The Mayor declared the Council Meeting open at 6:30pm and advised that the meeting is being
recorded and streamed live on the internet.

Cr Martin read the prayer at the commencement of the meeting.

2.     Acknowledgement of Original Inhabitants
The Mayor invited Cr El Mouallem to read the acknowledgement of the original inhabitants of
this land.

          We acknowledge that the original inhabitants of this land that we call Bayside
           were the Boon Wurrung people of the Kulin nation.

          They loved this land, they cared for it and considered themselves to be part of it.

          We acknowledge that we have a responsibility to nurture the land, and sustain it
           for future generations.

3.     Apologies
It is recorded that Cr Samuel-King indicated at a previous meeting that she would be taking
leave of absence and would not be attending the meeting. It is recorded that Cr Samuel-King
did not take a leave of absence from the 16 February 2021 Council Meeting and was in
attendance.

4.     Disclosure of any Conflict of Interest of any Councillor
There were no conflicts of interest submitted to the meeting.

That Council:
1.    considers the meeting to be adjourned for 10 minutes from the commencement of any
      technical problem which prevents Council from livestreaming the meeting
2.    adjourns the meeting to be reconvened on Wednesday 17 February 2021 at 5:30pm
      via livestreaming on Council’s website, in the event livestreaming cannot be resumed
      within 30 minutes from the commencement of the technical problem which prevents
      livestreaming on Council’s website.

5.     Adoption and Confirmation of the minutes of previous meeting
5.1    Confirmation of the Minutes of the Ordinary meeting of Bayside City Council held on
       22 December 2020.

       February 2021.

6.     Public Question Time
In accordance with Chapter 2, Section 57 of Council’s Governance Rules, 162 public
questions were submitted to the Meeting. In accordance with the resolution at the March
2020 Ordinary Meeting of Council, temporary meeting procedures with regard to public
question time are in place:
•     All questions received and responses are read out at the meeting within the allotted 15
      minute timeframe for public question time.
•     All questions and responses read out will be recorded in the minutes.
•     A written response will be provided to all questions received.

1.    Ms Sue Langley
Ms Sue Langley submitted a question regarding the Bayside Netball Centre – Holloway Road
proposal, and Ms Langley asked:
Why did the Council think it had the right, at the Council Meeting 15/09/2020, to sign a
proposal to enter in to a CJUA with Sandringham College and pay $750,000 to the VSBA
when Community Consultation hadn’t yet closed?
Response from the CEO
Through standard Council governance and other processes a report was submitted to the 15
September 2020 Council meeting at which time Council resolved to sign a Development
Agreement (not a Community Joint Use Agreement) providing a preliminary agreement to the
project with the Victorian School Building Authority. Extensive community consultation has
since been undertaken on the proposal.

2.    Ms Sue Langley
Ms Sue Langley submitted a second question regarding Council’s Netball Centre proposal,
and Ms Langley asked:
If Councillor Martin was ignorant of the facts in the Traffic Report, relating to the proposed
netball centre (email details can be provided if required), why was he been allowed to vote
on the issue?
Response from the CEO
Councillor Martin has been provided with all of the information relating to the traffic report to
enable him and all Councillors to be informed of the issues at the site.

3.   Dr Amy Touzell
Dr Amy Touzell submitted a question regarding Council’s Netball Centre proposal, and Dr
Touzell asked:
Why does the traffic report only assess vehicle movements from 8am - 4pm on a Saturday,
when council has clearly proposed the hours of use of the facility to be from 8am - 10.30pm?
Response from the CEO
The traffic report presented to the 16 February 2021 Council Meeting has been reviewed and
updated. This updated report includes modified operating hours that have been reduced in
line with community feedback.

4.   Mr Renato Fonti
Mr Renato Fonti submitted more than 2 questions. Council’s Governance Rules direct that a
maximum of 2 questions per individual will be responded to. Therefore a response will be
provided to the first 2 questions.
Mr Fonti’s first question is regarding Council’s Netball Centre proposal, and Mr Fonti asked:
How will you address the noise impact on residents, in particular, the elderly & people living
close by with sleep disorders, depression, anxiety, mental health issues?
Response from the CEO
The proposed design of the netball centre includes a range of mitigations to minimise noise
including a landscape buffer between the courts and adjoining properties that has been
increased to 15 metres and the use of bollard speakers to mitigate any impact of the PA
system. The proposed hours of use also reduce the amount of time noise may emanate from
the facility.

5.   Mr Renato Fonti
Mr Fonti’s second question is also regarding Council’s Netball Centre proposal, and Mr Fonti
asked:
Urban green spaces such as Holloway Road Green Belt, Parks & Sports fields give people
the space for physical activity, relaxation, peace, and an escape from heat. .Multiple studies
have shown that these spaces reduce stress and boost mental and physical health – how will
Bayside City Council address this important issue with the loss of this critical space?
Response from the CEO
The Sandringham College site is not public open space, it is land owned by the Department
of Education. As part of this proposal it is recommended that Council undertakes a master
planning exercise to open up approximately six hectares of open space at the Wangara
Road reserve.

6.    Miss Stephanie Batten
Miss Stehanie Batten submitted a question regarding Council’s Netball Centre proposal, and
Miss Batten asked:
How will you address the mental health issues that will impact residents directly adjacent to
the project?
Response from the CEO
Council recognises the impacts such a development may have on local residents and has
completed substantial work to try and mitigate these impacts as far as possible.

7.    Mr Steve Beauchier
Mr Steve Beauchier submitted a question regarding Council’s Netball Centre proposal, and
Mr Beauchier asked:
Have Bayside Council re engaged and updated the traffic assessment for Holloway,
Wangara and George street based upon school drop off and pick up but also Saturday
morning activities in these streets so report assesses the real baseline of traffic and parking
impacts in the area vs proposed increases due to the netball centre?
Response from the CEO
The original and revised traffic management plan recognises all activity that currently exists
in the precinct and models that all individuals enter and exit by vehicle via Holloway Road.
School drop off and pick up times will infrequently cross with community sport, however this
occurrence has been captured within the plan.

8.    Mr Alexander Fonti
Mr Alexander Fonti submitted a question regarding Council’s Netball Centre proposal, and
Mr Fonti asked:
I walk my dogs every day at Holloway Road reserve, I have seen an enormous increase in
activity on these reserves in the last 5 years - how will you cater for extra people/pets using "
open spaces " when the council is proposing this massive reduction in green space?
Response from the CEO

9.    Mrs Karin Milenkovic
Mrs Karin Milenkovic submitted a question regarding Council’s Netball Centre proposal, and
Mrs Milenkovic asked:
a)    As Bayside Councillors, is it your role to protect the amenity of residents and ensure
      that all decisions you make on issues within your control do not negatively impact the
      amenity and lifestyle of established residents?
b)    If so, why are you proposing to build a large, inappropriate Regional Sporting facility
      within a quiet, densely populated, no through road?
Response from the CEO
a)    Council has a role to balance the needs of residents and their amenity with the needs
      of residents wanting to undertake a range of structured and unstructured recreation
      activities.
b)    A detailed traffic and parking management plan can be effectively implemented to
      minimise traffic impact in the local area.

10.   Mr Paul Richards
Mr Paul Richards submitted a question regarding Council’s Netball Centre proposal, and Mr
Richards asked:
Why has Bayside City Council failed to consult with local residents prior to passing a decision
at their Council meeting 15/9/2020 to proceed with the development.
Response from the CEO
The timing of including the proposed netball centre with the Victorian School Building
Authority school project meant that Council was required to respond quickly and formalise a
Development Agreement within a timeframe that did not allow for community consultation.
The Development Agreement only provided preliminary agreement for the project and
Council has since undertaken community consultation. As a State Government site there is
no Town Planning Permit process associated with the proposed development at the
Holloway Road site.

11.   Mrs Tracey Walsh
Mrs Tracey Walsh submitted a question regarding Council’s Netball Centre proposal, and
Mrs Walsh asked:
Will residents who are affect by the new proposed netball courts be financially compensated
for the devaluation of their biggest asset, their homes.
Response from the CEO
The provision of community sporting facilities at the Holloway Road site is unlikely to
negatively impact housing prices in the area.

12.   Ms Kellie Tighe
Ms Kellie Tighe submitted a question regarding Council’s Netball Centre proposal, and Ms
Tighe asked:
I would still like some clarity on parking restrictions in the streets surrounding the new
proposed Netball site. Netball doesn’t run 365 days a year and nor should the parking
restrictions. Will the suggested parking restrictions be for game days only?
Response from the CEO
There are a number of traffic restrictions in place with some restrictions proposed to be
signed as Game Day restrictions only.

13.   Ms Kellie Tighe
Ms Tighe submitted a second question regarding Council’s Netball Centre proposal, and Ms
Tighe asked:
Have the council looked at improving the lighting lux at Thomas Street to accommodate night
matches? This would be substantially cheaper than the $17m rate payer funds proposed to
develop Holloway Road and starting from scratch.
Response from the CEO
Regardless of any night match lighting, the current number of non-compliant courts at
Thomas Street will not meet the needs of the 3,000 local members of the Sandringham
District Netball Association.

14.   Ms Anita Reynolds
Ms Anita Reynolds submitted a question regarding Council’s Netball Centre proposal, and
Ms Reynolds asked:
Why doesn't Council borrow the money to fix up Wangara Rd site for the Netball centre
instead of reducing the number of courts to fit into SSC oval and not providing SDNA with the
facilities that they have requested? Rates still rise even when there are no loans
outstanding!!
Response from the CEO
The proposed netball development at the Holloway Road site can be completed for $9.85 to
$8.85 million less than for similar facilities being built 200 metres away in Wangara Road.
There will not be a rate rise as a result of the proposed netball centre development.

15.   Mr Brett Dyer
Mr Brett Dyer submitted a question regarding Council’s Netball Centre proposal, and Mr Dyer
asked:
Why is the council not considering the current lighting at Thomas street netball courts to
increase the lux to enable games to be played at night at Thomas street? Under 17 girls do
not want to be playing netball on a Saturday night. Upgrading the lighting will enable games
to be played weeknights.
Response from the CEO
Regardless of any night match lighting, the current number of non-compliant courts at
Thomas Street will not meet the needs of the 3,000 local members of the Sandringham
District Netball Association.

16.   Mrs Prue Graham
Mrs Prue Graham submitted a question regarding Council’s Netball Centre proposal, and
Mrs Graham asked:
I would like Council to outline their plans for handling the extreme traffic that is going to occur
with the proposed netball project on Holloway Road.
Response from the CEO
Council has engaged a traffic consultant to prepare a detailed traffic and parking
management plan that when implemented will minimise the impact of traffic and parking in
the local area.

17.   Ms Kylie Charlton
Ms Kylie Charlton submitted a question regarding Council’s Netball Centre proposal, and Ms
Charlton asked:
The traffic report conducted for this new project was conducted during peak COVID
lockdown. How can Council intend to rely on this information gathered at a most
“unprecedented” time, would it not be completely irrelevant to normal traffic movements?
Response from the CEO
The Traffic Management Plan used data from pre-Covid, 2017 and 2018, to inform the
report. It is also recommended that the traffic management plan is reviewed six months after
initial implementation.

Ms Steph Fonti submitted a question regarding Council’s Netball Centre proposal, and Ms
Fonti asked:
How will you address the mental health issues that will impact residents directly adjacent to
the project?
Response from the CEO
Council recognises the impacts such a development may have on local residents and has
completed substantial work to mitigate these impacts as far as possible.

 7.1      PETITION REQUESTING COUNCIL TO CONSIDER INSTALLING
          TRAFFIC CALMING DEVICES ALONG BURROWS STREET, BRIGHTON
                        Environment, Recreation and Infrastructure - Sustainability & Transport
                                                File No: PSF/21/23 – Doc No: DOC/21/11734

 A petition has been received from residents requesting Council to consider installing traffic
 calming devices along Burrows Street, Brighton.

 (64 valid signatories – 56 residents of suburbs within or partly within Bayside; and 8 residents
 of suburbs outside of Bayside)

       We the undersigned hereby petition Bayside City Council to consider installing traffic
       calming devices along Burrows Street, Brighton. The reasons are as follows:

       1. Burrows Street is a narrow street with parking on both sides. It has become a ‘rat
          run’ or through road for motorists. It is also used for all day car parking by traders
          and commuters, resulting in traffic congestion and increasing the risks for
          pedestrians, dogs, cyclists etc.

       2. Signs stating ‘local traffic only’, are ignored and never policed.

       3. Due to poor visibility, there have been a number of near misses on the corner of Well
          and Burrows.

       4. Approval of several property developments in the street, will contribute to higher
          density and even more traffic congestion.

       5. Ideally, Burrows Street should be one way, but acknowledging that this is part of a
          bus route, it may be too difficult. Roundabouts and chicanes could be considered.

       We would welcome Council’s advice regarding suitable traffic calming devices that
       exclude speed humps (as they impact on the amenity of the resident), to minimise the
       risk and ensure the safety of everyone.

          LITTLE BRIGHTON RESERVE

 A petition has been received from residents supporting the community garden proposal at
 Little Brighton Reserve.

 (28 valid signatories – 26 residents of suburbs within or partly within Bayside; and 2 residents
 of suburbs outside of Bayside)

       ‘We the undersigned hereby petition Bayside City Council to approve the proposal to
       design and build a community garden’

       (Community Garden proposal at Little Brighton Reserve).

 Petition Requirements
 The submitted online petition containing 28 valid signatories meets the required format of a
 petition in accordance with Chapter 2, Section 58 of Council’s Governance Rules 2020.

       Attachment 2

    2. executes Agreements with Metropolitan Waste and Resource Recovery Group and
       Hanson Landfill Services Limited for Landfill Services on a Non-Guaranteed Basis
       for a four-year term commencing on 1 April 2021 for the specified schedule of rates
       in Confidential Attachment 2

    3. authorises the Chief Executive Officer to sign all necessary documentation related to
       both Agreements.

    Government Act 1989, to enter into a new Lease with Telstra Corporation Limited in
    accordance with the Heads of Agreements provided in Attachment 1, for the occupation
    of one new site at the Brighton Golf Course

 2. directs that under Section 190 and 223 of the Local Government Act 1989, public notice
    of the proposal to lease the new site described in Clause 1 above be given
 3. authorises the Director Corporate Services to undertake the administrative procedures
    necessary to enable Council to carry out its functions under section 223 of the Act in
    relation to the new Lease proposed
 4. establishes a Special Committee of Council and determines the membership of the
    Committee (with a minimum of three {3} councillors) to hear any submitters that wish to
    be heard
 5. in the event that submission/s are received, convenes a Special Committee of Council
    meeting on Wednesday 7 April 2021 at 6:30pm, to be held at the Council Chamber,
    Boxshall Street, Brighton, or held remotely via electronic media, to hear any submitters
    that wish to be heard
 6. receives a further report after the completion of the above statutory processes, in order
    for Council to consider and make a decision about whether to grant the Lease described
    in Clause 1.

       adjoining owner of 2 Allee Street, Brighton for $54,000 plus GST

  2.   gives public notice outlining the proposal in accordance with Section 223 of the Local
       Government Act 1989

  3.   establishes a Special Committee of Council and determines the membership of the
       Committee (with a minimum of three {3} councillors) to hear any submitters that wish
       to be heard

  4.   in the event that submission/s are received, convenes a Section 223 Special
