Virginia College Savings PlanSM (Virginia529SM), an independent state agency with principal office
located at 9001 Arboretum Parkway, North Chesterfield, VA 23236, RICHMOND RACEWAY, INC. d/b/a
Richmond Raceway (RR), a Delaware corporation, having its principal place of business at 600 East
Laburnum Avenue, Richmond, Virginia 23222, Papa John’s Pizza/PJ Cheese, Inc. (PJ), having its
principal place of business at 2104 W. Laburnum Ave, Suite 104, Richmond, VA 23227, and WRIC TV8
(WRIC) having its principal place of business at 301 Arboretum Pl, North Chesterfield, VA 23236
(collectively, the Sponsors) are sponsoring a contest awarding five (5) students contributions of
$2,000 to new or existing Invest529SM accounts with a family 4-pack of tickets to the spring NASCAR
race at RR, five (5) school awards of $1,000 and a Papa John’s pizza pack and one (1) teacher award of
a VISA gift card in the amount of $500 (Contest). Virginia529 is an Internal Revenue Code Section 529
qualified tuition program. A Section 529 college savings account is an individual savings account
intended specifically for the payment of qualified higher education expenses for a designated
beneficiary. Customers are encouraged to obtain all enrollment materials, including the Program
Descriptions, by calling 1-888-567-0540 or by downloading them from Virginia529.com and to read
them carefully before investing. For residents of states other than Virginia: before investing, you
should consider whether your or the beneficiary’s home state offers any state tax or other state
benefits such as financial aid, scholarship funds, and protections from creditors that are only available
for investments in that state’s qualified tuition program.

Prizes:

    1. Five (5) winners will each be awarded a student prize of one (1) contribution of $2,000 to a
       new or existing Invest529 account and a family pack of tickets to the spring NASCAR race at RR
       with four (4) tickets and four (4) pit passes (Student Prize). The value of the Student Prize is
       $2,480.
    2. Each of the five (5) Student Prize winner’s elementary school or school’s PTA will win one (1)
       $1,000 award towards 5th grade graduation ceremonies and a Papa John’s pizza pack (School
       Prize). The value of the School Prize is $1,140.
    3. One (1) winning teacher from a Contest participant’s elementary school will be awarded a
       VISA gift card in the amount of $500 (Teacher Prize). The value of the Teacher Prize is $500.

Contest Terms & Conditions

By entering and participating in the Contest, each entrant fully and unconditionally agrees to and
accepts the following Contest Terms & Conditions which are final and binding in all matters related to
the Contest:

Eligibility:

    1. Must be a U.S. citizen or legal U.S. resident and a Virginia public school student in fifth grade
       enrolled in a public school in the greater Richmond area or a Charlottesville public school at
       time of entry to enter.
2. Employees of Virginia529, PJ’s, RR, WRIC, as well as each of their agents, successors and
      assignees, and individuals engaged in the development, production or distribution of Contest
      materials, their advertising and promotion agencies and any and all other persons associated
      with the Contest and each of their immediate family members (spouse; parents, siblings,
      children, grandchildren and their spouses; and in-laws) and members of the same household
      (whether or not related) are not eligible to participate in the Contest or be named the
      beneficiary or the winner of the Student Prize, School Prize or Teacher Prize.
   3. Must write an essay answering the question “How will you better your community by
      attending a college, university or training program?” and submit the essay through the official
      Contest online form, located at www.virginia529.com/betterfuturefund.
   4. Must be a teacher at one of the public schools listed above in paragraph 1 during the term of
      the Contest and have at least five (5) students submit essays as described in paragraph 2 to be
      eligible to win the Teacher Prize. One (1) randomly selected eligible teacher will win the
      Teacher Prize and odds of winning the Teacher Prize depend on the number of eligible
      teachers.

Timing:

   1. The Contest begins September 18, 2018 at 10:00 AM ET and ends on March 1, 2019 at 11:59
      PM ET. Contest entries will only be accepted between these dates and times and will only be
      accepted through the Contest entry portal found at www.virginia529.com/betterfuturefund.
      Contest entries will only be accepted if they are submitted by using the online entry portal.
      Virginia529’s computer is the official timekeeper for the Contest.
   2. Judging will begin on or about March 18, 2019 and determination of winners will be complete
      on or about April 3, 2019, including selection of the winner of the Teacher Prize. PJ’s will use
      its best efforts to notify the winners’ Virginia public school by phone on or about April 8, 2019.
      Contest Winners’ Virginia public school will contact the parents or guardians of the Contest
      Winners and the winner of the Teacher Prize.
   3. Should the winner(s) not be able to be reached, PJ shall, in its sole discretion, choose another
      winner.

Contest Entry Requirements:

   1. Contest entrant must write an essay answering the question “How will you better your
      community by attending a college, university or training program?” Contest submission must
      be limited to 400 words or less, nonfiction and in English and must be the original,
      nonpublished work of the entrant. One entry per person.
   2. Contest entries will only be accepted if they are submitted by the entrant’s parent or guardian
      by using the online entry portal. Contest entrant’s parent or guardian is required to complete
      all information required on the official Contest entry form to enter the Contest.

Judging Criteria:

Entries will be judged by judges from the WRIC staff based on the following criteria:
Adherence to contest theme (50 percent)
Adherence to contest question (50 percent)
Winners shall be chosen by WRIC’s judging panel in its sole discretion and its decisions are final.
Requirements of Winner:

   1. Winners agree to comply with all participation requirements promulgated by Virginia529, RR,
      WRIC and PJ’s, including Virginia529 account requirements, and to complete and execute all
      necessary documents including, but not limited to, waivers and releases. The execution of
      additional releases and/or waivers of liability required by Richmond Raceway, Inc. and/or any
      other applicable sanctioning body or prize provider may also be required and returned within
      the time period specified by such entities, as appropriate. If necessary, winners’ parents or
      guardians agree to complete and execute necessary documents to open accounts with
      Virginia529 and to provide additional documents as required by Virginia529. If applicable, the
      Invest529 account application must be received by Virginia529 within 90 days from date of
      the Student Prize notification or the Student Prize is forfeited.
   2. Winners are the beneficiaries of the Student Prize and must designate a parent or guardian to
      be the account owner of the Student Prize and the parent or guardian will be solely
      responsible for any applicable local, state and federal taxes on the Student Prize. Winners of
      the Student Prize understand that Virginia529 may be required to report the Student Prize
      amount via a 1099-MISC and it is their responsibility to consult a tax adviser concerning the
      tax implications of accepting the Student Prize.
   3. Winners of the School Prize are solely responsible for any applicable local, state and federal
      taxes on the School Prize. Winners of the School Prize understand that Virginia529 may be
      required to report the School Prize amount via a 1099-MISC and it is his or her responsibility
      to consult a tax adviser concerning the tax implications of accepting this School Prize.
   4. The winner of the Teacher Prize is solely responsible for any applicable local, state and federal
      taxes on the Teacher Prize. Winner of the Teacher Prize understands that Virginia529 may be
      required to report the Teacher Prize amount via a 1099-MISC and it is his or her responsibility
      to consult a tax adviser concerning the tax implications of accepting this Teacher Prize.
   5. Each winner or each winner’s parent or guardian agrees to the Sponsors’ use of his or her
      name, photograph, likeness, essay (or any portion thereof), statements, testimonials, text
      and/or sound or video recording of him or her for advertising, promotional, or any other
      purposes in any medium throughout the world in perpetuity without additional compensation
      or consent unless required by law. Each winner or each winner’s parent or guardian agrees to
      execute a publicity release. Each winner’s parent or guardian also agrees to the use of the
      beneficiary’s name for the Sponsors’ marketing and public relations purposes without
      compensation. Beneficiary will execute a publicity release if over 18 years old.
   6. Neither the Student Prize, the School Prize nor the Teacher Prize may be redeemed for cash
      and no exchanges or substitutions are permitted.

Other Terms:

   1. In no event will Virginia529, RR, WRIC, or PJ’s be responsible or liable for any damages or
      losses of any kind for lost, late, misdirected, incomplete, or invalid entries. Virginia529 is not
      responsible for printing or typographical errors in any Contest-related materials nor is it
      responsible for the inability of a person to enter their essay online in the manner described for
      whatever the reason.
   2. Submitted entries become the property of Sponsors. Sponsors shall also own the copyright to
      each submitted entry.
   3. Entrants agree to the use of their essays (or any portion thereof), their names, photographs,
      likenesses, statements, testimonials, text and/or sound or video recording of them for
Sponsor’s advertising, publication, promotional, or other purposes in any medium throughout
     the world in perpetuity regardless of whether they are selected as a winner and without
     further consideration or consent unless required by law.
4.   Virginia529 will be collecting personal data about entrants in accordance with its Privacy
     Policy. Virginia529’s Privacy Policy is available at Virginia529.com and entrant is responsible
     for reviewing a copy of the Privacy Policy. By participating in the Contest and providing their
     email address and other personal information, entrants hereby agree to Virginia529’s
     collection and use of their personal information and acknowledge that they have read and
     accepted Virginia529’s Privacy Policy.
5.   If, in Virginia529’s, RR’s, WRIC’s or PJ’s discretion, winner is found to be ineligible or not in
     compliance with these Contest Terms & Conditions or Contest eligibility, winner will be
     disqualified and an alternate winner will be selected by RR in its sole discretion. Interpretation
     of and determinations on the correct application of these Contest Terms & Conditions shall be
     made by the Sponsors in their sole discretion and their decisions regarding these matters shall
     be final. In no event will the Sponsors be responsible or liable for any damages or losses of any
     kind should winner be found ineligible.
6.   By participating in the Contest, each entrant agrees to indemnify, hold harmless, and waive
     any claims against the Sponsors, and any of their affiliates, employees, directors, officers,
     agents, representatives, and assigns of the Sponsors, made by winners, entrants, or any other
     third parties arising directly or indirectly out of, or in any way connected with, this Contest or
     the Student Prize, School Prize or Teacher Prize awarded in connection therewith.
7.   By participating in the Contest, each entrant agrees that the contest shall be governed by, and
     construed in accordance with, the laws of the Commonwealth of Virginia without regard to
     any choice of law or conflict of law rules. Entrant agrees that venue for any litigation arising
     out of or related to this Contest or these Contest Terms & Conditions shall be in state court
     located in Chesterfield, Virginia and hereby consents to jurisdiction of same.
8.   This Contest is subject to all applicable federal, state and local laws. Void where prohibited.
9.   The Sponsors reserve the right to modify, extend, suspend, or terminate the Contest if it
     determines, in its sole discretion, that the Contest is technically impaired or corrupted or that
     fraud or technical problems, failures or malfunctions or other causes beyond the Sponsor’s
     control have destroyed or severely undermined or to any degree impaired the integrity,
     administration, security, proper play and/or feasibility of the Contest as contemplated herein.
     In the event an insufficient number of eligible entries are received and/or the Sponsors are
     prevented from awarding prizes or continuing with the Contest as contemplated herein by
     any event beyond its control, including but not limited to fire, flood, natural or man-made
     epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God
     or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or
     activity, war (declared or undeclared) or any federal state or local government law, order, or
     regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause
     not reasonably within Virginia529’s control (each a “Force Majeure” event or occurrence),
     then the Sponsors shall have the right to modify, suspend, or terminate the Contest. If the
     Contest is terminated before the designated end date, the Sponsors will (if possible) select the
     winner in a random drawing from all eligible, non-suspect entries received as of the date of
     the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole
     and exclusive remedy under such circumstances. Only the type and quantity of prizes
     described in these Contest Terms and Conditions will be awarded. These Contest Terms and
     Conditions cannot be modified or amended in any way except in a written document issued in
     accordance with law by a duly authorized representative of Virginia529. The invalidity or
     unenforceability of any provision of these Contest Terms and Conditions shall not affect the
validity or enforceability of any other provision. In the event that any provision is determined
    to be invalid or otherwise unenforceable or illegal, these Contest Terms and Conditions shall
    otherwise remain in effect and shall be construed in accordance with their terms as if the
    invalid or illegal provision were not contained herein. The Sponsors make no warranties, and
    hereby disclaims any and all warranties, express or implied, concerning any Student Prize, ,
    School Prize, or Teacher Prize furnished in connection with the Contest.
10. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS
    IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND VIRGINIA529, RR
    AND PJ’S HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE
    IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR
    NON-INFRINGEMENT.
11. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF
    THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
    ATTEMPT BE MADE, VIRGINIA529, RR AND PJ’S WILL DISQUALIFY ANY SUCH INDIVIDUAL AND
    RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER
    REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Virginia529 will share entrants’ information with RR. Information submitted to RR by any
    entrant or Virginia529 is subject to RR’s privacy policy located at
    http://www.richmondraceway.com/Track-Info/Privacy-Policy.aspx.
13. For a copy of these Contest Terms & Conditions and/or the Winners’ names, send your
