This year’s Symposium will include 60-90 minute sessions on topics similar to those at past
Symposiums (See the 2020 Symposium Agenda here). This year we will address evolving changes
and emerging developments in class action practice, including the impact of critical new Supreme
Court decisions in the Goldman Sachs (class certification), Ford Motor Company (personal
jurisdiction) and TransUnion v. Ramirez (Article III standing) cases; noteworthy Court of Appeals
rulings; evidentiary challenges and opportunities in a post-pandemic world; and ethical issues of
importance to class action practitioners.

To enhance this year’s Symposium, we have added a series of workshops the afternoon of the second
day (Saturday, October 30th). These workshops will provide comprehensive deep dives for
practitioners to choose from.

     Winning Your Motions Through Effective Oral Advocacy: With over 90% of all civil cases
     settling before trial, motion practice has become even more important than ever in consumer
     litigation. The outcomes of contested motions often constitute the tipping points in our cases.
     How can our oral motion advocacy be better prepared and delivered? This workshop will
     explore skills and strategies we all can use to improve our success rates at our motions
     hearings. The workshop will be led by Emmy Levens, a partner at Cohen Milstein’s Antitrust
     practice group with a particular expertise in complex litigation and class actions. Breakout
     groups will be designed to provide opportunities for the productive exchange of ideas among
     experienced practitioners.
     Making ESI an Integral Part of Your Litigation Practice: Electronically Stored
     Information (“ESI”) has become a critical part of consumer litigation. How you manage that
     discovery in your practice can be a significant issue. Do you handle it in-house, purchase
     specialized software programs, engage a consultant or outsource your requirements? How do
     you preserve and prepare the plaintiff’s ESI? How do you obtain and manage defendant’s
     databases? This workshop will explore these questions, led by Christine Webber, a partner at
     Cohen Milstein’s Civil Rights & Employment practice group where she organizes large, high-
     profile class and collective actions and works closely with economic and statistical experts on
     developing sophisticated statistical analyses of class claims. Breakout groups will be designed
     to provide opportunities for the productive exchange of ideas among experienced
     practitioners.
     Winning Your Motions Through Effective Written Advocacy: Improving our written
     advocacy skills in an adversarial context like consumer litigation presents unique challenges
     and opportunities to prevail. This workshop will be tailored to address how we can become
     better drafters of trial court motions and briefs. The session will be led by Matt Wessler, a
     principal at Gupta Wessler PLLC, where he focuses on public interest and plaintiffs’-side
     appellate and complex litigation.

2021 Consumer Rights Litigation Conference
and Class Action Symposium

This year’s Consumer Rights Litigation Conference (CRLC) will delve into every aspect of
consumer law, including full tracks on Auto Loans, Credit/Banking, Credit Reporting, Debt
Collections, Mortgages and Foreclosures, Student Loans and the Telephone Consumer Protection
Act (TCPA), in addition to many individual courses on ethics, litigation, practice issues and more.
Sessions will take place between 12:00 PM and 6:30 PM Eastern standard time (EST) every day, and
one conference registration fee will allow you to attend as many sessions as you’d like. For those
sessions you miss, we will be recording them for later viewing. We’ll also have plenary addresses
from high-profile speakers, strategy summits, legal tech talks, networking opportunities, and even a
few social gatherings to allow us to connect virtually.

  Step One: Are you Eligible to attend a NCLC Conference? You must certify
                                     that:

  1. You are a lawyer and that neither you nor anyone in your organization represents business or
     commercial clients (except in disputes between two businesses) or is engaged in any business
     other than providing legal representation to consumers, OR
  2. You are an employee of a state or federal regulatory or enforcement agency or of a state or
     federally funded nonprofit legal aid organization.
Non-attorneys who work for nonprofit organizations should email attendance@nclc.org with the
name of their employer and a brief description of what they do prior to registering

Step Two: If so, please send an email to attendance@nclc.org to request a late
                                 registration.

Note: After emailing the address above, our team will review your request, ask you to register if you
are eligible to attend, and then add you to the virtual platform system. You will then receive a link
and log-in information for our virtual conference platform. The process of registration and
integration into the virtual conference platform may take up to 48 hours depending on the volume of
late requests we receive.
