NEW TAX MANDATE LETTER
TAKING INTO ACCOUNT POPIA
It has now become essential to have a pre-season tax letter and mandate or
engagement letter as well as con rmation of the demographics of details of the
individuals. With the advent of S234 of the tax administration act the
consequences of having the incorrect information can be costly.
In your tax and secretarial mandates or engagement letters you need to have

The Personal Protection of Information Act comes into e ect on the 1st July 2021
which deals with the collecting and processing of private information. In order
to provide you with tax services we require your permission to provide us with
the necessary information that may fall within the de nition of personal
information as well as the taxation acts.
We would also like to place on record that our rm has complied internally with
all the provisions of the POPI act that relates to us, in regard to the processing,
security and backup of your data safely. Our information o cer has signed o
on all the requirements.
If you require our services to help you implement the provisions of POPIA please
advise us.
Please note that in the event that we are asked to resign from doing your work
for any reason whatsoever it will be necessary for us to retain your records
including your private information so that we can deal with any queries that
arise from your tax a airs until we are sure that all tax returns led by us are
nalized by SARS. The signing of this mandate letter indicates that we have
your permission to do that.

A word about the secretarial mandate. Company law compliance is at an all-
time low and that’s according to the CIPC Commissioner – check out the
notices. Please don’t misunderstand what’s required. In regard to the
compliance checklist every company has to comply even if the check list does
not have to be submitted to the CIPC. Be up to date with company law – Know
the Companies Act, Rules and Guidelines.

DIGITAL SIGNATURE ON A
NEW PLATFORM
We have reached the age of POPI. We need to insure that our documents are
guaranteed to reach our clients securely. Sky integrates with Signi ow which
guarantees that this will happen!
Our digital signature system is fully integrated into SKY Software.
The main aim of the Sky Sign system is to allow clients to approve various
documents that need to be approved. These are;-

provisional tax submissions
shareholder and directors resolutions
statutory forms that require a signature
Let us take the example of Provisional Tax, say we have just processed a large
number of provisional tax calculations, IRP6 forms and letters. We want to send
them to the clients for approval. The necessary links are embedded in the email
to the clients.
When the client receives the letter the link is clicked opening a secure website
and the letter opens ready for signature. The client registers their details with
the web site (once only) and the system gives the client the opportunity to a x
their signature to the letter either accepting or rejecting the contents. The
acceptance can be by way of their signed name or a sign indicating their
signature. The client can in fact draw or type their signature. They would then
be in a position to attach their signature, con rming the contents of the letter,
or in fact rejecting the contents of the letter. Once they do this and they have
signed the document, it automatically comes back to the sender – the Sky
Software system and the contents of the acceptance or rejection is automatically
read into the Acc n system.
The beauty of doing this bulk process is that the sender can now sort this into
acceptance or rejections or no response and proceed with the ling of the
necessary processing or ling of returns or documents.
The system will also be used for tax returns on a one-to-one basis.

stand up in a court of law and will conform to all the Laws in regard to digital
signatures.

PURPOSES
We are now in a position to obtain the following CIPC data straight into Sky Sec
for comparison and take-on purposes. All we need is the company name and
registration number. We obtain all the necessary info including company tax
numbers, directors tax numbers, vat numbers etc. This means that if we have a
list of company names and company registration numbers we can take on most
of your company secretarial and tax companies as well as directors. If there are
any directors missing we can update Sky Tax.
