Rolf Auf der Maur befasst sich seit Beginn seiner Anwaltstätigkeit 1992

Keine Netzsperren bei Urheberrechtsverletzungen
Das Handelsgericht des Kantons Bern hat mit einem am 15. Juni 2018
eröffneten Urteil die von der Filmdistributorin Praesens Film AG gegenüber
Swisscom verlangten Netzsperren abgewiesen. Das Handelsgericht kommt in
seinem ausführlich und sorgfältig begründeten Entscheid zur Einschätzung,
dass Swisscom nicht Teilnehmerin einer Urheberrechtsverletzung ist Das
Gericht weist die Klage daher infolge mangelnder Passivlegitimation der
Swisscom als Internet Service Providerin ab.
