Endorsements 1. Additional Insured Endorsement
The definition of ‘Insured’ is extended in include the Councillors and/or the Elected
Representatives of the Council.

Notwithstanding anything to the contrary in the Policy, it is understood and agreed that
the Policy shall extend to cover the legal liability arising out of loss or damage to property
belonging to the Insured’s employees and/or the elected members of the Insured.
The Insurers liability under this extension shall be limited to $1,000,000, which is part of
and not in addition to the Limit of Liability.
3. Hall Hirers Liability Extension
In respect of properties operated and/or owned by the Insured, the definition of ‘You’ is
extended to include Community & Sporting Groups, individuals, commercial groups and
the like, who use and hire the properties operated or owned by the Insured in relation to
all activities related to the hireage or use of these properties, and who do not hold
Liability Insurance that would respond to any legal liability incurred.
4. Indemnity to Ratepayers Extension
The Insurer will indemnify Ratepayers and/or residents for the legal liability arising out of:
a) The use of lawnmowers when mowing of public thoroughfares;
b) Garbage receptacles placed on a public thoroughfare;
c) The use or presence of shelters, cream sheds, rural mailboxes, calf pens, grocery
and newspaper and similar structures where placed, erected or maintained upon a
public road with our consent.
The Insurers liability under this extension shall be limited to $1,000,000, which is part of
and not in addition to the Limit of Liability.
5. Sanctions Clause
Insurer(s) will not be liable to provide any coverage or make any payment hereunder if to
do so would be in violation of any sanctions law or regulation which would expose us, our
parent company or its ultimate controlling entity to any penalty under any sanctions law
or regulation.
All other terms and conditions of this Policy remain unchanged.
6. Aviation & Airport Operators Exclusion
The Insurer(s) shall not be liable in respect of any Claim arising out of:
1. the operation of or responsibility for, by or on behalf of the Insured, any air
traffic control service;
2. the ownership, maintenance, operation, possession or use by or on behalf the
Insured of any aircraft or aerial device;
3. the ownership, maintenance, operation, possession by or on behalf the Insured
of any airport, or any airside services;
4. any Bodily Injury arising from any aircraft or aerial device;
5. any Property Damage to, or arising from, any aircraft or aerial device; or
6. any liability that is intended to be covered by any Airport Owners and Operators
Liability policy, whether such policy indemnifies the Insured for the specific
liability incurred or not.
All other terms and conditions of this Policy remain unchanged.
7. Marina Operators Liability Exclusion
The Insurer(s) shall not be liable in respect of any Claim arising out of any:
a) port, marina or terminal operation;
b) stevedoring or wharfingering;
c) ship refuelling or devanning;
d) operation of any dry docks, docks, wharves, slipways or ramps;
e) marine engineering, construction or repairing; or
f) any liability that is intended to be covered by any Port/Terminal Owners and
Operators, Marine Hull or Marine Protection and Indemnity or similar policy
whether such policy indemnifies the Insured for the specific liability incurred or not.
All other terms and conditions of this Policy remain unchanged.
8. Contract Works – Maximum Contract Value Endorsement
The following Definition is added to the Policy:

contracted by the Insured is employed to do that involves building, construction or
carrying out repairs, alterations, extensions or demolition of any building, structure or
infrastructure project carried out in the course of the contract.
The following Exclusion is added to the Policy:

The Insurer(s) shall not indemnity the Insured for any claim in respect of or alleging
Personal Injury or Property Damage arising out of or in connection with any Contract
Works, where the total value of the Contract Works exceeds $5,000,000, regardless of
whether the Contract Works are Insured or not.
All other terms of this Policy remain unchanged.
Lead Co-Insurance Clause
In this Policy, and unless the context requires otherwise, all references to Insurer(s) is
deemed to be Berkshire Hathaway Specialty Insurance Company ‘BHSI’ ("the Lead
Insurer”) and all other insurers participating in this Policy.
The participating insurers agree to accept any decision of the Lead Insurer and to follow
that decision in all matters relating to this Policy, other than in respect of any ex-gratia
settlement proposed by the Lead Insurer or where there is a material change to the risk/s
insured under this Policy.
The participating Insurers promises under this agreement and obligations under this
Policy are joint in so far as the Policy indemnities apply but each participating insurer's
liability for any claim under this Policy is several and is limited solely to the extent of its
proportionate share as tabled below.
No participating insurer is to be held liable to contribute towards or pay the proportionate
share of any other participating insurer who for any reason, howsoever arising, cannot or
does not satisfy all or part of its obligations under this Policy.
The Policy is issued and signed by the authorised representative of the Lead Insurer
under the authority of all participating Insurers.
