Revision of the TEN-E Regulation: EU guidelines for new energy infrastructure

                Resumen On 15 December 2020, the European Commission adopted a proposal to revise the 2013 regulation on trans-
                          European networks in energy (TEN-E). This proposal is currently the subject of interinstitutional 'trilogue' negotiations,
                          which started after both the European Parliament (October 2021) and the Council of the EU (June 2021) had adopted
                          formal negotiating positions. The 2013 TEN-E Regulation sets out EU guidelines for cross-border energy infrastructure,
                          and outlines the process for selecting projects of common interest (PCI). PCIs are infrastructure projects considered
                          essential for delivering on EU objectives in the energy field, including improved interconnection between national
                          markets, greater competitiveness, security of supply, and promotion of renewable energy sources. The list of PCIs is
                          updated every two years. Certain PCI projects are eligible for EU financing from the Connecting Europe Facility (CEF).
                          The revised TEN-E Regulation would align closely with the climate neutrality objectives of the European Green Deal:
                          supporting energy infrastructure that consolidates new and existing clean energy technologies, and ending policy and
                          financial support for fossil fuel projects. The latter would no longer be included on PCI lists and therefore unable to
                          receive CEF funding.

                 Resumen Council Regulation 2020/672 established SURE, the European instrument for temporary support to mitigate
                           unemployment risks in an emergency, which has been in force since 20 May 2020. This note provides an overview in
                           tabular format of the SURE implementing decisions as adopted by Council, of Commission issuances under SURE and
                           of disbursements. It will be regularly updated.

                Resumen In its Europe's Beating Cancer plan, published in February 2021, the European Commission suggests – among other
                          initiatives concerning cancer prevention – several actions concerning alcoholic beverages, such as limiting online
                          advertising and promotion, and reviewing European Union (EU) legislation on the taxation of alcohol. Also among the
                          proposals is mandatory labelling of ingredients and nutrient content on alcoholic beverages by the end of 2022. Health
                          warnings on labels should follow by the end of 2023. First attempts to label ingredients of alcoholic drinks were already
                          made in the late 1970s, however the Council was not able to agree on any of the proposed models. Furthermore,
                          alcoholic drinks containing more than 1.2 % by volume of alcohol (ABV) are exempted from the obligation, set on other
                          drinks and foodstuffs, to list the ingredients and make a nutritional declaration on the label. The European Commission
                          adopted a report in 2017, concluding that it had 'not found objective grounds that would justify' the absence of
                          information on ingredients and nutritional information on alcoholic beverages. Following on from the Commission's
                          report, the European associations representing the alcoholic beverages sectors presented their self-regulation
                          proposal in March 2018, suggesting that some sectors would list all ingredients on labels, while others could use online
                          means of communication instead. Stakeholders have differing views on the desirability and feasibility of listings on-
                          label; some would prefer this information to be allowed to be given off-label through QR-codes, apps or websites, while
                          others absolutely insist that alcoholic drinks should be no different from other sectors of the food and drink industry.
                          The European Parliament has called on the European Commission to consider a health warning and calorie content on
                          alcoholic beverage labels. This is an update of a Briefing published in April 2021.

Access to justice in environmental matters: Amending the Aarhus Regulation

              Resumen The European Union is party to the Aarhus Convention on access to information, public participation in decision-
                        making and access to justice in environmental matters. The Aarhus Regulation applies the Convention's provisions to
                        EU institutions and bodies. In 2017, the Aarhus Convention Compliance Committee, reviewing implementation by the
                        parties, found that the EU fails to comply with its obligations under Article 9, paragraphs 3 and 4 of the convention
                        concerning access to justice by members of the public. To address this non-compliance issue, on 14 October 2020 the
                        European Commission put forward a legislative proposal to amend the Aarhus Regulation. The Council and Parliament
                        adopted their positions on 17 December 2020 and 20 May 2021, respectively. Interinstitutional negotiations, launched
                        on 4 June 2021, concluded on 12 July with a provisional agreement. The text, endorsed by Member States'
                        ambassadors on 23 July, and by the Committee on the Environment, Public Health and Food Safety (ENVI) on 1
                        September 2021, now awaits a vote in Parliament's plenary, planned for the October I session. Third edition. The 'EU
                        Legislation in Progress' briefings are updated at key stages throughout the legislative procedure.

              Resumen This note provides a brief overview of Parliament involvement in scrutinising the Recovery and Resilience Facility (and
                        the European Union Recovery Instrument). It is based on Regulation 2021/241 of 21 February, setting out the
                        Recovery and Resilience Facility, and the relevant parts of the new Interinstitutional Agreement on budgetary matters
                        established between the Parliament, the Council and the Commission. It does not cover nor discusses in detail other
                        instruments or frameworks for scrutiny, namely those relating to the European Semester, EU budgetary procedures,
                        written or oral questions or any discharge procedures. This paper updates an earlier one initially published on January
                        2021.

                Resumen With internet-based communications services, such as webmail, messaging services and internet telephony, becoming
                           subject to the strict confidentiality requirements of the e-Privacy Directive, providers' deployments of specific
                           technologies to detect, report and remove child sexual abuse material online now appear unlawful. To accommodate
                           such practices, the European Commission proposed a regulation that would temporarily exempt them from certain
                           provisions of the e-Privacy Directive, without, however, stipulating the legality of these practices with respect to the
                           wider EU data protection framework. During its July plenary session, the European Parliament is due to vote at first
                           reading on the final text resulting from interinstitutional negotiations.

                 Resumen A prospectus is a legally required document presenting information about a company and the securities that it offers to
                           the public or seeks to admit to trading on a regulated market. The relevant EU legislation consists of a directive,
                           adopted in 2003, amended in 2010, and finally replaced by a regulation in 2017. Drawing up a prospectus entails time
                           and costs, which in the current economic context may deter issuers in distress from seeking to raise new funds, in
                           particular equity. To remedy this, the Commission proposed to amend Regulation (EU) 2017/1129. These
                           amendments aim at creating a temporary (18 month) regime for a short-form prospectus and to simplify the procedure
                           for issuers (so that they can rapidly raise capital), as well as to release pressure on financial intermediaries. The
                           Commission proposal was reviewed by the co-legislators who, among other things, increased the range of those who
                           can benefit from the regime, added elements that must appear in the recovery prospectus and increased the minimum
                           information in the prospectus. They further amended Directive 2004/109/EC (the 'Transparency Directive'), thus
                           providing Member States with the option to postpone, by one year, the requirement for listed companies.

Replacement benchmarks for financial benchmarks in cessation

                 Resumen The pricing of many financial instruments and contracts depends on the accuracy and integrity of (financial)
                           benchmarks, i.e. indices, by reference to which the amounts payable under such financial instruments or contracts, or
                           the value of certain financial instruments, are determined. The anticipated discontinuation of such a benchmark
                           (LIBOR) after the end of 2021 has created fears that it could lead to disruption in the internal market, given that the
                           Benchmarks Regulation ((EU) 2016/1011) does not provide for mechanisms to organise the orderly discontinuation of
                           systemically important benchmarks in the EU. That is why the Commission has proposed to amend the said regulation.
                           The co-legislators significantly amended the Commission’s proposal. Their amendments deal, among other things, with
                           the replacement of a benchmark by EU, or by national law, set additional obligations for supervised entities using a
                           benchmark, regulate the Commission’s powers to adopt delegated acts and establish additional obligations for the
                           Commission with regards to its proposed consultation. The European Parliament adopted the compromise agreement
                           in plenary on 19 January 2021. On 2 February 2021, the Council adopted the act. The final act was published in the

Amending securitisation requirements for the impact of coronavirus

                 Resumen Preserving the ability of banks to continue lending to companies, especially small and medium-sized enterprises, is key
                           when it comes to softening the economic impact of the pandemic and easing recovery. The Commission believes that
                           securitisation can contribute to this. It also considers that in order to increase the potential of securitisation the EU
                           regulatory framework (Regulations (EU) 2017/2402 and (EU) 575/2013) must be updated, to cater for (i) on-balance-
                           sheet synthetic securitisation and (ii) the securitisation of non-performing exposures (NPEs). The co-legislators
                           amended the Commission proposal, with amendments concerning, among other things, the requirements concerning
                           the credit protection agreement, the third party verification agent and the synthetic excess spread, the macroprudential
                           oversight of the securitisation market, the obligations of the EBA, the reporting on prudential requirements and financial
                           information, grandfathering for securitisation positions and NPE securitisations. The final act was signed on 31 March

                 Resumen Regulation (EU) 1315/2013 (the Trans-European Transport Network (TEN-T) Regulation), has shaped EU transport
                           infrastructure policy by strengthening the network approach. It has furthermore established guidelines for national and
                           EU investment in transport infrastructure, and introduced targeted funding under the Connecting Europe Facility and
                           other relevant EU schemes. In the context of new technological and social challenges and new policy approaches, the
                           TEN-T Regulation needs to better address present and future needs. To this end, the European Commission has
                           started a revision process that should end with the adoption of a new legislative proposal, planned for the third quarter
                           of 2021.

                Resumen During the June II plenary session, Parliament is expected to vote on a provisional agreement with the Council on the
                           transposition of fisheries management measures for the Northwest Atlantic. As a contracting party to the Northwest
                           Atlantic Fisheries Organization (NAFO), the European Union must transpose its measures so that they apply to
                           vessels flying the flag of EU Member States. The agreement also provides for new delegated powers to be granted to
                           the European Commission in order to facilitate faster transposition in the future.

                Resumen Data is a key pillar of the European digital economy. To unlock its potential, the European Commission aims to build a
                          market for personal and non-personal data that fully respects European rules and values. While the volume of data is
                          expected to increase dramatically in the coming years, data re-use is hampered by low trust in data-sharing, conflicting
                          economic incentives and technological obstacles. As the first of a set of measures announced in the European strategy
                          for data, the Commission put forward its proposed data governance act on 25 November 2020. It aims at facilitating
                          (largely) voluntary data sharing across the EU and between sectors by strengthening mechanisms that increase data
                          availability and foster trust in intermediaries. It establishes three principle re-use mechanisms and a horizontal
                          coordination and steering board. While there seems to be considerable support for data governance rules, the
                          appropriate approach remains fundamentally disputed. Issues have been raised concerning, for instance, the
                          ineffectiveness of labelling and registration regimes to foster trust and data re-use, the uncertain interplay with other
                          legislative acts, the onerous rules on international data transfers and the vulnerability of certain mechanisms to
                          commercial exploitation. The co-legislators, the European Parliament and Council, are in the process of assessing
                          whether the Commission's proposal presents an adequate response to the challenges identified and are working
                          towards defining their respective positions.

                Resumen This note intends to provide general information about simplification as well as to look a bit more in detail on this issue
                          in the framework of Cohesion Policy, Common Agricultural Policy and Research. These three EU policies represent
                          sectors that largely benefit from the financing of the EU budget and have experienced simplification due to the
                          response of the Commission, the European Parliament and the Council to the requests of final beneficiaries. At the
                          same time, there have been repeated calls from the European Court of Auditors regarding these policies to reduce
                          their complexity and further apply simplification measures, without compromising their functioning and the sound
                          financial management of the EU budget.

                          assessment (IA) accompanying the above-mentioned communication on the new EU strategy on adaptation to climate
                          change (new adaptation strategy), which aims to realise the 2050 vision of a climate-resilient EU. The IA was
                          published on 24 February 2021 and was subsequently referred to the European Parliament's Committee on
                          Environment, Pubic Health and Food Safety (ENVI). The Commission's communication builds on Article 4 of the
                          proposal for a European climate law regulation, which requires the Member States and the EU to enhance their
                          adaptive capacity, strengthen their resilience and reduce their vulnerability to climate change. The new EU adaptation
                          strategy was first announced in the European Green Deal communication in December 2019. The European
                          Parliament welcomed the new strategy as a key component of the EU's climate policy in its resolution of 17 December
                          2020 and called for a renewed and improved focus on climate adaptation. The Council, meanwhile, repeatedly
                          stressed the need for further action on adaptation, most recently in January 2020. The new strategy on adaptation to
                          climate change is part of the 2021 Commission work programme.

                Resumen On 18 June 2018, the Commission put forward a proposal for a regulation establishing a Customs programme for
                          cooperation in the field of customs over the 2021-2027 MFF period, a successor to Customs 2020. The programme's
                          main objective is to fund actions aimed at strengthening the customs union. On 15 December 2020, the co-legislators
                          reached agreement in trilogue. The Council adopted its first-reading position on 1 March 2021. On 8 March 2021,
                          IMCO – the committee responsible for the file in the European Parliament – adopted its recommendation for second
                          reading of the Customs programme by the Parliament. The Parliament voted to adopt the first-reading position without
                          amendments on 10 March 2021, and the final act was signed the following day. The regulation was published in the
                          Official Journal on 15 March 2021 and entered into force immediately, and with retroactive application as of 1 January

              Resumen The New Circular Economy Action Plan is one of the main building blocks of the European Green Deal. It sets
                        initiatives along the entire lifecycle of products with the aim to ensure that the resources used for their production,
                        including the waste generated, are kept in the EU economy for as long as possible. At the same time, the circular
                        economy policy aims at protecting the environment and empowering the consumers. Waste shipment within and
                        outside the EU has a crucial role in achieving the EU circular economy objectives. At EU level, the transboundary
                        movements of waste are governed by Regulation (EC) 1013/2006 on shipments of waste (WSR). However, the current
                        design and implementation of the regulation suffer from deficiencies and thus challenge the achievement of the EU
                        circular economy objectives. This Implementation Appraisal looks at the practical implementation of the WSR in light of
                        the Commission proposal for a revision of the regulation expected in the second quarter of 2021.

              Resumen On 28 May 2020, the European Commission adopted a proposal for a regulation on a Technical Support Instrument
                        that would provide Member States with technical support to strengthen their institutional and administrative capacity in
                        designing and implementing reforms. In the context of the 'Next Generation EU' recovery plan, it would support them to
                        prepare and implement recovery and resilience plans, and make reforms and investments related to the green and
                        digital transitions. Modelled on an instrument proposed by the Commission in 2018, the Technical Support Instrument
                        would replace the Structural Reform Support Programme that has helped implement over 1 000 reform projects in the
                        Member States since 2017. This new instrument has a budget of €864 million over the 2021-2027 period (in current
                        prices); by contrast, the Structural Reform Support Programme had a budget of €222.8 million for 2017-2020. At the
                        European Parliament, the Committee on Budgets (BUDG) and the Committee on Economic and Monetary Affairs
                        (ECON) worked jointly on this file under Rule 58 of the Parliament's Rules of Procedure. After interinstitutional
                        negotiations, on 19 January 2021, the Parliament adopted the compromise text at first reading. The final act was
                        signed on 10 February and published in the Official Journal on 19 February; the regulation entered into force the

              Resumen Eurodac is a biometric database in which Member States are required to enter the fingerprint data of asylum-seekers
                        in order to identify where they entered the European Union (EU). Established in 2000 and reviewed in 2013, its main
                        purpose is to facilitate the application of the Dublin Regulation. The 2013 revision broadened the scope to provide law
                        enforcement authorities with access to the Eurodac database. As part of the reform of the common European asylum
                        system in 2016, the European Commission proposed a recast Eurodac Regulation. The co-legislators reached a partial
                        agreement on the proposal in 2018. As part of the broader migration and asylum pact, the new Commission presented
                        an amended proposal on 23 September 2020. The Commission expects the co-legislators to promptly adopt the

                           Borders Code). As stated in the Commission Work Programme of 2021, the current health crisis and pandemic, and

                 Resumen On 12 December 2019, the European Commission adopted a proposal to amend Regulation (EU) No 654/2014
                           concerning the exercise of the EU's rights for the application and enforcement of international trade rules ('the
                           Enforcement Regulation') of 15 May 2014. The Enforcement Regulation enables the EU to suspend or withdraw
                           concessions or other obligations under international trade agreements in order to respond to breaches by third
                           countries of international trade rules that affect the EU's commercial interests. The proposed amendments were aimed
                           at empowering the EU to impose counter-measures in situations where EU trade partners violate international trade
                           rules and block the dispute settlement procedures included in multilateral, regional and bilateral trade agreements,
                           thus preventing the EU from obtaining final binding rulings in its favour. - The Council adopted its negotiating position
                           on 8 April 2020, and the Committee on International Trade (INTA) of the European Parliament adopted its position on 6
                           July 2020. Trilogue negotiations concluded on 28 October with a provisional agreement, which INTA endorsed on 10
                           November. Parliament adopted the agreed text on 19 January 2021. Following the Council's approval, the Regulation

                Resumen On 14 February 2017, the European Commission adopted a proposal amending Regulation (EU) No 182/2011 (the
                          'Comitology Regulation') in order to increase the transparency and accountability of the decision-making process
                          leading to the adoption of implementing acts. The main elements of the proposal include amending the voting rules for
                          the Appeal Committee (AC) in order to reduce the risk of a no opinion scenario and to clarify the positions of the
                          Member States, providing for the possibility of a further referral to the AC at ministerial level if no opinion is delivered,
                          and increasing the transparency of the comitology procedure by making public the votes of the Member States'
                          representatives in the AC. Following the opinions of a number of committees, submitted in the previous and current
                          terms, on 12 October 2020, Parliament's Committee on Legal Affairs adopted its report. It proposes to oblige Member
                          States' representatives to give reasons for their vote, abstention or for any absence from the vote, and where
                          particularly sensitive areas are concerned (consumer protection, health and safety of humans, animals or plants, or the
                          environment), also case-specific detailed reasons for their vote or abstention. Other amendments concern better
                          accessibility to the comitology register to increase transparency for citizens, and empowering Parliament and Council
                          to call on the Commission to submit a proposal amending the basic act, where they deem it appropriate to review the
                          implementing powers granted to the Commission. A partial first-reading report was adopted on 17 December 2020 in

                           initiative is part of measures contributing to a capital markets union and an economy that works for people. The initial
                           appraisal – which provides an analysis of the strengths and weaknesses of the European Commission's impact

                 Resumen In May 2020, the European Commission adopted a proposal on a Solvency Support Instrument. The aim is to support
                           otherwise viable companies in the Union that face solvency difficulties as a result of the coronavirus crisis, and to
                           mitigate possible distortions to the single market and its level playing field. Such distortions are to be expected given
                           the differing degree to which the Member States are affected and the likely unevenness of their responses, which may
                           depend on their fiscal capacity and level of debt. The Commission proposes to increase the guarantee provided to the
                           European Investment Bank under the European Fund for Strategic Investments and to use it to support financial
                           intermediaries, which will then select companies eligible for solvency help. At the European Council meeting in July
                           2020, EU Heads of State or Government did not take up the idea of the solvency support instrument. Both the
                           European Parliament and Commission President, Ursula von der Leyen, have expressed regret at this. Continuing the
                           examination of the proposal in Parliament, the co-rapporteurs have published a draft report in which they propose to
                           widen the scope of eligible companies and ensure fair geographical distribution.

                 Resumen On 27 July 2017, the UK Financial Conduct Authority (FCA) announced its resolution to phase out the London
                           Interbank Offered Rate (LIBOR) by the end of 2021. As supervisor of the LIBOR, the FCA wanted to allow for a smooth
                           transition to alternative reference rates of this widely used benchmark. On 24 July 2020, the European Commission
                           adopted a proposal to amend the Benchmarks, Regulation. The most important part of this proposal is to regulate the
                           replacement rate of a benchmark in cessation (in this case: LIBOR) and to avoid a legal vacuum. This amendment
                           would empower the European Commission to designate, by an implementing act, a statutory replacement rate to
                           replace the reference to the benchmark in cessation, if this cessation may result in significant disruption of financial
                           markets in the Union.
