SECTION A: THE RESIDENCY AGREEMENT
Rule 1. Licence Agreement
Each Occupier must enter into a formal Licence Agreement with the University of
Technology, Sydney. The Licence Agreement sets out the terms and conditions under
which the Occupier is entitled to the use of the Room, the Apartment and the Student
Residence including the common areas of the Student Residence (“Common Areas”).
Rule 2. Property Condition Report
Each Occupier is required to verify and sign a Property Condition Report form upon moving
into the Student Residence. The Occupier must check that the condition of each item listed
in the Property Condition Report is correct as stated. It is the Occupier’s responsibility to
note any missing items or variations to the condition of items on the form, which must be
signed and returned to the UTS: Housing Service within 7 days from the date of issue. If
the Occupier fails to sign this form, the UTS: Housing Service will deem that the Occupier
has agreed with the condition of the property as listed on the Property Condition Report.
Rule 3. Payment of Licence Fees
3.1 The Occupier is required to submit a Residential Fee Payment Option form to the
UTS: Housing Service prior to the Licence Agreement Commencement Date. All
fees must be paid in accordance with the terms set out in the Licence Agreement and
the Residential Fee Payment Option form. Non-payment of the Licence Fee is a
breach of the Licence Agreement.
3.2 Where the Occupier fails to pay their Residential Fees and their account falls in
arrears, UTS Housing Services may impose a sanction or block which will suspend
access to the Occupiers ‘My Student Administration account’ until such time the
outstanding account is paid in full.
Rule 4. Early Termination
If the Occupier wished to break the Licence Agreement before the Expiry Date, the Occupier
must provide in writing giving the reasons why the Occupier wishes to be released from his/
her Licence Agreement. The Occupier must pay a cancellation and administration fee equal
to two weeks rental (regardless of whether a new occupant for the Room is found). If a new
occupier is unable to be found, the Occupier will be liable to pay the weekly rental for the
Room until such time as a new occupier is found or the Licence Agreement expires
(whichever occurs first). These conditions apply regardless of the reasons for termination
(this includes termination initiated by the UTS Housing Service due to a breach of the
Housing Rules.
Rule 5. Removal of belongings at end of the Licence Agreement
5.1 The Occupier’s belongings must be removed from the Student Residence
immediately when Licence Agreement ends. The Occupier is required to vacate by
10am on their Licence Agreement end date.
UTS: Student Residences – Handbook and House Rules – November 2012 35.2 Any goods that the Occupier has not removed from the Student Residence at the end
of the Licence Agreement will become the property of UTS after 7 days from the end
or termination of the Licence Agreement. These goods may then be disposed of by
UTS without any reference to the Occupier. UTS may use the proceeds of sale to
cover the costs of removal and storage and retain any balance. UTS may recover
from the Occupier any shortfall in such costs as a debt due to UTS.
5.3 Where the Occupier reclaims the goods within 10 business days from the end of the
Licence Agreement the Occupier will be required to pay to UTS the costs of removal
and storage of the goods prior to the release of the goods to the Occupier and, if
such payment is not made, UTS may recover such costs from the Occupier as a debt
due to UTS.
5.4 Storage fees of up to $30/day may apply.
SECTION B: GENERAL RULES FOR COMMUNITY LIVING
Rule 6. Access to Rooms and Apartments
6.1 Occupiers must not enter any other Apartment or Room without the permission of the
relevant Occupier(s).
6.2 Entry to an Apartment or Room is restricted to the intended access point i.e door
only. It is prohibited to enter a premise by any other means.
6.3 To ensure the safety of all within the Student Residence, each Occupier is expected
to ensure that no person follows them into the Student Residence without authority to
do so. Occupiers must report any instance of unauthorised access or attempted
access or any suspicious activity to staff of the UTS: Housing Service or UTS
Security Service in a timely way.
Rule 7. Access to Rooms and Apartments by UTS: Housing Service
UTS staff, or any person authorised by UTS, may enter Rooms and Apartments in the
following circumstances:
To carry out a routine, formal inspection of a Room if the Occupier is given at least
4 days’ notice
to carry out a routine formal inspection of an Apartment’s common areas if the
Occupier(s) is given at least 2 days’ notice
To carry out routine or special cleaning of an Apartment, as well as cleaning
inspections for routine and special cleaning (i.e. to enable the UTS staff or the UTS
contractor’s staff to undertake quality control monitoring of the cleaners’ work). No
notice is required
To carry out urgent repairs within a Room or Apartment common area. No notice is
required in these instances
To carry out necessary non-urgent repairs in an Apartment or Room if the
Occupier(s) is given at least 1 days’ notice. (Explanatory note: the submission of a
written maintenance request by an Occupier provides consent for UTS staff to
access the Apartment or Room to inspect or repair the item)
If there is good reason to believe the Room has been abandoned by an Occupier.
No notice is required in these instances
To do a search and or an inspection of a Room or Apartment if the UTS: Housing
Service has reasonable cause to believe that the Occupier(s) has broken one or
UTS: Student Residences – Handbook and House Rules – November 2012 4more Rules relating to the health, safety or good order of the Student Residence (e.g.
tampering with smoke detectors, consumption of illegal substances, illegal guests,
cleanliness etc). No notice is required.
In an emergency situation. No notice is required in these instances
If the Occupier agrees orally or in writing that UTS staff can enter their Room without
the required prior notice period.
To show a vacant Room to a prospective Occupier if the Occupier(s) is given prior
warning via phone or email contact.
Rule 8. Alcohol
8.1 UTS encourages a responsible attitude towards the consumption of alcohol,
therefore it is not acceptable to introduce or possess large quantities of alcohol e.g.
kegs, bins of punch etc.
8.2 Behaviour associated with the misuse of alcohol will be treated as a Serious Offence
and Student Misconduct, Police action and/or formal disciplinary action, depending
on the circumstances
.
8.3 Occupiers must not walk between Apartments with open alcoholic drinks.
8.4 Where Occupiers of an Apartment have by mutual agreement chosen to have an
alcohol-free Apartment, other Occupiers should be sensitive to the cultural, moral,
religious, health or other beliefs/values leading to this decision.
8.5 No alcohol is to be consumed by, or provided to, anyone less than 18 years of age.
8.6 Non-alcoholic drinks must be made available at all gatherings, parties, events and
functions.
8.7 Drinking games and competitions which encourage excessive consumption of
alcohol are prohibited.
8.8 Binge and excessive consumption of alcohol within the Student Residence is
prohibited and will be considered improper and inappropriate conduct under the
Rules and under the UTS Student and Related Rules.
8.9 All common areas within the student residences are to be Alcohol Free from 10pm to
7am, except with written permission.
UTS is responsive to the needs to students with alcohol related problems through
appropriate support and referral mechanisms. Students seeking assistance can contact their
Residential Networker, UTS Housing Service or the Student Services Health Centre
(Building1, level 6).
UTS: Housing Service reserves the right to introduce at its discretion, alcohol free zones on
a temporary or permanent basis.
Rule 9. Animals and pets
Animals and pets of any kinds (including fish, birds and laboratory animals) are prohibited in
all parts of the UTS Student Residences. Trained guide dogs for Occupiers who have a
disability affecting vision are permitted with the prior permission of the UTS: Housing
Service.
UTS: Student Residences – Handbook and House Rules – November 2012 5Rule 10. Bicycles and other similar items Bicycles are welcomed and encouraged to be brought with you to residence. Designated bike spaces are provided at each residence (excluding Blackfriars). You will be required to provide you own lock to secure your bicycle. Under no circumstances may a bicycle be brought into or stored within any Room or Apartment, common area, or fixed to any building fixture / supports etc. Further to this you are not to ride roller skates, skate boards, bicycles or similar items within any area of Housing including your Room or Apartment, common areas, lifts, hallways etc. Rule 11. Dispute resolution All disputes arising between Occupiers and/or between Occupier(s) and UTS Housing Staff must be resolved in accordance with the clause 2.5 of Appendix 1. Rule 12. Goodwill, good manners and respect of others Student Residences are intended to be far more than just a place to live. UTS seeks to promote a residential student environment that builds a community conducive to showing respect for others. Goodwill, good manners, commonsense and a sincere desire to help others to enjoy a happy community life is expected of all Occupiers within Student Residences. The self- discipline of Occupiers will normally be sufficient to maintain the high standard of good order, which is expected of an adult community. It is anticipated that in most instances, the good behaviour of the Occupiers will be the result of a shared desire for harmonious living and good communication between the UTS: Housing Service staff and Occupiers within Student Residences. However, if there is negative behaviour detrimental to good order of the UTS Student Residence, then the use of the UTS Housing Service Disciplinary Procedures will be applied (as set out in Appendix 1). Rule 13. Hanging of laundry Clothes, sheets, towels, rugs, laundry or other items may not be hung on or from balconies or windows. The use of a clothes rack for the purposes of drying your washing on balconies is allowed provided it is not visible from the street. Rule 14. Mail and Parcels UTS Housing Service does not accept any mail or parcels which require a signature or cannot be left in your mailbox. If Occupiers expect such a delivery they either need to be in residence to sign for the delivery themselves or make arrangement for delivery or collection from an Australia Post Office or the courier company. When vacating residence, mailbox locks will need to be removed by residents. Locks will be removed from any locked mailboxes, upon checkout. Rule 15. Illegal activity
Occupiers must not engage in, and are required to ensure that their guests and visitors do
not engage in, any illegal activity, including but not limited to: the use or possession of an
illegal substance; use or possession of drug paraphernalia; cultivation of illegal drugs;
copyright infringement through any means including production of pirate video/ DVD/ or
unauthorised music duplication; solicitation; or participation in illegal gang activities within
the confines of any of the Student Residences. Participating in, or knowingly permitting such
activity in a UTS Student Residence will result in the termination of the Licence Agreement
and appropriate legal action. These matters may also be referred to the Police.
Rule 16. Misconduct
Misconduct that is also defined as a Serious Offence includes but is not limited to:
1. violence towards another Occupier, staff member, visitor or oneself;
2. prejudicing the good order of the UTS Student Residence;
3. intentionally endangering or threatening the life of oneself or any other person
including being found accessing restricted or prohibited areas of the
residences;
4. harassing or engaging in any other form of improper or discriminatory
behavior towards another student, an officer of UTS, a visitor to UTS, or any
other person in the UTS Student Residence and is related to the Occupier
and their occupation of the UTS Student Residence and where such
misconduct may relate, but is not limited, to race, ethnic or national origin,
gender, marital status, sexual preference, disability, age, political conviction
or religious belief;
5. criminal activities impacting on the Student Residence or the Occupier or
other Occupiers or that is likely to prejudice the good name of UTS;
6. behaving disgracefully, improperly, or inappropriately in the UTS Student
Residence;
7. misuse of fire equipment or serious acts of vandalism to UTS property;
8. misusing UTS Student Residence computing or communications equipment
to which the Occupier has access for his or her studies and in a manner
which is illegal or which is detrimental to the rights or property of others;
9. actions that breach the strata by-laws or New South Wales laws or
Commonwealth laws;
10. the issuance of a third written warning; and
11. unreasonably interfering with the freedom of other students to pursue their
studies or participate in the life of the University
Misconduct will be considered a breach of the Licence Agreement. Any Misconduct will be
dealt with in accordance with the UTS: Housing Service Disciplinary Procedures and may
also be referred to the UTS Registrar, to be dealt with under the UTS Student and Related
Rules as Student misconduct (refer to the UTS Calendar or
http://www.gsu.uts.edu.au/rules/student-index.html) or if the Misconduct is an illegal activity it
will be referred for action to the Police. A Serious Offence may result in the termination of
the Licence Agreement, in addition to any other action that might be taken by UTS.
Rule 17. Noise, disturbance and annoyance
UTS: Student Residences – Handbook and House Rules – November 2012 7Occupiers are expected to keep Student Residence facilities reasonably quiet, and to observe specific quiet hours as established by the UTS: Housing Service. Occupiers must not make, or permit their guests or visitors to make, any disturbing noise or other nuisance in or about the interior or exterior of the Student Residence that will interfere with the rights or wellbeing of others. Examples of such spaces include the entry/ exit point of Gumal and Yura Mudang, the Quadrant and water feature in the courtyard of Gumal, study labs and study rooms, Level 4 DAB Cafe or the Bridge on UPN and Harris Street, rear lane access at Geegal and Bulga, outdoor courtyards/ rooftop areas etc. Guests must vacate by 1.00 am. A ‘quiet time’ when excessive noise is not permitted, applies every night from 10.00 pm to 7.00 am, except on Friday and Saturday nights when it will be between 11.00pm and 8.00am or as otherwise negotiated between Occupiers, while still remaining within acceptable community noise standards. Strata by-laws and state and local government by-laws, regulations and fines apply in regard to unacceptable noise levels. Occupiers using a sound system within the Residence must be mindful of neighbours, and relevant laws and noise standards. All UTS Student Residences are in residential areas. UTS Housing Service will take action on any complaints received via our neighbours. Occupiers who breach this rule risk termination of their Licence Agreement, as well as other UTS Housing Service Disciplinary Proceedures being applied and may result in financial penalty associated with any damage caused. UTS: Housing Service reserves the right to introduce at its discretion, restricted access or closure of part or all of common area spaces and facilities within the residences on a temporary or permanent basis. Rule 18. Notification of absence If an Occupier will be absent for any reason for more than 48 hours, the Occupier must notify and leave an emergency contact number with other Occupiers in their Apartment, the Residential Networker or the UTS: Housing Service so that we can advise family who may need to contact you urgently during that time. UTS: Housing Service staff may enter an Occupier's Room to check on their wellbeing if they have not advised of an absence and have not been seen for 2 days (or lesser time where UTS deems it appropriate). The University may report any Occupiers that have been missing for more than 3 days (or lesser time where UTS deems it appropriate) and for whom they have no record of whereabouts, to the Police as a missing person and provide the Police with all relevant personal information required. Rule 19. Observation of Rules and other directives Occupiers must abide by all the directives, rules, and regulations, which may be established and promulgated by UTS in the interests of health, safety, the proper conduct of Student Residences, and the orderly and efficient operation and administration of the UTS Housing Service residential system. Occupiers are expected to attend all Student Residence floor and individual meetings as they are convened by the UTS: Housing Service throughout the year, unless there are reasonable reasons for not doing so such as classes or personal emergencies. The Occupier is responsible for being aware of any materials and information discussed and/or UTS: Student Residences – Handbook and House Rules – November 2012 8
distributed at any such meetings, and for abiding by any decisions or directives resulting from any such meeting. At all times, while on UTS Housing premises, residents and their guests must carry their UTS student ID, (for non UTS students, valid ID). Upon request by UTS Security guard, Residential Networkers or other UTS staff, such ID will need to be produced. Failure to do so may result in removal from UTS Housing premises and further disciplinary action. Rule 20. Photographing, videotaping and use of other recording devices Audio and/or visual recording (e.g. videoing, photographing) of other Occupiers without their specific permission is prohibited. Unauthorised or inappropriate use of photographs or video or audio recordings of other Occupiers is also prohibited and potentially contravenes NSW and / or Commonwealth privacy and other laws. UTS: Housing Service may, from time to time, take photographs / videos of events and activities in which residents of UTS Student Residences may participate. These images may be used by UTS for promotional purposes e.g. marketing, publicity, website, social media etc. Rule 21. Physical violence, harassment, vilification and anti-social behaviour Physical violence, verbal abuse, any form of harassment or vilification and obscene or harassing telephone calls, emails, social media, blogs, posters, banners, images etc are strictly forbidden in the Student Residences. These behaviours are considered breaches of the Licence Agreement and an Occupier engaging in such behaviour may, depending on the circumstances, be subject to room re-allocation, expulsion from the UTS Housing Service residential system, other UTS Student misconduct proceedings and/or Police or other legal action if the behaviour is unlawful. Discrimination, harassment and victimisation are against the law and will not be tolerated in UTS Residences. Rule 22. Proselytising and recruitment Unreasonable proselytising and recruitment activities by religious or other groups, which would reasonably cause annoyance, offence or harm to others in the UTS Student Residences are not permitted. Occupiers are not to engage in such activities or facilitate others to do so. Occupiers should refer cases of such activities to the UTS Housing Service staff, or, if after hours, directly to the UTS Security Service or Residential Networker. Rule 23. Signs, notices, posters, banners, etc. Occupiers may post signs, posters, notices and the like on UTS Student Residence noticeboards only once an Occupier has received approval from UTS Housing Service. Banners and signs may not be hung from, or posted on, internal or external walls, balconies and other surfaces. UTS: Student Residences – Handbook and House Rules – November 2012 9
Care should be taken to maintain the tidiness of the noticeboards, to consider the need for other users to have space, and not to post items that may reasonably be considered to be offensive. UTS Housing Service reserves the right to remove any inappropriate or offensive material displayed. Writing on Apartment / bedroom, refrigerators / walls / tiles and other such surfaces within or outside an Apartment, or in or upon the Student Residence, is not permitted. Rule 24. Social Gatherings Common spaces at the Student Residences are meant primarily for Occupiers’ enjoyment and therefore no gatherings would be allowed unless a minimum of 80% of the guests are from the UTS Student Residences. Social gatherings of up to 8 guests (excluding Occupiers of the Apartment) can be held within an Apartment. The guest limit includes both internal (other Occupiers from other Apartments) and external (non-resident) guests. Gatherings attended by 9 guests or more must be held in the common areas of that Student Residence and not within an Apartment. Social gatherings of 15 guests or more require approval from UTS Housing Service. The Occupier must complete an online “social gatherings request form” located on the UTS: Housing Service website at least 3 working days prior to the event. Requests for social gatherings to be held between Monday to Thursday may not be approved if UTS Housing Service considers it could be disruptive to other Occupiers. A social gathering is defined as any occasion when a resident invites other residents or non- residents to socialise in a particular place and time whether for Birthday parties, celebrations of any sort, informal get-togethers, etc. On some occasions multiple social gathering requests may be received for the same day/time. In this case, to ensure the safety and security of all residents and to facilitate the use of common areas by all residents a cap will be placed on the total number of social gatherings approved based on the number of invitees. Within Yura this cap is 80, Gumal 60, Bulga 40 and Geegal 35. In such situations we will approve social gathering requests on a first in – first served basis. Approved gatherings for more than 35 residents in attendance will require additional security staff to be present at the gathering. The cost of the additional security staff will be covered by the organizer and must be paid prior to the social gathering. A 12 hours cancellation period must be given, prior to the event or the organizer will still be liable for all costs. Organiser/s are still liable for ensuring safety and security of guests and any breaches of UTS Housing rules and regulations will be dealt with accordingly. Failure to report or act on problems of a more serious nature at the social gatherings may result in disciplinary action and/or penalties. If the social gathering is seen to have more guests than stated on the Social gathering request, the party will be shut down. In general, requests for gatherings to be held during formal examination periods will not be approved. Private exclusive gatherings (e.g:18th or 21st birthdays), etc, requiring exclusive use of the common area/ facilities are not permitted. This is due to the need for the area to be left for all residents’ enjoyment and use. UTS Student Residences are not to be treated as a private function venue and therefore Occupiers are advised to take such large gatherings externally. Promotions of social gatherings on forums such as Facebook where the event is public and not restricted only to specific individuals on the guest list and within the approved guest cap will result in the cancellation of any social gathering request including if previously approved. Any social gathering resulting in inappropriate behaviour will be shut down. For all gatherings, attendees must carry UTS student ID, (for non UTS students, valid ID). Upon request by UTS Security guard, Residential Networkers or other UTS staff, such ID will need to be produced. Failure to do so may result in removal from the venue and further disciplinary action. In NSW, noise pollution is regulated through the Protection of the Environment Operations Act 1997 (NSW) and local government laws, regulations, by-laws, and strata by-laws apply in regard to unacceptable noise levels. In responding to noise complaints, an authorised officer will take the approach of what a 'reasonable person' would consider offensive. Refer to Rule 17. Rule 25. Solicitation, sales and promotion Solicitation, sale or promotion of any good or service by any person or company is prohibited within Student Residences, except where prior approval has been granted in writing by the Manager, UTS: Housing Service. Students wishing to provide tutoring services for a fee to other students should discuss this request with the UTS: Housing Service staff, who has the authority to recommend approval of such activities to the Manager, UTS: Housing Service. Rule 26. Sport and recreational equipment The use of sport and recreational equipment, such as skateboards, rollerblades, frisbees, balls, hockey sticks and the like, (other than equipment supplied by the UTS for use in the Student Residence common rooms) is not permitted to be used within Student Residences, Gumal Foyer and courtyard and public access points (driveways, thoroughfares). Rule 27. Study Labs Each residence is equipped with a ‘study lab’ which is available for use by each UTS resident to aid in research, assignments and study purposes only. Whilst this is a facility for residents use only, these are limited resources provided for late night study purposes mainly. Residents are encouraged to use the computer lab facilities in the University Campus and not to depend on the Residence study labs. Occupiers are not to:
Consume or take food or drinks into the study lab (bottled water excepted).
Download movies and use of site requiring a large bandwidth.
Download, view or store obscene or offensive material
Attempt repairs or modifications on equipment or software
Use Mobile phones in the lab.
Annoy other users e.g. Music CDs, games, mobile phones, being noisy.
Connect unauthorised equipment to any UTS Computer or Network.
Use more than one computer at a time.
All residents of UTS Housing are bound by a set of rules. These rules are designed to
ensure maximum benefit from the facilities for all residents. These are available through the
Service Desk Knowledge Base, In addition to Residence Lab rules the following UTS
Policies also apply The Acceptable Use of IT Facilities Policy and Copyright at UTS covers
all UTS IT facilities.
Whilst there is no time limit to how long a computer can be accessed for study purposes in
the residences’ study labs, it is expected that residents be considerate to the amount of time
they occupy a computer, so as to allow other residents access.
Any person found in breach of any of the above rules will be subject to disciplinary action.
Rule 28. Theatrette and Music room (Yura Mudang Housing).
The Theatrette and Music room in the Yura Mudang Housing are for the enjoyment of all
Occupiers of the student residence. Occupiers are expected to keep Student Residence
facilities reasonably quiet, and to observe specific quiet hours as established by the UTS:
Housing Service.
Occupiers are not to:
Consume or take in alcoholic drinks into either area unless it is an UTS
Housing authorised event
Consume or take in food or drinks into the music room.
Remove or tamper with any equipment and instruments.
Climb over or on furniture.
All furniture in all Common Areas is to be reinstated in its original position
Occupiers are required to remove and dispose of any rubbish in these areas and return the
space to its original state.
Rule 29. Use of Student Residences for business purposes
The Occupier must not use any part of a Student Residence, address or telephone number
for business purposes, except where prior written approval has been given by the Manager,
UTS: Housing Service to conduct the business activity.
Rule 30. Vehicles and parking spaces
Vehicles are prohibited from all areas of Student Residences except car parks and ancillary
driveways. Where an Occupier is entitled by written agreement with UTS to occupy a car
space within a Student Residence such car space is not to be given or sub-let to any other
UTS: Student Residences – Handbook and House Rules – November 2012 12person without prior written approval of the Manager, UTS: Housing Service. Limited car
spaces are available in some residences, for a monthly fee.
Rule 31. Visitors/Guests
Visitors/ guests are classified as any person that is not a resident of the apartment/ studio
you are residing in at UTS Residence. This includes your family, relatives, girl/ boyfriend,
friends and other persons invited by you or your guests.
31.1 An Occupier is permitted to have a maximum of 1 overnight guest per visit. An
Occupier may have overnight guests up to a total of 10 nights per semester. No
visitor may stay for more than 5 consecutive nights or by being the guest of another
Occupier consecutively within the same Student Residence. The Occupier must first
gain the consent of the other Occupiers of the Apartment, and then apply online to
the UTS: Housing Service or email 1 working day in advance of the visit. All
approved overnight guest are to reside in the Occupiers Room and not sleep in the
common area.
The email communication should note:
the name of the Occupier
the day(s) and night(s) the guest will be staying
whether all other Occupiers in the Apartment have been consulted, the
names of Occupiers who have been consulted, and of those who have
approved the visit and any who are objecting to the visit
the number of times the Occupier has had an overnight guest in the year to
date
the number of times the Occupier has had overnight guest in the year to date.

Applications for weekend guests must be submitted by the Thursday before the
intended stay, even if the guest is arriving on Saturday or Sunday. The UTS:
Housing Service reserves the right to make any checks it deems appropriate to
ensure the Occupier has in fact checked with other Occupiers and gained their free
and willing agreement. Note that no overnight guests are allowed during the 2 weeks
prior to the commencement of each semester, the week prior to a final examination
period or during an official examination period.
The UTS: Housing Service reserves the right to make exceptions under special
circumstances in respect of the approval of guests staying in Student Residences.
Any extra bedding used to accommodate such a guest MUST be removed from the
Room/Apartment after use or as the case may be.
Subject to Rule 31.1 the following rules apply:
31.2 Residents are allowed one unplanned overnight guest to be included in the total of 10
overnight guest nights per semester.
Anyone arriving with one guest after 1am will be deemed to have an overnight visitor
and on such occasion they will be required to sign in at the point of entry, available at
each residence.
31.3 Occupiers are responsible for the conduct of their guests or visitors (including family,
girl/boyfriend, friends, relatives and other UTS Residents), who must also respect
UTS: Student Residences – Handbook and House Rules – November 2012 13and comply with all rules/regulations while in or about the Student Residence. Any
breach by guests or visitors is deemed a breach by the Occupier. The Occupier will
be responsible for the behaviour of their guests or visitors and agrees to pay for any
damage or loss to University property caused by any guest or visitor.
31.4 The privilege of having guests or visitors in the Student Residence or in the Room
assigned to an Occupier is subject to these Rules. The Occupier must not allow a
Room or Apartment or any part thereof to be occupied by anyone else without the
permission of the other Occupiers within the Apartment and the written permission of
the UTS: Housing Service. Note that guests may need to show some form of
identification if directed by staff of the UTS: Housing Service, UTS Security Service
or by a Residential Networker.
31.5 Occupiers are permitted to welcome a maximum of 5 guests to their Student
Residence from 7.00 am to midnight daily. Guests must leave the residence by 1am.
After midnight only one guest per Occupier will be permitted entry and all guests will
be required to sign in at the point of entry. Occupiers wishing to have visitors outside
these times must gain the consent of other Occupiers of the Apartment, and UTS
Housing as per above rule 30.1.
31.6 The Occupier is not permitted to sub-licence their room to a third party or to allow
another person(s) to occupy the room other than as allowed under these Rules.
Entering into a sub-licence (whether or not evidenced in writing) constitutes a breach
of the Licence Agreement.
31.7 Allowing a friend to stay in your room when you are away on vacation, will be
considered sub-licensing and is not permitted. This constitutes a breach which may
result in a disciplinary action including a financial penalty or a possible exclusion from
the Student Residences.
31.8 Unauthorised overnight guest may attract a fee up to $100/day.
SECTION C: HEALTH AND SAFETY
Rule 32. Health and safety
32.1 Occupiers are prohibited from engaging in any conduct, in or about any Student
Residence, which may pose a threat to the health or safety of persons or property,
which may pose a threat to their own safety, which interferes with the rights or
wellbeing of others, or which violates any provision of the Licence Agreement, or any
rule, policy or regulation of UTS or any applicable law or regulation.
32.2 Occupiers are strictly prohibited from sitting on, climbing and or jumping over any
safety barriers, garden beds, fencing or walls within the student residences.
Occupier(s) found in breach of this rule will face serious disciplinary action. This is
particularly relevant for Gumal and Yura Mudang Housing Tower.
32.3 Each Occupier is responsible for their own health insurance.
(Explanatory note: The UTS Health Service –- Medical Practice has doctors available
to see UTS students on a confidential basis. Counsellors are also available in the
UTS Counselling Service for free and confidential consultations. Both the Medical
UTS: Student Residences – Handbook and House Rules – November 2012 14Practice and the Counselling Service are located on level 6, UTS Tower, ph 02 9514
1177).
32.4 UTS Residences are under 24-hour, closed-circuit security camera surveillance for
the safety of the Occupiers.
32.5 UTS Residences also has a roaming security guard on duty from 7pm each evening
for the patrol of Gumal, Bulga, Geegal and Blackfriars for the safety of the Occupiers.

Rule 33. Fire safety and equipment
In the event of a fire alarm, all Occupiers and their visitors MUST follow the evacuation
procedures. The evacuation procedures are posted on the official noticeboards within each
Student Residence and/or the back of each apartment/ studio door. Please familiarise
yourself with the evacuation procedures, emergency exits and the evacuation meeting
points. For more information, please see your Residential Networker).
Occupiers are prohibited from activating, without reasonable cause, fire alarm systems, and
from damaging any fire safety equipment or discharging or tampering with fire safety
equipment except for discharging in the case of fire or the reasonable threat of a fire being
present. Willful misuse of or tampering with fire safety equipment is unlawful and may result
in legal action being initiated and may also lead to termination of the Licence Agreement.
Occupiers will also be held responsible for any tampering with or misuse of fire safety
equipment by their guests or visitors. This includes covering, removal or deliberate
deactivation of smoke detectors and alarms.
Any cost or relevant charges associated with the replacement, reinstatement, repair or the
call out of on call personnel, Fire Brigade and/ or Fire Safety contractors will be passed on to
the Occupier.
The activation of the Fire Alarm within the residence due to deliberate activation, negligence,
or carelessness will be liable for the Fire Brigade call out fee of up to $550.
Rule 34. Fire escapes and external doors
34.1 For safety and security reasons, external, vestibule and fire escape doors MUST
NOT be propped open at any time.
34.2 Where it is indicated that a fire escape door is for use in case of an emergency only,
it is not to be used for any purpose other than for escape from fire or threat of fire
(with the exception of the fire escapes leading to Apartment 210 in Gumal Ngurang,
to Apartment 501 in Bulga Ngurra, and in the new Yura Mudang floors 8 to 21).
34.3 Fire drills are conducted periodically in the UTS Residences.
Rule 35. Appliances
Occupiers are only permitted to bring and use electrical appliances that are safe and energy
efficient. The UTS: Housing Service staff can advise whether an appliance is permitted but
cannot advise on its safety.

Approval of any specified appliance is not a warranty by UTS that the appliance is safe or fit
for its purpose. There may be a requirement, as part of the approval process that the item is
to be Portable Appliance Tested / Electrical Tag and Tested, in which case an additional fee
may apply.
Rule 36. Communicable diseases
36.1 The Occupier must immediately notify UTS: Housing Service of any communicable
disease, such as tuberculosis (TB), hepatitis A, B & C, meningococcal, tuberculosis
measles, chicken pox, bird flu, swine flu etc.
36.2 UTS recommends that all Occupiers should assume that there may be a risk (remote
or otherwise) that others may be carrying a communicable disease, and adopt
universal hygiene practices, safe sharps handling practices and safe sexual practices
(see http://www.health.nsw.gov.au for further information).
Rule 37. Dangerous items and substances
37.1 For health and/or safety reasons, the following are prohibited:
use or storage of toxic or flammable materials and chemicals, including solvent-
based cleaning products, petrol, kerosene and the like;
open-flame devices, including candles, incense burners and smoking devices
including shisha pipes;
torchière-style halogen lamps and ultraviolet tanning lamps;
any heaters other than those installed or approved in writing by UTS: Housing
Service ;
electric blankets;
air-conditioners other than those installed by UTS in the Student Residence or
approved in writing by the UTS: Housing Service;
weapons, including replica weapons
projectile devices
barbeques or cooking devices except as permitted in writing.
fireworks.
37.2 In the event of a fire or other damage caused by an Occupier's use of a prohibited
item or substance, the Occupier will be required to pay the cost of the attendance of
the fire brigade, and costs of any damage whatsoever, together with any other
financial loss that may be incurred by UTS from the incident. These actions will also
result in disciplinary action as outlined in Appendix 1. The current charge for the Fire
Brigade call out is up to $550 per each alarm (fee subject to change by the NSW Fire
Brigade).
Rule 38. Pests
The Occupier must immediately notify the UTS Housing Service via the on-line maintenance
notice system of any pest infestations (e.g. ants, cockroaches, fleas, bedbugs, lice, etc.).
Infestation of bed bugs must be followed up with UTS Housing Service for urgent attention.
Financial penalty may apply if the cause of the issue is the fault of the Occupier/s.
Rule 39. Smoking
In accordance with the UTS ‘smoke-free environment’ policy, smoking is totally prohibited in
all internal and external (outdoor) areas within UTS Student Residences including all
UTS: Student Residences – Handbook and House Rules – November 2012 16Common areas, balconies, internal and external thoroughfares and stairwells. There may be
designated sections of external Common Areas where smoking is permitted. Shisha pipes
and other smoking devices are strictly prohibited.
(Designated areas for smoking are: Gumal Ngurang – outdoors on level 9, designated areas
of level 2, Geegal – courtyard, Bulga Ngurra – outside the foyer entrance on ground floor,
Yura Mudang areas marked on level 21 rooftop).
Rule 40. Throwing of objects
Occupiers may not throw or drop any object from any window, door, fire escape or any other
part of the Student Residence. Occupiers may not play any games or activities that involve
throwing of any objects within the residence or in public walkways, courtyards, common
property. These include but are not limited to:
Gumal foyer,
Gumal water feature in the Quadrant,
Gumal roof top
Geegal courtyard,
Rear lanes adjacent to Geegal and Bulga,
Roof top and Level 8 terrace at Yura Mudang,
Ultimo Pedestrian Network (UPN) adjacent to Yura Mudang entrance,
Level 4 DAB Cafe walkway or,
The Bridge on UPN and Harris Street.
Occupiers who do so risk termination of their Licence Agreement, as well as other UTS
disciplinary proceedings and may be subject to financial penalty associated with any
damage caused.
SECTION D: ACCESS CARDS, KEYS AND LOCKS
Rule 41. Access devices (keys and access cards)
41.1 Each Occupier will be issued access devices (UTS student ID, temporary access
card and/or mail box keys) to the Student Residence. These access devices remain
the property of UTS and must be returned (excluding UTS student ID), in person, by
the Occupier to the UTS: Housing Service office at the end of the term of the Licence
Agreement (however terminated). The Occupier may be charged for any access
device not returned strictly in accordance with this Rule.
41.2 Access devices may not be used by anyone other than the Occupier to whom they
have been issued. Allowing another person to use an access device issued to an
Occupier constitutes a breach of the Licence Agreement.
41.3 It is prohibited to duplicate any access device to any Student Residence.
41.4 Alteration or use of access devices for any unauthorised purpose may result in
confiscation, financial penalty and/or disciplinary action.
41.5 Lost or stolen access devices must be reported immediately to the other Occupiers of
the Apartment and to the UTS: Housing Service or, if after hours, to the UTS Security
Service so that safety measures may be put in place.
UTS: Student Residences – Handbook and House Rules – November 2012 1741.6 Lost, damaged or stolen access devices can be replaced at the UTS: Housing
Service office for a fee. Multiple replacements may result in additional fees in each
instance. A charge may also apply for lock replacement and/or re-keying costs for
other Occupiers of the Student Residence if necessary. It should be noted that no
fee will be charged for replacement of a malfunctioning access device.
Rule 42. Locks / Access devices
Occupiers are prohibited from removing, changing, installing, or replacing any locks / access
devices. Locks / access devices should not be tampered with at any time, including by taping
or jamming them to allow a door to remain open / unlocked.
All external doors must be kept locked at all times, clear of obstructions and not propped
open at all times for the safety and security of all residents. Occupiers or share apartments
who are found to be in breach of this rule may be subject to disciplinary action and/or
financial penalty.
SECTION E: CLEANING AND MAINTENANCE OF THE PREMISES
Rule 43. Cleaning and garbage disposal
43.1 The Occupier must:
43.1.1 Ensure that their Room, Apartment and associated Common Areas are kept clean,
tidy and habitable;
43.1.2 Clean their Room, Apartment and associated Common Areas regularly, and keep all
areas, including personal bedroom space, kitchen and bathroom areas in a sanitary
state by adopting personal hygiene habits that would generally be considered fair
and reasonable in a shared living context;
43.1.3 Not put anything down any sink, toilet or drain likely to cause damage or obstruction;
e.g. paper towel, sanitary napkins, condoms etc.
43.1.4 Store foods in appropriate containers or wrappings to minimise odours and pest
infestations;
43.1.5 Sort and place recycled materials in an appropriate container; (refer to chart
provided).
43.1.6 Place garbage in an appropriate container, wrapping it first if required, and dispose of
it promptly by placing in the garbage chute, garbage room etc. without letting it
accumulate in the Apartment;
43.1.7 Not drop garbage or liquids from garbage on flooring, especially carpeted areas
between Apartments and garbage/recycling areas; and
43.1.8 Remove personal items from shower recess to aid the cleaners in cleaning the
associated area e.g. shampoo/ conditioner bottles, soap, loofah, body sponge/ cloths
etc.
43.2 Pest infestation, due to poor hygiene, sanitation and garbage disposal in an
Apartment or Room may result in special cleaning and pest control carried out by
UTS: Student Residences – Handbook and House Rules – November 2012 18UTS: Housing Service at the Occupier’s expense. Poor hygiene includes, and is not
limited to, leaving spoiled food items in cupboards, fridge, or bedroom.
Rule 44. Alterations, additions and decorating
44.1 The Occupier must not:
44.1.1 Make any alteration or addition, without the written permission of the UTS: Housing
Service, including but not limited to:
the construction of any partition to any Room, Apartment or Common Areas;
Place or affix any satellite dish, antenna or other device to any part of any UTS
Building;
Running of cabling between rooms, apartments or buildings.
44.1.2 The Occupier must not place or affix any satellite dish, antenna or other device to
any part of any UTS building. Cabling between rooms in a Student Residence is not
permitted.
44.1.3 Occupiers are prohibited from permanently removing any item of furniture, fixture,
fitting or other effect belonging to UTS from any Room, Apartment or Common Area
of the Student Residence. Furniture may not be taken into any room in the Student
Residence without being returned to the area intended for general use, and vice
versa. No furniture from the Common Areas is permitted to be removed.
44.1.4 Remove windows or screens from windows, fire escapes, doors or other exterior
parts of the Student Residence.
44.1.5 Occupiers are not permitted to bring additional furniture/furnishing items, such as
their own bed, mattress, shelves, desk, etc into their Room or Apartment, except if
there is a documented medical or health reason. A letter from your doctor is required
to be presented to the UTS: Housing Service office for consideration in support of
your request. Final approval of all requests is up to the discretion of the Housing
Manager or Resident Life Staff. Any costs associated with the removal, storage and
return of any furniture/ item(s) will be at the expense of the occupier.
44.1.6 Refrigerators may not be brought into Student Residences, except if there is a
documented medical or health reason. Refer to rule 4.2 for actions needed to be
taken for approval.
44.1.7 UTS: Housing Service reserves the right to remove any extra bedding, furniture,
appliances etc. if prior approval has not been sought from UTS: Housing Service –
charges may apply for removal or disposal of such items.

44.1.8 Do any decorating that involves painting, marking, inserting nails or screws, making
holes in, or otherwise damaging the Room or any other part of the Student
Residence. The Occupier will be liable for the cost of any repairs, repainting, cleaning
or replacement due to unauthorised decorating.
