Special Malt Beverage Permits
LMC 5.08—W.S.12-4-501

      Local licensing authority can:
          Set fees
          Licensing term
          Where Malt Beverages can be sold and consumed.
      Staff recommendation:
          Eased the restrictions by removing:
               “and which are either (1) an enclosed building containing meeting rooms,
                kitchen facilities and an auditorium which seats a least 800 persons, or (2) a
                stadium or outdoor arena.”
          Shall be issued for a period up to one year, with the fee prorated
           accordingly.

      New section added in LMC in accordance with State Statute
      Who can deliver:
           Retail, Microbrewery, Winery, Winery Satellite, and Manufacturer licenses
      All sales must occur at the licensed building
           Through an app or over the phone
           Must be 21 years of age
           Delivered to the individual who placed the order
           No exchange of money at the door
      Contracts allowable with Uber Eats, Door Dash, etc. for delivery services
           Staff recommendation: Requiring the 90 days for alcohol server training
            (mirrors LMC 5.09.060.G.)

LMC 5.09.400--W.S. 12-4-201

   A retail liquor license is the authority under which a licensee is
    permitted to sell alcoholic liquor or malt beverages for use or
    consumption but not for resale, except as otherwise provided in W.S.
    12-4-201.
Restaurant Changes

   Removed the “Room” requirement and made it an “Area”
       Won’t require construction of a room/enclosure
       Consumption in not allowed in the dispensing area
   Removed Requirements:
       Allows for fast food restaurants to apply
       Consumption would be for on premises only
   Staff recommendation: Change wording from “twenty-one (21)” to
    “eighteen (18)”, to enter the dispensing area as an employee (LMC
    5.09.455 (A)
   Shall not promote or operate as a bar/lounge
Microbrewery and Winery

The Liquor division separated the two out in State
Statute

     Both are different as far as the law goes

          The biggest change was the removal of the
          population formulas.

      To qualify for a resort retail liquor license, the appropriate licensing
       authority shall require the resort complex to:
           Include a restaurant and a convention facility
           Include motel, hotel or privately owned condominium, town house or
            home accommodations approved for short term occupancy with a
            minimum of one hundred (100) sleeping rooms
           Be a ski resort facility open to the general public
           Twenty-Four (24) hour alcohol catering permits- pursuant to LMC
            5.09.605.
Malt Beverage and Catering Permits
