v. 20210323These terms for participation in the WHEELSTAIR “Silver Series” support program (“Terms”) apply
to support for development works and implementation of a device which is designed to assist people
in manual wheelchairs in moving up/down stairs and on flat terrain without any assistance
(“Wheelstair®”), manufactured on behalf of Wheelstair Sp. z o.o., with its registered office at
ul. T. Zana 11A, 20-601 Lublin, Poland, registered in the National Court Register under number
KRS 0000739059, and represented by:
a) Jacek KÜHNL-KINEL - President of the Management Board
b) Michał ZDZIARSKI - Vice President of the Management Board
hereinafter referred to as "WHEELSTAIR".
The person wishing to support the development and implementation of Wheelstair® and join the
“Silver Series” support program (“Program”) as described below in Clause 3 is hereinafter referred
to as "YOU".
1. General
By returning the filled-out Application Form and transferring the Support Fee (indicated below in
Clause 3) to WHEELSTAIR, YOU hereby confirm that YOU wish join the Program and enjoy the
benefits reserved for Program participants, in accordance with these Terms. YOU acknowledge that
WHEELSTAIR may not have completed the development or begun manufacturing the Wheelstair®
at the time YOU join the Program. Communication between YOU and WHEELSTAIR during the
Program and later, if necessary, will be by e-mail (for WHEELSTAIR to: joinus@wheelstair.com ;
for YOU to: the e-mail address indicated in the Application Form).
2. Nature of the Program; Support Fee
The nature of the Program is primarily to assist WHEELSTAIR in completing the development works
of Wheelstair® as soon as possible, enabling the commencement of its manufacture as well as its
introduction for sale on a large scale. All the financial support that YOU provide as part of your
participation in the Program (“Support Fee”) will be dedicated to the above-mentioned purpose.
As a token of gratitude for your support, WHEELSTAIR undertakes to convey the following benefits
to YOU:
A. From the first day of entry into force of the Program:
1) The possibility of active participation in a socially responsible project with global reach i.e.
the development works and implementation of a device designed to assist people in
manual wheelchairs in moving up/down stairs and on flat terrain without any assistance
2) Advance information about new WHEELSTAIR products and WHEELSTAIR services
B. 14 days from the date WHEELSTAIR receives your name and logo (in a form and format
approved by WHEELSTAIR) along with a correctly completed and signed statement of
holding rights to use the same, in accordance with Appendix 1:
1) Posting information about YOU as an entity supporting the process of Wheelstair®
development on WHEELSTAIR website (www.wheelstair.com) and in WHEELSTAIR
social media (provided that your name, logo and signed statement set out in Appendix 1
are sent back to WHEELSTAIR).
-1-C. After receipt of information on the effective readiness for delivery of the Wheelstair® device:
1) 1 Wheelstair® devices with 1 wheelchair adapted to them (type at your discretion,
model at WHEELSTAIR's discretion) delivered to the address indicated by YOU
2) Door-to-door service for your Wheelstair®
3) The Wheelstair® to be delivered to YOU can be painted in a colour of your choice from
among 30 possible colours
4) The Wheelstair® to be delivered to YOU may have a personalized inscription
5) Priority in placing orders on general terms for max. 5 Wheelstair® units
The Support Fee is non-refundable should YOU decide not to support WHEELSTAIR any further for
reasons other than those described in Clause 4. These Terms do not explicitly constitute a sale
agreement for Wheelstair® and do not lock in a production slot or Expected Readiness for Delivery
Date (as defined below in Clause 4).
3. Effective Date; course of the Program
The Program becomes effective when WHEELSTAIR receives both: (1) your correctly filled-out
Application Form and (2) your Support Fee in the amount of:

The Support Fee should be paid by YOU not later than fourteen (14) days after YOU send the correctly
filled-out Application Form to WHEELSTAIR . WHEELSTAIR will send YOU confirmation together with
your unique Program membership number, within seven (7) days after the Program becomes effective,
and YOU will be placed by WHEELSTAIR on the Program-orders list, which is reserved only to Program
participants and YOU will obtain the rights specified in the Clause 2 (A)-(C) above. From that moment
YOU will also receive communications about the development of Wheelstair®. If the Support Fee is not
paid within the time limit indicated above, the Program will not become effective and YOU will not be
placed by WHEELSTAIR on the Program-orders list. Your place on the Program-orders list depends on
the date when YOU effectively become a Program member.
4. Readiness for Delivery Date
The readiness for delivery of Wheelstair® is expected to be reached by 31.12.2022 (“Expected
Readiness for Delivery Date”). While WHEELSTAIR will make every possible effort to keep to this
date, due to the nature of development works it is possible that the date will change. Should the
effective readiness for delivery be delayed by more than twelve (12) months from the Expected
Readiness for Delivery Date, YOU shall have the right to withdraw from the Program on the
conditions described in Clause 7, within fourteen (14) days from 31.12.2023 or from the date when
WHEELSTAIR notifies YOU of the availability of your Wheelstair®, whichever occurs first.
-2-5. Deferral and Transferability
If YOU do not wish to receive your Wheelstair® at the time that YOU are contacted by WHEELSTAIR,
YOU have the option to relinquish your Program-order sequence position on the list and defer to a
later position. If YOU do not communicate your decision to WHEELSTAIR within fourteen (14) days
of notification from WHEELSTAIR, YOU will automatically be granted such a deferral. This option is
transferable or assignable by YOU to another party upon your written request.
6. Priority
WHEELSTAIR will establish the sequence of your Wheelstair® delivery according to your place on
the Program-orders list. WHEELSTAIR may decline your Program participation to avoid over-
subscription, if WHEELSTAIR is unable to commence shipping of Wheelstair® to your region or as
WHEELSTAIR deems appropriate in its sole discretion. If your Program participation is declined,
YOU will be notified of this and your Support Fee will be refunded within fourteen (14) days of you
being notified. The Program-orders list reserved to Program members takes precedence over the
Pre-order list (see also PRE-ORDER on www.wheelstair.com ).
7. Right of Withdrawal
YOU have the right to withdraw from the Program within fourteen (14) days without giving reason.
The notice period is fourteen (14) days from the day the Program has become effective for YOU,
which will be confirmed in writing by WHEELSTAIR. To exercise your right to withdraw, YOU must
send a clear statement to: joinus@wheelstair.com informing WHEELSTAIR about your decision to
withdraw from the Program. YOU may use the attached template (Appendix 2), but use of the
template is not mandatory. To meet the deadline to exercise your right of withdrawal, it is sufficient
that YOU dispatch your notice of withdrawal before the end of the 14-day period mentioned above.
If YOU withdraw from the Program, WHEELSTAIR will refund the Support Fee received from YOU
within fourteen (14) days from the day WHEELSTAIR receives your statement of withdrawal.
WHEELSTAIR will use the same payment method YOU used to complete the transaction, to refund
the Support Fee, unless otherwise expressly agreed with YOU. WHEELSTAIR will not charge YOU
any fee for this refund; notwithstanding the foregoing, banks may charge you with a bank fee related
to the refund of the Support Fee.
8. Limitation of Liability
To the maximum extent permitted by applicable law, WHEELSTAIR makes no warranty of any kind
in connection with these Terms or the subject matter thereof. Under no circumstances will
WHEELSTAIR be held liable for any indirect or consequential loss or damage, including any and all
(a) loss of opportunity (including loss of contract or right to offer or tender); (b) lost opportunity cost;
(c) loss of business; (d) reduction or damage to goodwill; (e) damage to name or reputation; (f) loss
or corruption of data, and regardless of whether any or all of these circumstances are considered to
be indirect or consequential losses or damage, in contract, tort (including negligence), under any
statute or law or otherwise arising out of WHEELSTAIR’s breach of these Terms, even if
WHEELSTAIR has been advised of the possibility of occurrences which would or might lead to such
loss or damages. If WHEELSTAIR is held liable for any damages related to the Programme or these
Terms, YOU will only have the right to claim a refund of the Support Fee made to WHEELSTAIR.
WHEELSTAIR makes no warranty that a ready for sale Wheelstair® device will fit to every wheelchair
model. By accepting these Terms YOU also confirm that YOU are aware that the final technical
-3-requirements for a wheelchair to work properly with Wheelstair® may vary from the current technical
requirements indicated on the WHEELSTAIR website, and that YOU are not entitled to raise any
claims against WHEELSTAIR connected with such changes (if any). WHEELSTAIR undertakes to
make sufficient efforts not to change the technical requirements if possible.
9. Personal Data Processing
The controller of your personal data is WHEELSTAIR (“Controller”). Pursuant to these Terms,
WHEELSTAIR processes your personal data, such as name, surname, email address, company /
institution name, and telephone number.
Purposes and legal basis for the processing:
1) in connection with the obligations connected with the Program – based on article 6.1 b) of
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on
the protection of natural persons with regard to the processing of personal data and on the
free movement of such data, and repealing Directive 95/46/EC (“GDPR”),
2) in connection with sending newsletters regarding the current offer of WHEELSTAIR to the
given email address provided – based on article 6.1. f) of the GDPR,
3) in connection with accounting, tax and other purposes, arising from or in connection with the
legal obligations of the Controller – based on article 6.1. c) of the GDPR,
4) in connection with WHEELSTAIR’s legitimate interest, in particular for the purposes of defending
itself against, establishing and pursuing claims – based on article 6.1. f) of the GDPR.
Personal data may be shared with:
1) authorized employees and/or contractors of the Controller;
2) persons or entities providing particular services to the Controller (accounting, legal,
marketing, courier and IT services) – within the scope required to provide those services.
Retention periods:
1) For the purpose of exercising rights and fulfilling obligations arising from the Program– until
the expiry of any claims,
2) For the purpose of archiving documents – until the expiry of any claims,
3) For accounting and/or tax purposes pertaining to the Program – for no longer than 5 years
counted from the end of the calendar year in which the tax obligation arose,
4) For the purpose of sending newsletters to the email address provided – for 10 years.
In accordance with the GDPR, YOU have the following rights relating to the processing of your
personal data, exercised by contacting the Controller via any means of communication:
1) to access to your personal data (art. 15 GDPR) by requesting sharing and/or sending a copy
of all your personal data processed by the Controller,
2) to request rectification of inaccurate personal data (art. 16 GDPR) by indicating the data
requiring rectification,
3) to request erasure of your persona data (art. 17 GDPR); the Controller has the right to refuse
to erase the personal data in specific circumstances provided by law,
4) to request restriction of processing of your personal data (art. 18 GDPR) by indicating the
data which should be restricted,
-4-5) to move your personal data (art. 20 GDPR) by requesting the preparation and transfer by the
Controller of the personal data that you have provided to the Controller to YOU or another
controller in a structured, commonly used machine-readable format,
6) to object to the processing of your personal data based on art. 6.1 e) or f) of the GDPR, on
grounds relating to your particular situation (art. 21 GDPR),
7) to lodge a complaint with a supervisory authority, in particular in the EU member state of your
habitual residence, place of work or place of the alleged infringement if you consider that the
processing of personal data relating to YOU infringes the GDPR (art. 77.1 GDPR).
Providing your personal data is not obligatory. Providing your personal data is necessary in order to
perform the obligations arising out of these Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Poland without regard to its conflict of law
provisions. Any disputes that may arise from these Terms, and which cannot be settled amongst the
Parties, shall be submitted for resolution to the court of competent jurisdiction.
-5-APPENDIX 1 Statement on holding property rights to the name / logo
As I have joined the Wheelstair support program (the “Program”), I hereby represent that:
a) I hold (or I am authorised to represent the rights holder of) any and all property rights to a
name [insert] (the “Name”) and logo [insert], which I am sending as a graphic file (the “Logo”)
along with this statement, and any other rights necessary for me to use the Name and the
Logo in the manner as set forth in this Statement, and I further confirm that the Name and
the Logo are free and clear of any third-party claims;
b) the Name and the Logo are not the subject of any other agreement or covenant which would
prevent them from being used in the manner as set forth in this Statement;
c) I consent and grant a license for the Name and the Logo to be placed in all WHEELSTAIR
publications about Wheelstair®, the Program and the entities participating in the Program, on
any media and any information platforms, including on WHEELSTAIR websites, social media
and other possible forms of communication;
c) I will not raise any claims for and against the use of the Name and the Logo by WHEELSTAIR
in the manner and to the extent indicated in item (c) above;
d) I indemnify and hold WHEELSTAIR harmless for, from and against any liability under the Civil
Code and any third-party claims related to the use by WHEELSTAIR of the Name and the
Logo in the manner and to the extent indicated in (c) above.;
e) I am aware that WHEELSTAIR has the sole authority to accept the Name and Logo, and that
only Names and Logos accepted by WHEELSTAIR may be placed in WHEELSTAIR
publications about Wheelstair®.

-6-APPENDIX 2 Template Program Withdrawal Letter
Regarding: Withdrawal from the Program according to the rules on distance selling
On …………………. I joined the Program to support development and implementation of the
Wheelstair® device, and obtained certain benefits from WHEELSTAIR in exchange.
I understand that the rules on distance selling provide for a cooling-off period, during which
consumers have the right to withdraw from a contract of this nature. I am hereby giving notice that I
wish to exercise my right to withdraw from my commitment with you.
Please confirm my withdrawal, and I look forward to having my Support Fee returned to me as soon
as possible or at the latest within 14 days of your receipt of this letter.

-7-Niniejsze warunki uczestnictwa w „Srebrnej Serii” programu wsparcia Wheelstair („Warunki”)
dotyczą prac rozwojowych i wdrożenia urządzenia służącego do pomocy osobom poruszającym się
na wózkach inwalidzkich w samodzielnym poruszaniu się po schodach i po płaskim terenie
(„Wheelstair®”), wyprodukowanego w imieniu Wheelstair Sp. z o.o., z siedzibą przy ul. T. Zana 11A,
20-601 Lublin, Polska, wpisanej do Krajowego Rejestru Sądowego pod numerem KRS 0000739059,
którą reprezentują:
a) Jacek KÜHNL-KINEL - Prezes Zarządu
b) Michał ZDZIARSKI - Wiceprezes Zarządu
zwanej dalej „WHEELSTAIR”.
Osoba pragnąca wesprzeć rozwój i wdrożenie urządzenia Wheelstair® w ramach programu
wsparcia „Srebrnej Serii” („Program”) opisanego w pkt. 3, zwana jest w dalszej części niniejszego
dokumentu „WSPIERAJĄCYM”.
1. Postanowienia ogólne
Przesyłając wypełniony Formularz Zgłoszeniowy oraz przekazując Wkład (wskazany poniżej w
pkt. 3) do WHEELSTAIR, WSPIERAJĄCY potwierdza chęć uczestnictwa w Programie i uzyskania
przywilejów zastrzeżonych dla uczestników Programu, zgodnie z niniejszymi Warunkami.
WSPIERAJĄCY przyjmuje do wiadomości, że w chwili przystąpienia przez WSPIERAJĄCEGO do
Programu, WHEELSTAIR mogła jeszcze nie ukończyć prac rozwojowych nad urządzeniem
Wheelstair® lub mogła jeszcze nie rozpocząć jego produkcji. Komunikacja między
WSPIERAJĄCYM a WHEELSTAIR w trakcie trwania Programu, a w razie potrzeby w późniejszym
czasie, będzie odbywać się pocztą elektroniczną (do WHEELSTAIR na adres -
joinus@wheelstair.com; do WSPIERAJĄCEGO - na adres e-mail wskazany w Formularzu
Zgłoszeniowym).
2. Istota Programu; Wkład
Istotą programu jest przede wszystkim pomoc firmie WHEELSTAIR w jak najszybszym ukończeniu
prac rozwojowych urządzenia Wheelstair® w celu umożliwienia rozpoczęcia jego produkcji seryjnej
oraz wprowadzenia do sprzedaży na dużą skalę. Wszelkie wsparcie finansowe udzielone przez
WSPIERAJĄCYCH w ramach uczestnictwa w Programie („Wkład”) zostanie przeznaczone na
wyżej wymieniony cel.
W dowód wdzięczności za udzielone wsparcie, WHEELSTAIR zobowiązuje się przekazać
WSPIERAJĄCEMU następujące korzyści:
A. Od pierwszego dnia obowiązywania Programu:
1) Możliwość aktywnego uczestnictwa w odpowiedzialnym społecznie przedsięwzięciu o
zasięgu globalnym, tj. w pracach rozwojowych i wdrożeniu urządzenia pomagającego
osobom korzystającym z ręcznych wózków inwalidzkich w samodzielnym poruszaniu
się po schodach oraz po płaskim terenie
2) Uzyskiwanie z wyprzedzeniem informacji o nowych produktach i usługach
WHEELSTAIR
B. W terminie 14 dni od dnia otrzymania przez WHEELSTAIR nazwy i logo WSPIERAJĄCEGO
(w formie i formacie zatwierdzonych przez WHEELSTAIR) wraz z prawidłowo wypełnionym i
-8-podpisanym oświadczeniem o prawie do posługiwania się nimi, zgodnie ze wzorem w
Załączniku 1:
1) Umieszczenie na stronie internetowej (www.wheelstair.com) oraz w mediach
społecznościowych WHEELSTAIR informacji o WSPIERAJĄCYM, jako o podmiocie
udzielającym wsparcia w procesie rozwoju urządzenia Wheelstair® (pod warunkiem
odesłania przez WSPIERAJĄCEGO nazwy, logo i podpisanego oświadczenia
zgodnego ze wzorem w Załączniku 1).
C. Po otrzymaniu informacji o gotowości urządzenia Wheelstair® do dostawy:
1) Dostarczenie 1 egzemplarzu urządzenia Wheelstair® z 1 dostosowanym do niego
wózkiem inwalidzkimi (rodzaj wózka wg uznania WSPIERAJĄCEGO, model wózka wg
uznania WHEELSTAIR) na adres wskazany przez WSPIERAJĄCEGO
2) Serwis 'door-to-door’ na dostarczone urządzenie Wheelstair®
3) Możliwość pomalowania dostarczonego urządzenia Wheelstair® na kolor wybrany
przez WSPIERAJĄCEGO spośród 30 dostępnych kolorów
4) Możliwość umieszczenia spersonalizowanego napisu na dostarczonym urządzeniu
Wheelstair®
5) Pierwszeństwo złożenia zamówień na warunkach ogólnych, na maksymalnie 5
egzemplarzy urządzenia Wheelstair®
W przypadku decyzji o wycofaniu się z dalszego wsparcia WHEELSTAIR z przyczyn innych niż
wskazane w pkt. 4, Wkład nie podlega zwrotowi. Niniejsze Warunki nie stanowią umowy sprzedaży
urządzenia Wheelstair®, nie rezerwują okna produkcyjnego, ani nie gwarantują Przewidywanego
Terminu Gotowości do Dostawy (w rozumieniu definicji w pkt. 4).
3. Data wejścia w życie; przebieg Programu
Program obowiązuje od momentu otrzymania przez WHEELSTAIR od WSPIERAJĄCEGO obu
następujących pozycji: (1) prawidłowo wypełnionego Formularza Zgłoszeniowego i (2) Wkładu w
kwocie:

WSPIERAJĄCY powinien dokonać Wkładu nie później niż czternaście (14) dni po wysłaniu do
WHEELSTAIR prawidłowo wypełnionego Formularza Zgłoszeniowego. WHEELSTAIR prześle
WSPIERAJĄCEMU potwierdzenie otrzymania powyższych wraz z unikalnym numerem
uczestnictwa w Programie, w terminie siedmiu (7) dni od rozpoczęcia obowiązywania Programu
oraz umieści WSPIERAJĄCEGO na liście zamówień w ramach Programu, zastrzeżonej wyłącznie
dla uczestników Programu oraz WSPIERAJĄCY uzyska prawa wskazane w pkt. 2 (A)-(C) powyżej.
Od tego momentu WSPIERAJĄCY będzie również otrzymywał informacje na temat postępów w
zakresie opracowywania urządzenia Wheelstair®. Jeśli Wkład nie zostanie wpłacony w terminie
wskazanym powyżej, Program nie będzie obowiązywał, a WSPIERAJĄCY nie zostanie
umieszczony przez WHEELSTAIR na liście zamówień w ramach Programu. Pozycja na liście
-9-zamówień w ramach Programu zależy od dnia skutecznego przystąpienia WSPIERAJĄCEGO do
Programu.
4. Termin gotowości do dostawy
Planowany termin gotowości urządzeń Wheelstair® do dostawy to najpóźniej 31.12.2022 roku
(„Przewidywany Termin Gotowości do Dostawy”). Należy wyraźnie podkreślić, że WHEELSTAIR
dokłada wszelkich starań, aby dotrzymać ten termin, jednak ze względu na charakter prac
rozwojowych możliwe jest jego wydłużenie. W przypadku opóźnienia faktycznego terminu gotowości
do dostawy o ponad dwanaście (12) miesięcy po Przewidywanym Terminie Gotowości do Dostawy,
WSPIERAJĄCY ma prawo zrezygnować z Programu na warunkach opisanych w pkt. 7, w terminie
14 (czternastu) dni od dnia 31.12.2023 roku lub od dnia powiadomienia WSPIERAJĄCEGO przez
WHEELSTAIR o dostępności urządzenia Wheelstair®, w zależności od tego, które z tych zdarzeń
nastąpi wcześniej.
5. Odroczenie i zbywalność
Jeżeli WSPIERAJĄCY nie będzie chciał otrzymać swojego urządzenia Wheelstair® w chwili, w której
WHEELSTAIR skontaktuje się z nim, WSPIERAJĄCY będzie miał możliwość zrezygnowania ze
swojej pozycji na liście zamówień w ramach Programu i przejścia na późniejszą pozycję. Jeżeli
WSPIERAJĄCY nie powiadomi WHEELSTAIR o swojej decyzji w terminie czternastu (14) dni od
momentu otrzymania powiadomienia od WHEELSTAIR, przedmiotowe odroczenie zostanie
automatycznie przyznane WSPIERAJĄCEMU. Powyższa opcja jest zbywalna i może być
przedmiotem cesji na rzecz innej strony na pisemne żądanie WSPIERAJĄCEGO.
6. Pierwszeństwo
WHEELSTAIR ustali kolejność dostawy urządzenia Wheelstair® w zależności od pozycji
WSPIERAJĄCEGO na liście zamówień w ramach Programu. WHEELSTAIR może odmówić
WSPIERAJĄCEMU uczestnictwa w Programie w celu uniknięcia nadmiernej liczby zgłoszeń, w
przypadku niemożności rozpoczęcia przez WHEELSTAIR wysyłki urządzenia Wheelstair® do
regionu WSPIERAJĄCEGO lub jeśli według swojego uznania WHEELSTAIR uzna to za stosowne.
W przypadku odmowy uczestnictwa w Programie, WSPIERAJĄCY zostanie o tym powiadomiony,
a jego Wkład zostanie zwrócony w ciągu czternastu (14) dni od powiadomienia. Lista zamówień w
ramach Programu zarezerwowana dla uczestników Programu ma pierwszeństwo przed listą
zamówień w ramach Przedsprzedaży (patrz również PRZEDSPRZEDAŻ na stronie
www.wheelstair.com).
7. Prawo rezygnacji
WSPIERAJĄCY ma prawo zrezygnować Programu w terminie czternastu (14) dni bez podania
przyczyny. Okres przewidziany na przekazanie stosownego zawiadomienia wynosi czternaście (14)
dni od dnia skutecznego przystąpienia Programu, który to dzień zostanie potwierdzony pisemnie
przez WHEELSTAIR. W celu skorzystania z prawa rezygnacji, WSPIERAJĄCY zobowiązany jest
przesłać na adres: joinus@wheelstair.com jednoznaczne oświadczenie informujące WHEELSTAIR
o rezygnacji z Programu. W tym celu WSPIERAJĄCY może skorzystać z załączonego wzoru
(Załącznik 2), choć użycie tego konkretnego wzoru nie jest obowiązkowe. W celu dotrzymania
terminu skorzystania z prawa rezygnacji wystarczy wysłać oświadczenie o rezygnacji przed
upływem wyżej wymienionych 14 dni.
- 10 -Jeśli WSPIERAJĄCY zrezygnuje z Programu, WHEELSTAIR zwróci otrzymany od
WSPIERAJĄCEGO Wkład w ciągu czternastu (14) dni od dnia wpłynięcia do WHEELSTAIR
oświadczenia o rezygnacji. Do zwrotu Wkładu WHEELSTAIR skorzysta z tej samej metody
płatności, która została użyta do przeprowadzenia transakcji, o ile ze WSPIERAJĄCYM nie
uzgodniono inaczej. Z tytułu dokonywania zwrotu WHEELSTAIR nie pobiera żadnych opłat,
natomiast banki mogą pobrać ewentualne opłaty transakcyjne związane ze zwrotem Wkładu.
8. Ograniczenie odpowiedzialności
W najszerszym zakresie dozwolonym przez obowiązujące prawo, WHEELSTAIR nie udziela
żadnych gwarancji w związku z niniejszymi Warunkami ani w ich przedmiocie. W żadnym wypadku
WHEELSTAIR nie ponosi odpowiedzialności za jakiekolwiek straty lub szkody pośrednie lub wtórne,
w tym za wszelkie (a) utracone możliwości (w tym utratę umowy lub prawa do składania ofert); (b)
utracone koszty alternatywne; (c) straty handlowe; (d) zmniejszenie lub utratę wartości firmy; (e)
szkody na dobrym imieniu lub reputacji; (f) utratę lub uszkodzenie danych oraz niezależnie od tego,
czy jakiekolwiek lub wszystkie te okoliczności są uważane za straty lub szkody pośrednie lub wtórne
na podstawie umowy, jako czyn niedozwolony (w tym zaniedbanie), na podstawie ustawy lub w inny
sposób wynikający z naruszenia przez WHEELSTAIR niniejszych Warunków, nawet jeżeli
WHEELSTAIR została poinformowana o możliwości wystąpienia zdarzeń prowadzących lub
mogących prowadzić do takiej straty lub szkody. Jeżeli WHEELSTAIR zostanie pociągnięta do
odpowiedzialności za jakiekolwiek szkody związane z Programem lub niniejszymi Warunkami,
WSPIERAJĄCEMU przysługiwać będzie jedynie prawo żądania zwrotu Wkładu uiszczonego na
rzecz WHEELSTAIR.
WHEELSTAIR nie udziela żadnej gwarancji, że gotowe do sprzedaży urządzenie Wheelstair®
będzie pasować do każdego modelu wózka inwalidzkiego. Akceptując niniejsze Warunki,
WSPIERAJĄCY potwierdza również, że ostateczne wymagania techniczne dla wózków mogących
prawidłowo współpracować z urządzeniem Wheelstair® mogą różnić się od tych wskazanych na
stronie internetowej WHEELSTAIR oraz że nie jest uprawniony do dochodzenia względem
WHEELSTAIR roszczeń w związku z możliwymi zmianami. WHEELSTAIR zobowiązuje się podjąć
dostateczne starania, aby w miarę możliwości nie zmienić wymogów technicznych dla wózków.
9. Przetwarzanie danych osobowych
Administratorem danych osobowych WSPIERAJĄCEGO jest WHEELSTAIR („Administrator”).
Zgodnie z niniejszymi Warunkami, WHEELSTAIR przetwarza dane osobowe WSPIERAJĄCEGO
takie, jak: imię, nazwisko, adres e-mail, nazwa firmy/instytucji, numer telefonu.
Cel i podstawy prawne przetwarzania:
1) w związku ze zobowiązaniami w ramach Programu – na podstawie art. 6(1)(b)
Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r.
w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w
sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE
(„RODO”),
2) w związku z wysyłaniem na dany adres e-mail biuletynu dotyczącego bieżącej oferty
WHEELSTAIR – na podstawie art. 6(1)(f) RODO,
3) w związku z celami księgowymi, podatkowymi i innymi wynikającymi z obowiązków prawnych
Administratora – na podstawie art. 6(1)(c) RODO,
4) w związku z uzasadnionym interesem WHEELSTAIR, w szczególności w celu obrony przed
roszczeniami, ustalania i dochodzenia roszczeń – na podstawie art. 6(1)(f) RODO.
- 11 -Dane osobowe mogą być udostępniane:
1) upoważnionym pracownikom i/lub podwykonawcom Administratora;
2) osobom lub podmiotom świadczącym określone usługi na rzecz Administratora (usługi
księgowe, prawne, marketingowe, kurierskie, informatyczne) – w zakresie wymaganym do
świadczenia tych usług.
Okresy przechowywania:
1) Do celów wykonywania praw i wypełniania zobowiązań wynikających z Programu – do czasu
wygaśnięcia wszelkich roszczeń,
2) Do celów archiwizacji dokumentów – do czasu wygaśnięcia wszelkich roszczeń,
3) Do celów księgowych i/lub podatkowych dotyczących Programu – przez okres nie dłuższy
niż 5 lat licząc od końca roku kalendarzowego, w którym powstał obowiązek podatkowy,
4) W celu wysyłania biuletynów na podany adres e-mail – przez okres 10 lat.
Zgodnie z RODO, WSPIERAJĄCEMU przysługują następujące prawa dotyczące przetwarzania
jego danych osobowych, wykonywane przez kontakt z Administratorem za pośrednictwem
dowolnych środków komunikacji:
1) dostępu do swoich danych osobowych (art. 15 RODO) poprzez żądanie udostępnienia i/lub
wysłania kopii wszystkich danych osobowych przetwarzanych przez Administratora,
2) żądania sprostowania niedokładnych danych osobowych (art. 16 RODO) poprzez wskazanie
danych wymagających sprostowania,
3) żądania usunięcia danych osobowych (art. 17 RODO); Administrator ma prawo odmówić
usunięcia danych osobowych w szczególnych okolicznościach przewidzianych przez prawo,
4) żądania ograniczenia przetwarzania danych osobowych (art. 18 RODO) poprzez wskazanie
danych, których przetwarzanie należy ograniczyć,
5) przeniesienia danych osobowych (art. 20 RODO) poprzez żądanie przygotowania i
przekazania przez Administratora danych osobowych przekazanych przez
WSPIERAJĄCEGO Administratorowi, WSPIERAJĄCEMU lub innemu administratorowi w
ustrukturyzowanym, powszechnie używanym formacie nadającym się do odczytu
maszynowego,
6) sprzeciwu wobec przetwarzania danych osobowych na podstawie art. 6(1)(e) lub (f) RODO
z przyczyn odnoszących się do szczególnej sytuacji WSPIERAJĄCEGO (art. 21 RODO),
7) wniesienia skargi do organu nadzorczego, w szczególności w państwie członkowskim UE, w
którym WSPIERAJĄCY ma miejsce zwykłego pobytu, miejsce pracy lub w którym miało
miejsce domniemane naruszenie, jeżeli WSPIERAJĄCY uzna, że przetwarzanie danych
osobowych jego dotyczących narusza przepisy RODO (art 77(1) RODO).
Podanie danych osobowych nie jest obowiązkowe. Podanie danych osobowych jest konieczne do
wypełnienia zobowiązań wynikających z Warunków.
10. Prawo właściwe i jurysdykcja
Niniejsze Warunki podlegają prawu Rzeczpospolitej Polskiej, z wyłączeniem zawartych w nim norm
kolizyjnych prawa. Wynikające na gruncie niniejszych Warunków spory, których Strony nie mogą
rozstrzygnąć pomiędzy sobą, zostaną skierowane do sądu właściwej jurysdykcji.
- 12 -ZAŁĄCZNIK 1 Oświadczenie dotyczące praw majątkowych do nazwy / logo
W związku z przystąpieniem do programu wsparcia urządzenia Wheelstair ("Program"), ja niżej
podpisany, niniejszym oświadczam, że:
a) jestem właścicielem (lub osobą uprawnioną do reprezentowania właściciela) wszelkich praw
majątkowych do nazwy [wypełnij] („Nazwa”) i logo [wypełnij], które przesyłam wraz z
niniejszym oświadczeniem w formie pliku graficznego („Logo”) oraz innych niezbędnych do
wykorzystania Nazwy i Logo w sposób wskazany w niniejszym oświadczeniu praw i
potwierdzam, że Nazwa i Logo są wolne od jakichkolwiek roszczeń osób trzecich;
b) Nazwa i Logo nie są przedmiotem żadnej innej umowy ani zobowiązania, które
powodowałaby niemożność wykorzystania ich w sposób wskazany w niniejszym
oświadczeniu;
c) wyrażam zgodę i udzielam licencji na korzystanie z Nazwy i Logo poprzez umieszczenie
Nazwy i Logo we wszystkich publikacjach WHEELSTAIR, informujących o Wheelstair®,
Programie i podmiotach biorących udział w Programie, na wszystkich możliwych nośnikach i
platformach informacyjnych, w tym na stronach internetowych WHEELSTAIR, portalach
społecznościowych WHEELSTAIR i w innych możliwych formach komunikacji;
c) nie będę zgłaszać żadnych roszczeń w związku z użyciem przez WHEELSTAIR Nazwy i
Logo w sposób i w zakresie wskazanym w lit. c) powyżej;
d) zwalniam WHEELSTAIR z odpowiedzialności na zasadach kodeksu cywilnego z tytułu
wszelkich roszczeń osób trzecich związanych z użyciem Nazwy i Logo przez WHEELSTAIR
w sposób i w zakresie wskazanym w lit. c) powyżej Nazwy i Logo.;
e) jestem świadomy, że akceptacja Nazwy i Logo leży w wyłącznej gestii WHEELSTAIR i że
jedynie Nazwa i Logo zaakceptowane przez WHEELSTAIR będą mogły być umieszczone w
publikacjach WHEELSTAIR, informujących o Wheelstair®.

- 14 -Les présentes conditions de participation au programme de soutien « Série Argent » Wheelstair (les
« Conditions ») concernent le développement et la mise sur la marché d’un dispositif pour aider
les personnes en fauteuil roulant à se déplacer seules dans l’escalier et sur une surface plane (le
« dispositif Wheelstair® »), fabriqué au nom de la société Wheelstair Sp. z o.o., ayant son siège à
l’adresse : ul. T. Zana 11A, 20-601 Lublin, Pologne, immatriculée au Registre Judiciaire Nationale
sous le numéro KRS 0000739059, représentée par :
a) Monsieur Jacek KÜHNL-KINEL - Président de la Gérance
b) Monsieur Michał ZDZIARSKI - Vice-président de la Gérance
ci-après dénommée « WHEELSTAIR ».
La personne souhaitant apporter son soutien au développement et à la mise sur le marché du
dispositif Wheelstair® dans le cadre du programme de soutien « Série Argent » (le « Programme »)
décrit au point 3, est dénommée ci-après le « PARTICIPANT ».
1. Dispositions générales
En adressant le Formulaire d’Adhésion dûment rempli et en transmettant une Contribution (visée
au point 3 ci-dessus) à WHEELSTAIR, le PARTICIPANT confirme sa volonté de participer au
Programme de soutien et de bénéficier des privilèges réservés aux participants au Programme,
conformément aux présentes Conditions. Le PARTICIPANT prend acte qu’au moment de l’adhésion
au Programme, le développement du dispositif Wheelstair® peut être encore inachevé ou
WHEELSTAIR n’a pas encore commencé sa fabrication. La communication entre le PARTICIPANT
et WHEELSTAIR au cours du Programme, et plus tard, si besoin est, se fera par courrier
électronique (à WHEELSTAIR à l’adresse - joinus@wheelstair.com; au PARTICIPANT - à l’adresse
e-mail indiquée au Formulaire d’Adhésion).
2. Caractéristiques du Programme; Contribution
Le Programme de soutien a pour objet d’aider la société WHEELSTAIR à achever le plus
rapidement possible le développement du dispositif Wheelstair® en vue de lancer la production en
série du dispositif et de le mettre en vente sur le marché à grande échelle. Tout soutien financier
accordé par les PARTICIPANTS dans le cadre du Programme (la « Contribution ») sera employé
à cette fin.
En signe de reconnaissance du soutien accordé, WHEELSTAIR s’engage à octroyer au
PARTICIPANT les avantages suivants :
A. À partir du premier jour de la validité du Programme :
1) Participation active à l’entreprise socialement responsable à l’échelle mondiale, c’est-
à-dire au développement et à la mise sur le marché du dispositif pour aider les
personnes en fauteuil roulant manuel à se déplacer seules dans l’escalier et sur une
surface plane,
2) Information préalable sur les nouveaux produits et services WHEELSTAIR,
B. Dans un délai de 14 jours de la réception par WHEELSTAIR du nom/dénomination et du logo
du PARTICIPANT (sous forme et en format approuvés par WHEELSTAIR) ainsi que de la
déclaration dûment remplie et signée portant le droit de les utiliser, selon le modèle figurant
à l’Annexe 1:
- 15 -1) Publication sur le site internet (www.wheelstair.com ) et les réseaux sociaux de
WHEELSTAIR des informations sur le PARTICIPANT, en tant qu’entité qui fournit le
soutien au développement du dispositif Wheelstair® (à condition que le PARTICIPANT
transmette ses nom/dénomination et logo, ainsi que la déclaration signée et conforme
au modèle figurant à l’Annexe 1).
C. Après avoir reçu l’information sur la disponibilité du dispositif Wheelstair® à la livraison :
1) Livraison d’un (1) dispositif Wheelstair® avec un (1) fauteuil roulant compatible (type
de fauteuil roulant laissé à la libre appréciation du PARTICIPANT, modèle de fauteuil
laissé à la libre appréciation de WHEELSTAIR) à l’adresse indiquée par le
PARTICIPANT,
2) Service « porte à porte » pour le dispositif Wheelstair® livré,
3) Possibilité de peindre le dispositif Wheelstair® livré avec une couleur choisie par le
PARTICIPANT parmi les 30 couleurs disponibles,
4) Possibilité d’apposer une inscription personnalisée sur le dispositif Wheelstair® livré,
5) Priorité à la passation des commandes dans les conditions générales pour un
maximum de 5 dispositifs Wheelstair®.
En cas de rétractation du programme de soutien WHEELSTAIR pour des raisons autres que celles
indiquées au point 4, la Contribution n’est pas remboursable. Les présentes Conditions ne
constituent pas un contrat de vente du dispositif Wheelstair®, ne réservent pas de créneau dans le
planning de production ni ne garantissent pas le Délai Prévu de Disponibilité à la Livraison (au sens
de la définition visée au point 4).
3. Date d’entrée en vigueur ; déroulement du Programme
Le Programme de soutien entre en vigueur dès la réception par WHEELSTAIR de la part du
PARTICIPANT: (1) du Formulaire dûment rempli et (2) de la Contribution d’un montant de:
25000 EUR, versée sur le compte bancaire de WHEELSTAIR nº 18 1050 1025 1000 0090 8120
2427 (Bank BIC/Swift: INGBPLPW)
ou
30000 USD, versée sur le compte bancaire de WHEELSTAIR nº 93 1050 1025 1000 0090 8120
2435 (Bank BIC/Swift: INGBPLPW)
Le PARTICIPANT doit apporter la Contribution au plus tard quatorze (14) jours suivant l’expédition
à WHEELSTAIR du Formulaire dûment rempli. Par la suite, WHEELSTAIR enverra au
PARTICIPANT un accusé de réception des éléments visés ci-dessus, accompagné d’un numéro
unique de la commande dans le cadre du Programme, dans un délai de sept (7) de l’entrée en
vigueur du Programme de soutien et mettra le PARTICIPANT sur la liste des commandes dans le
cadre du Programme, réservée exclusivement aux participants au Programme. En conséquence, le
PARTICIPANT obtiendra les droits indiqués au point 2 (A)-(C) ci-dessus. À partir de ce moment-là,
le PARTICIPANT sera régulièrement tenu informé de l’avancement des travaux sur le dispositif
Wheelstair®. A défaut de versement de la Contribution dans le délai imparti ci-dessus, le Programme
cessera d’être valable, et le PARTICIPANT ne sera pas mis sur la liste des commandes dans le
cadre du Programme. La place sur la liste des commandes dans le cadre du Programme dépend
de la date d’adhésion efficace du PARTICIPANT au Programme de soutien.
- 16 -4. Délai de disponibilité à la livraison
La disponibilité des dispositifs Wheelstair® à la livraison est prévue au plus tard pour le 31/12/2022
(le « Délai Prévu de Disponibilité à la Livraison »). Il important de préciser que WHEELSTAIR
fait toute diligence pour respecter le délai visé ci-dessus. Toutefois, en raison de la nature des
travaux de développement, ce délai peut être prorogé. Si la date réelle de préparation de la livraison
est retardée de plus de douze (12) mois par rapport au Délai Prévu de Disponibilité à la Livraison,
le PARTICIPANT aura le droit d'annuler le programme dans les conditions décrites au point 7, dans
les quatorze (14) jours suivant la première des deux dates suivantes: le 31/12/2023 ou la notification
par WHEELSTAIR au PARTICIPANT de la disponibilité de Wheelstair®.
5. Prorogation et cessibilité
Dans l’éventualité où le PARTICIPANT ne souhaiterait pas recevoir son dispositif Wheelstair® au
moment où WHEELSTAIR l’informe sur sa disponibilité, le PARTICIPANT pourra annuler sa place
sur la liste des commandes dans le cadre du Programme et passer à une position ultérieure.
Lorsque le PARTICIPANT n’informera pas WHEELSTAIR sur sa décision en ce sens dans un délai
de quatorze (14) jours de la notification de WHEELSTAIR, la prorogation en question sera
automatiquement accordée au PARTICIPANT. Cette option peut être cédée à un tiers sur la
demande écrite du PARTICIPANT.
6. Priorité
WHEELSTAIR fixera l’ordre de livraison du dispositif Wheelstair® en fonction de la place du
PARTICIAPANT sur la liste des commandes dans le cadre du Programme. WHEELSTAIR peut
refuser au PARTICIPANT l’adhésion au Programme pour éviter le nombre excessif de demandes,
en cas d’impossibilité pour WHEELSTAIR de commencer l’expédition du dispositif Wheelstair®, en
ce qui concerne la région du PARTICIPANT, ou si WHEELSTAIR le juge utile. En cas de refus de
la participation au Programme, le PARTICIPANT en sera tenu informé et WHEELSTAIR lui
remboursera sa Contribution dans un délai de quatorze (14) jours suivant la notification. La liste des
commandes dans le cadre du Programme réservée aux participants au Programme a la priorité sur
la liste des commandes dans le cadre de la Prévente (voir également la section PRÉVENTE sur le
site internet www.wheelstair.com).
7. Droit de rétractation
Le PARTICIPANT peut se rétracter du Programme dans un délai de quatorze (14) jours sans donner
de motifs. Le délai prévu pour envoyer une notification en ce sens est de quatorze (14) jours de la
date d’adhésion effective au Programme, confirmée par WHEELSTAIR sous forme écrite. En vue
d’exécuter son droit de rétractation, le PARTICIPANT est tenu d’en informer WHEELSTAIR et
d’envoyer une déclaration expresse de rétractation du Programme à l’adresse:
joinus@wheelstair.com. Pour ceci, le PARTICIPANT peut utiliser le modèle figurant à l’Annexe 2,
bien que l’emploi de ce modèle concret soit facultatif. Afin de respecter le délai de rétractation, il
suffit d’envoyer la déclaration de rétractation visée ci-dessus avant l’expiration du délai de 14 jours.
En cas de rétractation du PARTICIPANT du Programme de soutien, WHEELSTAIR lui remboursera
sa Contribution, dans un délai de quatorze (14) jours de la réception de la déclaration de rétractation.
Pour effectuer ce remboursement, WHEELSTAIR doit recourir au même mode de paiement qui a
été utilisé pour verser la contribution, sauf accord contraire avec le PARTICIPANT. Le
remboursement par WHEELSTAIR est gratuit, mais les banques peuvent prélever d’éventuels frais
bancaires à ce titre.
- 17 -8. Clause limitative de responsabilité
Dans la mesure autorisée par la loi en vigueur, WHEELSTAIR ne consent aucune garantie dans le
cadre des présentes Conditions ni au titre de leur objet. WHEELSTAIR ne pourra en aucun cas être
tenue pour responsable des pertes ou des dommages indirects ou secondaires, notamment (a) des
opportunités perdues (y compris de la perte du contrat ou du droit de présenter des offres); (b) des
coûts d’opportunité perdus; (c) des pertes commerciales; (d) de la diminution ou de la perte d’un
fonds de commerce; (e) du préjudice d’image et de réputation; (f) de la perte ou de la destruction
des données et ceci indépendamment du fait que n’importe laquelle ou toutes ces circonstances
sont considérées comme des pertes ou des dommages indirectes ou secondaires, en vertu des
stipulations contractuelles, comme un acte illicite (notamment une négligence), en vertu des
stipulations contractuelles ou d’une autre manière résultant de la violation des présentes Conditions
par WHEELSTAIR, même si WHEELSTAIR a été bien informée de la possibilité de survenue
d’événements entraînant ou pouvant entraîner une perte ou des dommages visés ci-dessus. Dans
l’hypothèse où WHEELSTAIR serait tenue pour responsable de quelconques pertes liées au
Programme ou aux présentes Conditions, le PARTICIPANT n’aura que le droit d’exiger le
remboursement de la Contribution versée pour le compte de WHEELSTAIR.
WHEELSTAIR ne garantit pas que le dispositif Wheelstair® disponible à la vente sera compatible
avec tout modèle de fauteuil roulant. En adhérant aux présentes Conditions, le PARTICIPANT
déclare également que les exigences techniques définitives, applicables aux fauteuils roulants
pouvant fonctionner correctement avec le dispositif Wheelstair®, peuvent différer de celles figurant
sur le site internet de WHEELSTAIR et qu’il s’interdit de faire valoir ses droits auprès de
WHEELSTAIR en raisons d’éventuelles modifications. WHEELSTAIR s’engage à faire son possible
pour ne pas modifier, dans la mesure du possible, les exigences techniques applicables aux
fauteuils.
9. Traitement de données à caractère personnel
L’Administrateur des données à caractère personnel du PARTICIPANT est WHEELSTAIR
(l’«Administrateur»). Conformément aux présentes Conditions, WHEELSTAIR traite les données
personnelles suivantes du PARTICIPANT: prénom, nom, adresse e-mail, raison
sociale/dénomination de l’institution, numéro de téléphone.
Finalité et fondement légal du traitement :
1) aux fins des engagements pris dans le cadre du Programme – en vertu des dispositions de
l’art. 6(1)(b) du Règlement du Parlement européen et du Conseil (UE) 2016/679 en date du
27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des
données à caractère personnel et à la libre circulation de ces données, et abrogeant la
directive 95/46/WE (« RODO »),
2) aux fins de l’expédition à l’adresse e-mail indiquée d’un bulletin de l’offre en cours
WHEELSTAIR – en vertu des dispositions de l’ art. 6(1)(f) du règlement RODO,
3) à des fins comptables, fiscales et autres résultant des obligations légales de l’Administrateur
– en vertu des dispositions de l’ art. 6(1)(f) du règlement RODO,
4) aux fins des intérêts légitimes de WHEELSTAIR, afin de se défendre contre les
revendications, constater et poursuivre des créances – en vertu des dispositions de l’ art.
6(1)(f) du règlement RODO.
- 18 -Les données à caractère personnel ne sont accessibles qu’aux personnes suivantes:
1) salariés/sous-traitants autorisés de l’Administrateur;
2) personnes ou entités fournissant des prestations de services à l’Administrateur (services
comptables, juridiques, services de marketing, services de courrier, services informatiques)
– dans la mesure requise pour la prestation de ces services.
Durées de conservation :
1) aux fins de l’exécution des droits et de l’accomplissement les engagements résultant du
Programme – jusqu’à l’expiration de toute prétention,
2) à des fins archivistiques des documents – jusqu’à l’expiration de toute prétention,
3) à des fins comptables et/ou fiscales relevant du Programme – pendant la période inférieure
à 5 ans à compter de la fin de l’année civile, au cours de laquelle l’obligation fiscale est née,
4) aux fins de l’expédition des bulletins à l’adresse e-mail indiquée – pendant 10 ans.
Conformément au RODO, le PARTICIPANT dispose des droits suivants concernant le traitement
des données à caractère personnel qui le concernent, exercés par voie de contact avec
l’Administrateur, à l’intermédiaire de tout moyen de communication:
1) droit d’accès aux données à caractère personnel qui le concernent (art. 15 du règlement
RODO), en exerçant le droit de demander et/ou d’obtenir une copie de toutes les données à
caractère personnel traitées par l’Administrateur,
2) droit de rectification des données à caractère personnel qui sont inexactes (art.16 du
règlement RODO), en indiquant les données qui doivent être rectifiées,
3) droit à l’effacement des données à caractère personnel (art.17 du règlement RODO);
l’Administrateur peut refuser d’effacer les données à caractère personnel dans des
circonstances prévues par la loi,
4) droit à la limitation du traitement des données à caractère personnel (art. 18 du règlement
RODO), en indiquant les données dont le traitement doit être limité,
5) droit à la portabilité des données à caractère personnel (art. 20 du règlement RODO), en
demandant à l’Administrateur de collecter et de transmettre les données à caractère
personnel, transmises à l’Administrateur par le PARTICIPANT, au PARTICIPANT ou à un
autre administrateur, dans un format structuré, couramment utilisé et lisible par machine,
6) droit d’opposition au traitement des données à caractère personnel, en application de l’art.
6(1)(e) ou (f) du RODO pour des raisons tenant à la situation particulière du PARTICIPANT
(art. 21 du règlement RODO),
7) droit d’introduire une réclamation auprès d’une autorité de contrôle, en particulier dans l’État
membre dans lequel le PARTICIPANT trouve sa résidence habituelle, son lieu de travail ou
le lieu où la violation aurait été commise, si le PARTICIPANT considère que le traitement des
données à caractère personnel le concernant constitue une violation du règlement RODO
(art. 77(1) du règlement RODO).
La communication des données à caractère personnel n’est pas obligatoire. La communication des
données à caractère personnel est nécessaire pour remplir les engagements résultant des
présentes Conditions.
