those in prison has benefited from the conditional release awarded on a large scale to common criminals, for example in Iran. However, his unequivocally proclaimed ethical principles soon put him at odds with the communist regime, resulting in several prison sentences. Havel nevertheless held fast to his belief that moral integrity was a question of necessity, not choice, and attempted to live up to this ideal. The 1989 collapse of the regime made Havel a hero and, shortly after, an unlikely President. During his years in office, he managed to drive his country through the challenges of moving to a free market democracy, while maintaining his personal moral convictions and tirelessly advocating for larger issues of human rights, peace and democracy, underpinned by an active civil society. While Havel and his collaborators recast the foundations of today's Czech and Slovak democracies, his achievements in foreign policy have perhaps been even more important. Reminding Western countries of the dangers of a Europe that continued to be divided even after the removal of the Iron Curtain, Havel was instrumental in anchoring the new Czech Republic in western Europe, through its membership of the North Atlantic Treaty Organization (NATO) and the European Union (EU). He both recognised and emphasised the importance of closer European cooperation based on shared values, which for Havel constituted the core of relations among European countries. A firm advocate of the Euro-Atlantic alliance, he supported the United States of America, even on occasions when some other western European countries were reluctant to do so. With his political writings reaching far beyond the circumstances in which they were written, Havel is considered one of the most important intellectuals of the 20th century. He has received numerous honours and awards. One of the European Parliament's buildings in Strasbourg has borne Václav Havel's name since 2017. Der Sacharow-Preis für geistige Freiheit ist daher wichtiger denn je: Er ermöglicht es dem Europäischen Parlament, gemäß Artikel 21 des Vertrags über die Europäische Union auf die Notlage derjenigen aufmerksam zu machen, die sich gegen die Unterdrückung der Menschenrechte und Grundfreiheiten einsetzen, auf die sich die EU gründet und die sie in ihren Außenbeziehungen fördert. Sacharow- Preisträger 2019 ist der angesehene uigurische Wirtschaftsprofessor Ilham Tohti, ein gemäßigter Verfechter der Rechte der uigurischen Minderheit und des Dialogs mit der Han-Mehrheit in China. Vor dem Hintergrund der sich verschärfenden Politik Chinas gegen religiösen Extremismus, ethnischen Separatismus und Terrorismus – in deren Rahmen man die uigurische Identität inzwischen als schwerwiegende Bedrohung der nationalen Sicherheit verteufelt – wurde er 2014 unter mit Separatismus zusammenhängenden Vorwürfen zu lebenslanger Haft verurteilt. Der Sacharow-Preis ist eine mit 50 000 EUR dotierte Auszeichnung, die auf einer Feier im Europäischen Parlament während der Plenartagung im Dezember in Straßburg in Anwesenheit der weiteren Finalisten vorgestellt wird. Sie gehört damit zu den jenen Förderern des europäischen Gedankens, deren Triebkraft die Erfahrungen des Ersten Weltkriegs waren. Wie viele von ihnen stammte auch Louise Weiss aus dem Grenzgebiet im Osten Frankreichs, das 1871 von Deutschland annektiert worden war. Louise Weiss widmete ihr Leben mehreren Kämpfen, die sich gegenseitig befruchteten, dem Kampf für die Rechte der Frau, dem Kampf für Europa und die Freiheit der Völker Mitteleuropas und dem geistigen Ringen, um die Wurzeln des Krieges zu verstehen und sie auszuradieren. Sie war abwechselnd als Journalistin, Politikerin, engagierte Intellektuelle und Dokumentarfilmerin in vielen Teilen der Welt tätig. Ihr Engagement für Europa stand aber im Mittelpunkt ihres Handelns und 1979 wurde sie bei dem ersten allgemeinen und direkten Urnengang in das Europäische Parlament gewählt. Als Alterspräsidentin hielt sie die Eröffnungsrede und übergab dann den Vorsitz an Simone Veil, eine andere Kämpferin für Europa. Over the course of the eighth legislature, the DEG has aimed to bring strategic focus to its democracy support activities through the introduction of a Comprehensive Democracy Support Approach (CDSA). While the introduction of the CDSA has outlined a vision for more focused and strategic interventions around the electoral cycle, the implementation remains a ‘work in progress’. There have been some innovative and long-term activities that bring coherence with EU policies, notably in Ukraine, but also there continue to be some cases of one-off actions without clear objectives. The comparative advantage of the EP in democracy support is its political perspective and ability to work ‘peer to peer’ with other parliamentarians, which has been demonstrated in its capacity building and mediation and dialogue activities. Overall the EP should continue to strive to be innovative and strategic in its democracy support, working where it has influence and bringing policy coherence with broader EU priorities. Election observation remains relevant, and follow-up to observer recommendations could be enhanced. The Sakharov Prize and the activities around it, which are also coordinated by the DEG, are consistent with EU values, including through support for human rights defenders and civil society. Available case studies, written reports and interviews with organisations working in the field confirm the reported abuses. Recent Interpol reforms have made significant impact on safeguarding individuals both substantially and procedurally. Nevertheless, and especially considering the significant increase in the number of Notices and Diffusions in the Interpol system, reforms remain to be fully implemented and transparency and enforcement mechanisms continue to leave room for improvement. Taking as a point of departure the responses from the EU institutions and bodies, and EU Member States, the study recommends taking further steps for Interpol to ensure full implementation of recent reforms, a fully transparent system and consistent legal and procedural safeguards for individuals in the Interpol Notice System.. Support for human rights defenders is a long established component of the EU's external human rights policy and one of its major priorities. The EU guidelines on HRDs adopted in 2004 outline concrete measures for protecting HRDs at risk, including the provision of emergency aid, and encourage EU diplomats to take a more proactive approach towards HRDs. The European Commission manages a financial instrument in support of HRDs working in the world's most dangerous situations. The European Parliament is a long-standing advocate of a comprehensive EU policy on HRDs and has actively contributed to its shaping. Its urgency resolutions on human rights breaches around the world, some of which have focused on individual HRDs and the particular threats they face, have drawn attention to the difficulties facing HRDs in many countries. Parliament has also organised hearings with HRDs, issued statements about cases of HRDs at risk, and highlighted the plight of HRDs during visits by its delegations to the countries concerned. The Parliament's Sakharov Prize is the EU's most visible action in favour of HRDs. It has a significant impact on laureates, providing them with recognition and, in many cases, indirect protection. Following a military coup in May 2014, the junta clamped down on political dissent. In 2017 a new constitution restored some of the rights taken away in 2014, but the timing of elections remains uncertain and the military is likely to maintain political influence even after handing over power to a civilian government. Other long-standing concerns include abuses of migrant workers' labour rights and restrictions on freedom of expression. This analysis presents the main human rights trends in Belarus, examining legislation, policy commitments and violations of human rights. While the Belarusian government has made nominal concessions towards the EU, no systemic progress in terms of human rights has been made in the post-2016 period. The study also describes and assesses the EU’s human rights promotion activities in bilateral EU-Belarus relations, within the context of the Eastern Partnership multilateral dimension and in regard to financial assistance. Although the EU has expanded the range of its political dialogue with Belarus since 2016, it has had very little influence over the human rights situation in the country. The EU’s impact has been limited not just because of the very nature of the Belarusian regime. EU institutions and member states have increasingly prioritised geopolitical interests as well as the stability and resilience of Belarus over human rights concerns. The EU should increase efforts to mainstream human rights in all aspects of its relations with Belarus and find a better balance between ‘normalisation’ and ‘conditionality’ based policy approaches vis-à-vis the country. With renewed efforts to counter people smuggling in the context of an unprecedented influx of migrants and refugees into the EU, it assesses existing EU legislation in the area – the 2002 Facilitators’ Package – and how it deals with those providing humanitarian assistance to irregular migrants. The study maps EU legislation against the international legal framework and explores the effects – both direct and indirect – of the law and policy practice in selected Member States. It finds significant inconsistencies, divergences and grey areas, such that humanitarian actors are often deterred from providing assistance. The study calls for a review of the legislative framework, greater legal certainty and improved data collection on the effects of the legislation. Standing up for human rights defenders around the world: What is the EU doing? With the adoption in 2004 of EU Guidelines on HRDs, the EU has established a set of concrete measures for protecting HRDs at risk, including the provision of emergency aid. The Guidelines encourage EU diplomats to take a more proactive approach, by establishing contact with HRDs and intervening on their behalf when they are at risk. The European Commission manages a financial instrument to support HRDs working in the world's most dangerous situations. A Human Rights Mechanism managed by NGOs with EU financial support has also been launched in order to enhance the effectiveness of EU action on behalf of HRDs. All this makes the EU a major supporter of HRDs in the world. The European Parliament has been a long-time advocate of a comprehensive EU policy on HRDs, actively contributing to its shaping. It has drawn attention to the difficult situation of HRDs in many countries through its urgency resolutions on human rights breaches in the world, some of which have specifically dealt with individual HRDs facing particular threats. It can also organise hearings with HRDs, issue statements about cases of HRDs at risk, or raise the plight of HRDs during visits by its delegations to the countries concerned. The EP’s Sakharov Prize is the EU's most visible action in favour of HRDs. Its impact is significant on laureates, providing them with recognition and, in many cases, indirect protection. In June 2012 the EU launched its Strategic Framework and Action Plan on Human Rights and Democracy including some benchmarked actions to take on behalf of HRDs and calling on EU Delegations and EU Member States missions to prepare human rights country strategies (HRCS) and to update the strategies annually. The 2008 revised European Union Guidelines on Human Rights Defenders (the Guidelines) provide a number of important recommendations for the EU and its Member State missions which have resulted in many good practice actions toward support and protection of HRDs. This study investigates the effective implementation of the Guidelines in Kyrgyzstan, Thailand and Tunisia, primarily from the viewpoints of diplomats and HRDs, with focus on the latter. Findings of this study suggest effective implementation of the Guidelines is uneven across European missions and there needs to be a joining up of the Guidelines’ recommendations with the new HRCS process. Recommendations to the EU and the European Parliament include mainstreaming knowledge of the Guidelines throughout EU sections and missions, taking a more considered approach to engagement with HRDs to create enabling human rights environments and ensuring attention to the most vulnerable HRDs. Since the calls on Belarus so far have failed to result in the establishment of such an institution in this country, the study focuses only on Armenia, Azerbaijan, Georgia, Moldova and Ukraine. While noting the strengthening of the standing and a considerable progress in work of the analyzed institutions, the study refers to the assessments presented by them, as well as to external opinions that emphasize the need to continue programmes of support offered to these institutions. This has had profound implications for human rights on a number of levels. Firstly, communication technologies are presenting new ways to more fully realise our human rights. This is particularly true of the right to freedom of expression. Secondly, ICTs have provided human rights activists with new tools for defending human rights. Internet access via mobile phones gives citizens the power to communicate rights violations in real time to global audiences; social networking tools connect human rights defenders across the world to enhance collaboration and information sharing; censorship circumvention technologies allow people to bypass attempts to monitor and control information and communication flows. However, as well as unleashing tremendous new opportunities for protecting and advancing human rights, digital communications also present a series of serious challenges. These include direct threats to human rights, such as the development of increasingly sophisticated censorship and surveillance mechanisms. They also include deeper, structural problems such as the persistence of digital divides in access to communications infrastructure and capacities along geographical, gender and social lines. It tracks the evolution of the concept of human rights mainstreaming taking into account similarities and differences between the UN and the EU, and reviews the relevant policy commitments and potential tools for human rights mainstreaming that have been put in place by the EU since 2001. The current status and impact of human rights mainstreaming is then examined with reference to three specific external relations policy areas, i.e. the CFSP/ESDP, development cooperation and trade, and migration and asylum policy. Two cases – one thematic related to human rights defenders and one regional concerning human rights policy vis-à-vis the Western Balkans – are focused upon in order to analyse the intersection of different sectors and policy areas. The study argues in favour of a stronger centralised structure to ensure effective human rights mainstreaming; including the possibility of establishing the position of an EU Human Rights Commissioner. The authors also urge the European Union to re-design the European Instrument for Democracy and Human Rights for a better mainstreaming effect and to promote human rights based approaches to programming in the other financial instruments (most importantly regarding neighbourhood and development instruments). It can serve as an alternative to violent struggle for people facing oppression, undercut the power of extremist and militant armed groups, and contribute to regional security and stability. This study argues that international support for nonviolent movements can be vital, but needs to be based on an understanding of the movement itself, its strategy, circumstances and needs. It must be an extension of, not a replacement for, local strategically-planned nonviolent resistance, and should be informed by close consultation with grass-roots nonviolent movements about what is welcome and appropriate. The authors propose that more should be done to make EU programmes less state-centred and to encourage ‘democratisation-from-below’, by supporting the independent organisational capacity of civil society.
