1. EnviroFuel Gas Network Available on the Estate
                                                                                                       16/07/2018

Dear Homeowner,

Congratulations on your purchase at Waterfall Estate’s. Please note that the gas supplied through this network is
LP (Liquid Petroleum) gas and any appliances chosen by you must be manufactured or set for LP Gas.

The standard Waterfall connection fee is R 9,053.73 including VAT. The connection fee includes the pre-paid
meter and all components installed in the meter box. The Gas meter box is distributed by EnviroFuel at a cost of
R 1,838.85 including VAT. This is the only Gas meter box which is allowed to be used on the Estate. This meter
box MUST be installed on the boundary of your property where the gas pipe enters your stand.

The connection and installation between the Gas main line and the meter box will to be carried out by
Envirofuel’s nominated contractor Fueltec, who will quote and invoice the homeowner directly. Fueltec are the
only contractors authorised by EnviroFuel to carry out this installation.

EnviroFuel aims to sell the LP Gas supplied to you at a rate lower than the regulated MRP (Maximum Retail Price)
of bottled LP Gas for inland areas. This price will be adjusted upwards or downwards monthly in accordance with
the Department of Energy’s regulated MRP (Maximum Retail Price) for LP Gas.

EnviroFuel has implemented a Gas prepayment metering system where residents of Waterfall Estates are able to
purchase, manage and control their usage of Gas.

A Pre-Paid Smart Gas Meter that complies with international safety and quality standards will be installed in the
meter box situated on the boundary wall of each property. The Gas prepayment metering system consists of the
Pre-Paid Smart Gas Meter, a Smart Card and Prepayment Vending System. Gas can be purchased at vending
terminals through an online account registration. A detailed user manual will be issued once your EnviroFuel Pre-
Paid gas account has been opened. The vending terminals will be strategically situated at locations in Waterfall
Estate.

Once your EnviroFuel Pre-Paid gas account has been opened, the smart card can then be recharged with gas
credits (volume) by inserting the smart card at one of the vending terminals. After recharging the smart card, the
smart card must then be inserted into the gas meter and the gas credits (volume) purchased will then be
transferred to, and displayed on the meter. These smart cards are linked to your gas meter and EnviroFuel Pre-
Paid gas account, and will not work with any other gas meter. Residents will be able to monitor their usage by
checking the meter, where gas usage will be shown by decreasing volume (credits) displayed on the meter. The
gas meter recharge process is repeated when the resident wishes to make another purchase of gas. The Pre-Paid
Smart Gas Meter is designed to automatically disconnect the supply of gas once the remaining gas credits
(volume) have been depleted.

Additionally, the Pre-Paid Smart Gas Meter is equipped with many safety functions and alarms. The gas meter is
designed to close its internal meter valve should any of these alarms be triggered. These alarms will be indicated
on the LCD screen on the front of the gas meter.

2. Plan Approval Process for EnviroFuel Gas Connection.
Plan Approval Process: Step #1
Once the homeowner has submitted their Sketch Plans to Century Property Developments Aesthetics Committee
for approval, a meeting with EnviroFuel must be scheduled to discuss and review the use of Gas Appliance’s, Gas
and/or Solar Water and Underfloor Heating systems, in accordance with the Century Properties Architectural
Guidelines. This meeting must be attended by the home owner and architect. Copies of the sketch plans which
were submitted to the Aesthetics Committee for approval should be presented at this meeting. The sketch plans
should include the following:

     Site Plan showing the site building footprint and boundary walls.
     Building Floor Plan layouts.

Plan Approval Process: Step #2
After meeting with EnviroFuel, an Approved Gas Installer should be chosen from the list of Approved Installers
included in this pack, to design the Gas Installation and Gas Appliances in accordance with SANS 10087-1 and the
OWNERS GAS INSTALLATION REQUIREMENTS AND SPECIFICATION found in this pack.

This will be required for the drafting of detailed and working gas layout drawings. Generally, a gas installer would
need to be appointed before they will hand over their proposed design of their gas installation.

A stand screenshot indicating where the gas network pipe enters each stand and an electronic copy of the
EnviroFuel Typical Gas Layout Template can be obtained from EnviroFuel.

Plan Approval Process: Step #3
Detailed and working gas layout drawings will need to be drafted and submitted to EnviroFuel for approval. These
drawings must be drafted in accordance with and format as indicated on the EnviroFuel Typical Gas Layout
Template found in this pack.

These drawings must include the following information and details:

     Site Plan showing the site, building footprint, boundary walls and Building Floor Plans.
      The following information must be indicated on the gas layout drawings:
           All Notes as indicated on the Typical Gas Layout Template.
           Gas meter box placement on the boundary wall.
           Gas pipe from meter box to building.
           Details of temporary/back-up gas bottles.
           Details of gas piping to be used, location, distance and diameter of the piping.
           Positions of shut off valves and pressure regulators.
           Position and details of any of the following appliances:
                   o Gas cooking appliances including barbeques.
                   o Gas space heating (Fireplaces and wall mounted gas heaters).
                   o Gas and/or Solar domestic hot water systems.
                   o Gas and/or Solar underfloor heating systems. Gas back-up generator units.
                   o Ventilation for Gas Space Heating appliances must be as per the details given SANS
                      10087-1.

     Please also note the following when installing Gas Water Heaters (Gas Geysers):
           Gas water heaters installed internally must be fitted with a proper flue system leading to the
              outside of the building.
           Gas water heaters installed externally must be screened from view using a method acceptable to
              Century Property Development’s aesthetics committee
           No gas geysers may be installed in roof voids.

     These detailed and working gas layouts MUST BE STAMPED AND/OR SIGNED BY THE REGISTERED LPGAS
      INSTALLER RESPONSIBLE FOR THE DESIGN AND INSTALLATION OF THIS GAS LAYOUT .

Plan Approval Process: Step #4
Once detailed and working gas layouts have been drafted, two A1 paper copies of Site Plan and Building Floor
Plans must be submitted to EnviroFuel for Approval. One copy of the drawings will be stamped if approved. The
other copy will be filed in EnviroFuel’s records.

It is suggested that electronic copies of the proposed detailed and working gas layouts are sent through to
EnviroFuel for review before two A1 paper copies are printed.

Plan Approval Process: Step #5
The EnviroFuel approved detailed and working gas drawings must be submitted to the Aesthetics Committee,
together with the building working drawing as part of Stage 2 of Century Property Developments Aesthetics
Committee approval process.

4. Owners Gas Installation Requirements and Specifications.

1. The Gas meter box distributed by EnviroFuel, is the ONLY Gas meter box which is allowed to be used on the
   estate. This meter box MUST be installed on the inside of the street boundary wall, where the gas supply
   pipe enters the stand, even if the home owner elects not to connect to the gas network, as the gas
   reticulation pipe for the stand needs to be terminated and maintained in the meter box. The meter box
   must be positioned on the wall as shown on Annexure A.

2. The following safety distances around the gas meter box must be adhered to:
       Gas meter box to be kept clear from any obstructions and combustible materials at all times.
       No drains within 2m of the gas meter box.
       All safety distances must comply with SANS 10087-1.

3. The pre-paid gas meter will be supplied and installed together with the meter box components by
   EnviroFuel. The pre-paid gas meter, valves etc. will only be fitted just prior to the gas being connected to
   the property and once the required documentation and gas connection fee has been paid by the owner.

4. The meter box will be supplied with an isolation valve on the inlet side of the meter. This will allow our
   installer to shut the gas supply to the meter for maintenance purposes. The isolation valve will also serve as
   a shut-off valve to the property in the event of an emergency.

5. The gas pressure supplied on the outlet side of the pre-paid gas meter is 2.8 kPa, which is appliance
   operating gas pressure. The entire gas installation piping must therefore be specified and designed
   accordingly, taking into account the appliance operating gas pressure, requirements of the appliance and
   distance of the appliance from the meter box.

6. The gas piping from the meter box to the first isolation valve at entry to the building must NOT be less than
   32mm in diameter and must be laid underground and encased in a 90mm diameter sleeve ( Marley Hydro-
   wall uPVC Class 9 Pressure Pipe) up to the point where the pipe emerges from the ground to enter the
   isolation valve. LPgas Hazard Tape must be placed 300mm above this sleeve to indicate that the pipe is
   below. The top of the sleeve should be a minimum of 600mm below finished ground level. This is to ensure
   that gardening or other activities cannot lead to a puncture of the gas pipe.

7. A ¾” (three quarter inch) female fitting is required to be fitted on the end of the house supply pipe installed
   in the gas meter box. If any reducing fittings are used, they must be made of stainless steel. The
   measurement of this pipe from the bottom of the meter box to the end of the ¾” Female fitting (including
   any reducing fittings) must be 110mm, as shown on Annexure B.

8. Before entering the building there must be an isolation valve. (This can also be classified as an emergency
   shut-off valve).

9. Due to the supply gas pressure of 2.8 kPa being supplied from the pre-paid gas meter, it is of utmost
   importance that the sizes (Internal Diameter) of gas pipes to be installed have been calculated correctly, by
   taking into account the distance of pipe required and the appliance rating (amount of gas consumed by
   appliance).

          Gas installations utilizing a “manifold distribution system"
           Meaning the gas pipes are installed from a central distribution point with individual gas pipes
           supplying each gas appliance in the gas installation. The following recommended minimum sized
           internal diameter (ID) gas pipes should be installed, as indicated in Table 1 below:

           ***Recommended pipe sizes are also affected by distance and appliance rating and may need to be
           increased***

          Gas installations utilizing a “loop through piping system”
           Meaning the gas pipe is installed to a gas appliance and then supplies another appliance, or a
           number of gas appliances installed. To determine the size(s) of pipe required in a gas pipe system, it
           is necessary to estimate the amount of gas (expressed in terms of MJ/hr) that passes through each
           section of pipe when all the appliances are turned full-on. The size of pipe needed for each section
           of the pipe system is determined from the rating(s) of each appliance in the system and the length
           of pipe in each section. This type of piping system may require that the recommended minimum
           sized gas pipes indicated in Table 1, be increased to a bigger internal diameter (ID).

          When a pipework system is designed, provision should be made for additional appliances which
           might be installed at a later date and pipe sizes should, therefore, be large enough to cater for such
           future extensions.

10. An isolation valve must be installed before each appliance as per SANS 10087-1.

11. It is recommended that the piping installed in the building be Corrugated Stainless Steel Piping sheathed
    with polymer. If the owner and installer elect to use another type of pipe, this pipe must comply with the
    requirements of SANS 10087-1 and recommendations of LPGSASA.

12. The installation in the building must be done in accordance with SANS 10087-1. This standard covers all the
    aspects of a domestic LP Gas Installation.

13. All Emergency Services by-laws are to be adhered to at all times.

14. All appliances installed must comply with SANS 1539 and be approved by the LPGSASA. Appliances without
    a flame failure shut-off device may not be installed.

15. No flueless appliances are allowed to be installed in bedrooms and bathrooms. Where flueless appliances
    are installed in other areas, adequate ventilation MUST be provided for as stipulated in SANS 10087-1

16. Please note the following when installing Gas Geysers:
           Gas water heaters installed internally must be fitted with a proper flu system leading to the
            outside of the building.
           Gas water heaters installed externally must be screened from view using a method
            acceptable to century property development’s aesthetics committee
           No gas geysers may be installed in roof voids

17. Should a temporary gas bottle supply point be installed to the gas installation, a pressure reducing
    regulator must be installed at the temporary gas bottle supply point. This pressure reducing regulator must
    reduce the gas pressure from the temporary gas bottle(s) to 2.8 kPa appliance operating gas pressure.

18. No pressure regulators are required at appliances. If a temporary gas bottle supply point is provided, the
    2.8 kPa output pressure regulating equipment used must be approved and comply with SANS 1237.

19. As required by law, each home owner MUST be issued with a Certificate of Compliance on completion of
    their gas installation. This C.O.C is issued by the registered gas installer who carried out the gas installation
    from the boundary wall gas meter box, including all external and internal gas installation as well as the
    connection of SANS 1539 and LPGSASA approved LP gas appliances. A copy of this C.O.C must be issued to
    EnviroFuel.

20. The installation must be designed, installed, inspected and maintained in accordance with SANS 10087-1
    and the EnviroFuel - Owners Gas Installation Requirements and Specification.

21. EnviroFuel reserves the right to inspect the entire gas installation prior to approving a gas connection to the
    EnviroFuel gas network.

22. It is essential that the water supply to the house is balanced with a pressure regulating valve and that all
    water pipe sizes in the house comply with the water requirements to ensure correct flow of hot water to
    gas heated water appliances such as basins, showers and baths.

23. It is recommended that two or three 110mm sleeves are laid across the driveway so that should for
    whatever reasons a gas service or any other service need to be laid or re-routed, your driveway won’t need
    to be lifted.

24. It is also recommended that your building contractors are made aware of the main gas pipelines that have
    been installed along the pavements, before the ground is cut away for driveways between the road and
    boundary wall. This also applies to flower beds and trees that will be planted on pavements. These details
    can be obtained or pointed out on site by the company responsible for installing the gas reticulation.

25. In addition to the gas installation being in accordance with SANS 10087-1 and EnviroFuel’s Specifications,
    each home owner is to submit detailed and working gas drawings of their gas installation to EnviroFuel for
    final approval. No gas will be supplied to the home owner until approval from EnviroFuel is obtained.]

26. In the event of any alteration to the gas installation, updated plans must be submitted to EnviroFuel for
    approval. A copy of the new C.O.C must also be sent to EnviroFuel.

          Additional specifications enforced by the Johannesburg EMS Flammable Liquids Department

27. At least one 9kg DCP fire extinguisher must be supplied in the garage of each home, which must comply
    with SANS 810

28. The use of 48kg LPG cylinders on the Estate may only be used on a temporary basis, for the commissioning
    of LPG installations at the individual residential property, and for the supply of LPG to the individual
    residential property until connected to the LPG piped network.

   Once the individual residential property is connected to the LPG piped network, all 48kg cylinders, full or
   empty, MUST be removed from the residential property. The only LPG cylinders that may be stored/kept
   on a residential property are either two 9kg LPG cylinders OR one 19kg LPG cylinder

7. Standard Terms and Conditions for Gas Supply.

                                  Standard Terms and Conditions for Gas Supply Application
                                                    Effective June 2013
1. Agreement to Supply Gas and Start Date
1.1 Subject to the fulfilment of the conditions as set out in clause 1.2 (to our satisfaction), we agree to supply you, and you agree to buy from
    us, your requirement of pipe distributed LP (“Liquid Petroleum”) gas (“LP gas”) at the inlet flange of the meter applicable to your supply
    (the “Supply Point”) with effect from the starting date (the “Starting Date”) until this contract (this “Contract”) constituted by the terms
    and conditions herein contained, your application, including any other terms and conditions which we may expressly agree with you in
    writing, is terminated or the gas supply is disconnected, cut-off, prohibited or restricted pursuant to the terms and conditions herein
    contained.
1.2 The supply of gas is conditional upon:
    1.2.1   A completed and signed application form;
    1.2.2   The Supply Point being connected to our gas supply system;
    1.2.3   Payment of any initial charges and connection fees which we may specify as being payable by you;
    1.2.4   Payment of the amount of any deposit that we may request (in accordance with clause 3 below); and
    1.2.5   Acknowledgement of the “Owners/Lessees Gas Installation and Specification” published by EnviroFuel.
1.3 At the time or when we notify you of an anticipated Starting Date, you must be in possession of an approved certificate of compliance in
    respect of the pipeline work from the meter to your residential dwelling and the installed LP gas appliances. If you fail to do so, we may
    refuse to supply or discontinue supplying you with gas.
1.4 These terms and conditions are subject to and are without prejudice to the Standard Terms and Conditions of Trade of EnviroFuel.
2. Payment
2.1 You agree to pay for the gas supplied in terms of the Pre-paid smart card system which will have vending points at various locations in
    the residential Estate. A separate user manual detailing the use and application of the Smart Card system is available on request.
2.2 The selling price of the gas will be adjusted upwards or downwards on a monthly basis taking into account the Department Of Energy’s
    published MRGP (Maximum Refinery Gate Price for LP Gas), Sasol’s surcharge, delivery costs, any other reticulation and maintenance
    costs (excluding Value-Added Tax).
2.3 We may at our discretion (to the extent permitted by law), vary any of our charges for the supply of gas and ancillary services and/or any
    other terms and conditions at any time without your prior written consent, however you will receive written notice regarding the
    variation no later than 10 days after the variation comes into effect.
3. Gas Consumed
3.1 The quantity of gas which you have paid will automatically be loaded onto your meter when the pre-paid and loaded smart card is
    inserted into the said meter. The owner’s / lessee’s Smart Card can only be used in the meter installed at the owner’s / lessee’s property.
    The meter will show the amount of gas credit (volume) loaded and thereafter consumed.
3.2 You are not entitled to resell any gas supplied to you in terms of this Contract.

4. Other Termination Rights
4.1 Your Right to Terminate
    You may terminate this Contract at any time by giving us at least 7 days’ prior written notice which will be effective from the time the
    Supply Point is disconnected or the supply of gas is terminated.

4.2 Our Rights to Terminate
    We may terminate this Contract and/or discontinue supply:-
    4.2.1   at any time by giving you at least 7 days’ prior written notice; or
    4.2.2   with immediate effect by giving you written notice where you have:-
            4.2.2.1     not paid any charges due to us within 30 days of the date of our invoice or other notice requesting payment; or
            4.2.2.2     failed to comply with any term or condition contained in this Contract (whether material or otherwise), which we
                        have required you by written notice to remedy within a reasonable period, and you have failed to do so, which failure
                        has resulted or will result in our contractual position being prejudiced; or
            4.2.2.3     provided incorrect information in your application for gas supply; or
            4.2.2.4     not consumed any gas for a continuous period of 6 months or more and we reasonably believe that you no longer
                        require a gas supply.

5. Automatic Termination
      This Contract will automatically terminate without liability to us:-
5.1          on the date a new contract for the supply of gas to the Supply Point is concluded with a third party; or
5.2          on the date our license to supply gas is revoked or suspended (should same ever occur), but in such circumstances this Contract
      will automatically be reinstated on any re-granting or upliftment of the suspension, as contemplated herein.
6. Consequences of Termination
6.1 Upon the termination of this Contract, you will remain liable to pay for all gas consumed at the Supply Point until date of termination
    and in addition thereto, you will remain liable for the consequences of any other breach prior thereto. Insofar as it may be relevant, we
    will remain liable in respect of any breach of this Contract by us prior to the said termination.
6.2 If you terminate this Contract for any reason whatsoever during the first 12 months calculated from the Starting Date (or such alternative
    date as may be agreed upon in writing), you will remain liable for all our expenses and costs incurred in the installation of the gas supply
    to the Supply Point.
6.3 If you cease to occupy the property served by the Supply Point and fail to terminate this Contract in accordance with the provisions of
    clause 4, you will be liable to pay for any gas consumed at the Supply Point and associated service charges until the first occurring of:-
      6.3.1    the 7th day after we receive written notice that you have ceased to own/lease or occupy the property in question; and
      6.3.2    the time from which we supply gas to the Supply Point in pursuance of a written request by a third party.
6.4 On the termination of this Contract, we will be entitled to remove from the Supply Point any property which belongs to us including any
    property present or associated with the said Supply Point.

7. Meters and Pipes
7.1 You are required to properly maintain and repair, when and where necessary, all gas pipes and other apparatus on your side of the Supply
    Point by employing third parties with appropriate experience to carry out the required maintenance or remedial work.
7.2 You are not allowed in any way whatsoever to tamper with, misuse or damage the meter and/or the Supply Point. If you do so, you will
    be responsible for the costs incurred in repairing and/or replacing the said meter and/or Supply Point (including all apparatus associated
    therewith).
7.3 You are required to immediately report to us any defects and/or damage to our gas installation.
7.4 Furthermore, and if you are not the owner/lessor of the property served by the Supply Point, you shall notify the owner/lessor in writing
    of our right, title and interest to our meters, gas pipes and other apparatus. We shall in any event and at all times be entitled (but not
    obliged) to unilaterally and without your consent notify the owner/lessor of the property of our de facto and de jure ownership.
8. Safety and use of gas – (Important Notice)
              You are required to immediately notify any escape or
              expected escape of gas to the emergency service whose
              telephone number is shown on your meter box and
              other documentation supplied to you.
You are required at all relevant times to use the gas in a responsible and safe manner, and you are prevented from in any way whatsoever
interfering with the supply of gas to any other party or occupant within the development.

9. Disconnecting your Gas Supply
      It is moreover agreed that your supply of gas may be disconnected where permitted in accordance with the provisions of this Contract
      or as may be required by law. In addition thereto, we will be entitled to interrupt the gas supply for the purposes of repairs and
      maintenance to the gas reticulation network. We however will endeavour to provide reasonable notice of such disruptions.

10. Access to the Property
We (including any duly authorised person, officers, agents and the like) will have unrestricted access to the Supply Point and the property,
where permitted or required in accordance with the provisions of this Contract or by law, to enable us to execute the provisions of this
Contract in accordance with its terms and conditions. By way of example, you will allow access to the Supply Point and the property at all
reasonable times for the purposes of reading, inspecting, installing, repairing, replacing or carrying out any other service in relation to the
meter, Supply Point and/or any other apparatus associated therewith, which may be executed at any time.

11. Limitation of Liability
11.1      Matters beyond our control
         We will not be liable for any breach of this Contract, if we are unable to comply with any of our contractual obligations due to
         circumstances beyond our reasonable control, but if such circumstances arise, we will take all requisite steps, so far as it is reasonably
         possible to comply with such obligations.

11.2   Consequential loss
       Neither parties will in any circumstances whatsoever (even in the event of negligence) be liable to the other in respect of any breach
       of contract, claim in delict or breach of any statutory duty for:-
       11.2.1    any loss of profit, loss of revenue, anticipated savings, loss of use, loss of contract, loss of goodwill or other special damages;
                 or
       11.2.2    any indirect or consequential loss; or
       11.2.3    loss resulting from any liability to any other person and/or third party.

11.3   Other restrictions on liability
       Without detracting from the provisions of clauses 11.1 and 11.2 above, we will not be liable for any loss or damage arising from any
       breach of this Contract other than for loss of or damage to property directly resulting from such breach, provided that our liability
       for such loss or damage shall in any event be limited to R75 000,00 (“the Basic Limit”). The said Basic Limit shall be indexed annually
       in accordance with the South African Consumer Price Index (“CPI”) with a base date of 1 August 2011.
11.4   In any event, and without detracting in any way whatsoever from the provisions of clauses 11.1, 11.2 and 11.3 above, we shall not
       be liable for any loss or damage of any kind which you may suffer as a result of any negligence on our part, provided that we shall
       not be exempted from any wilful misconduct or gross negligence amounting to recklessness, in which event the provisions of clause
       11.3 will be applicable.
11.5   No Warranties relating to equipment
       We give no warranties, express or implied, as to the adequacy, safety or other characteristics of any equipment, pipes, appliances
       and/or devices used or to be used by you in connection with the supply and use of gas, which is governed by the terms and conditions
       herein contained.

12. Assignment
   We will be entitled to assign and cede any and all of our rights and contractual obligations under the Contract without your prior
   writtenconsent. It is however agreed that you will not be entitled to assign and/or transfer your rights and/or contractual obligations
   under this Contract without our prior written consent.

13. Notices
13.1   Any notices which you are required or wish to give under this Contract should be delivered or sent to our address as it moreover
       appears from clause 19 or to such other address as we may notify you in writing.
13.2   Any notices which we are required or wish to give you in terms of this Contract will be accepted by you as properly given, if delivered
       or sent to your address as stated in the application, or such other address as you may notify us in writing, which change of address
       shall only be effective 14 days after the receipt of such notice.

14. Previous Agreements
   This Contract supersedes and substitutes in its totality all previous agreements which may have been concluded between the parties.

15. Interpretation
15.1        The following terms shall have the meaning assigned to it below:-
       15.1.1 “this Contract” refers to the standard terms and conditions for gas supply (application effective June 2013) read in conjunction
              with the application for gas connection (residential);
       15.1.2 “owner” refers to the owner of the property or the lessee thereof (whichever is applicable);
       15.1.3 “the property” refers to the property owned or leased (whichever is applicable) by the applicant;
       15.1.4 “we”, “us”, “our” and “ourselves” refers to Envirofuel Proprietary Limited (Registration Number: 2011/002036/07), which
              shall deem to include its servants, agents, officers, representatives, assigns and successors in title; and
       15.1.5 “you”, “your”, “yourself” or “yourselves” refers to the person or persons who signs the application as applicant. If more than
               one person signs the said application, both parties will jointly and severally be liable to execute the contractual obligations
               contained in this Contract.
15.2   Words and expressions defined herein shall have the meanings ascribed to them whenever used in this Contract.
15.3   The headings have been included for ease of reference and shall not be taken into account in the interpretation of the clause contents.
15.4   If this Contract does not provide an interpretation guideline, then the meaning of a word shall be interpreted according to the latest
       addition of the Oxford Dictionary and Thesaurus and otherwise in terms of the Interpretation Act of South Africa, as amended from
       time to time.
15.5   None of the provisions contained herein shall be construed against or interpreted to the disadvantage of the party responsible for
       the drafting or preparation of this Contract.
15.6   Unless specifically provided to the contrary, all amounts which are payable In terms of this Contract are exclusive of Value-Added
       Tax.

16. Law
16.1   This Contract will be interpreted and operated in accordance with the laws of the Republic of South Africa.
16.2   You hereby consent to the jurisdiction of the magistrate’s court in respect of any action or proceedings which may be brought against
       you by us, notwithstanding the fact that the relieve sought would normally exceed such jurisdiction. However, it is moreover agreed
       that we shall in any event be entitled to bring proceedings in the High Court of South Africa where such proceeding would fall within
       the jurisdiction of the magistrate’s court.

17. Costs
    Should you fail to comply with the terms and conditions contained in this Contract, you will be liable for the payment of all costs on a
    scale as between attorney and client, including collection commission and tracing agents’ fees.

18. Credit Information
    You agree that we may, on receipt of your application, and during the currency of this Contract:
18.1   Verify all information supplied and as it moreover appears from the application;
18.2   Execute whatever enquiries and receive information from any third party, credit bureau or financial institution in order to establish
       your credit worthiness; and/or
18.3   Provide information on the conduct of your account to any credit bureau or credit provider in the event of a breach of this Contract.

20. Miscellaneous
20.1 This Contract constitutes the entire agreement between the parties in relation to the subject matter and any amendments, variations
       or additions thereto shall only be effective if in writing and signed by both parties.
20.2 No indulgence or extension of time which may be granted to you shall constitute a waiver of or, whether by estoppel or otherwise,
       limit any of our existing or future rights in terms hereof.
20.3 The parties shall at all times act in good faith with one another and with the intention to diligently execute the terms and conditions
       herein contained.

9. Frequently Asked Questions About Piped Gas Available on the Estate.

Question 1: What type of gas will be piped to homes at Waterfall Estates?
Answer: The gas will be Liquid Petroleum Gas (LPG), not natural gas. Appliances and systems should be chosen for
LP Gas. Most appliances can be modified from Natural Gas to LP Gas and vice versa.
LP Gas is a blend of propane and butane and some other minor components. The mixtures vary from time to time
but the mixture proportions have little effect on the performance of the gas.

Question 2: How will the gas be supplied to Homeowners
Answer: Tank farms have been installed throughout the estate and a gas pipe network has been installed and
reticulated providing a gas pipe connection to each home in the estate. The tank farms each have two 6400 litre
storage tanks. These tank farms are underground.
There are 18 tank farms on the estate so far and these 36 tanks plus the reticulation piping provide substantial
storage amounting to approximately 48kg of gas for each stand in the estate. 48kg of LP Gas represents about 2
to 4 weeks usage for the average home.

Question 3: What will the gas cost?
Answer: LP Gas is sold in Rand per kilogram, which is converted into m³ (cubic meters) at the vending terminal
and loaded onto your gas smart card. EnviroFuel aims to sell the LP Gas supplied at a rate lower than the
regulated MRP (Maximum Retail Price) of bottled LP Gas for inland areas. This price will be adjusted upwards or
downwards monthly in accordance with the Department of Energy’s regulated MRGP (Maximum Retail Price) for
LP Gas.

Question 4: Is there a Connection Fee?
Answer: There is a connection fee of R 9,053.73 including VAT. The connection fee includes the pre-paid meter
and all components installed in the meter box. The Gas meter box is distributed by EnviroFuel at a cost of
R 1 838.85 including VAT. This is the only Gas meter box which is allowed to be used on the Estate. This meter
box MUST be installed on the boundary of your property where the gas pipe enters your stand.

Question 5: What are the Environmental issues around the use of LP Gas
Answer: LP Gas is a clean burning fuel that is safe and provides economical energy supply. LP Gas is generally
manufactured by petrol and oil refinery companies. In the case of EnviroFuel the supplier of bulk LP Gas is Sasol
Homegas.
LP Gas is not supplied from the controversial ‘fracking’ process.
LP Gas has always been considered the fuel of choice for effective home heating, hot water and cooking. In
addition to the benefits gas provides inside your home the use of LP Gas can also contribute to significantly
reducing your carbon footprint.
Using LP Gas results in much lower CO2 emissions than other energy sources such as coal fired electricity.

For example by replacing your electric geyser with a continuous flow LP Gas hot water system can reduce the
green house gas emissions produced by your hot water use by up to 75%. Note also that the greenhouse gas
emissions are even lower than an electrically boosted solar system.

Question 6: What about Safety when using LP Gas
Answer: There are two key areas when considering safety which concern the installation and the homeowner.
The function of the installer is to connect and install the LP Gas supply from the meter box to the home and its
gas powered appliances and to ensure that the entire system is working properly in a safe environment with

                      All safety systems and controls are functioning correctly
                      The homeowner has been shown and taught the normal operation of the system and
                       appliances including maintenance and safety procedures including actions to be taken in
                       the case of emergencies

           The Homeowners should ensure that:
                  They are familiar with the safe operation of all installed appliances
                  Knows where the shut off valves are located
                  They protects the system from damage or interference
                  There is adequate ventilation as required by current LP Gas safety standards

Question 7: What about the efficiency of gas compared to Electrical powered appliances
Answer: The World LP Gas Association carried out a study entitled ‘LP Gas: Efficient Energy for A Modern World’
which quantified the primary energy efficiency of LP Gas compared with other energy sources in four selected
applications and in six regions of the world. This study showed that LP Gas is among the most energy efficient
options in many applications and regions around the world.

Question 8: What about the integrity and continuity of supply of LP Gas
Answer: As already mentioned EnviroFuel has installed 18 tank farms on the Estate, which together with the
reticulation system provide storage of at least 48kg of LP Gas for each property on the Estate.
This in conjunction with the supply contract with Sasol should ensure continuity and integrity of supply.

Question 9: How will I purchase my LP Gas
Answer: Gas will be sold through a vending system which charges your gas smart card with the amount of gas
credits (volume) purchased. Once the card is inserted in your meter the volume of gas credits (volume) purchased
will be allowed to flow through the meter to the gas appliances being used. Vending stations will be located at
strategic points in the Estate and the gas will be paid for using a nominated credit card.
