                                        ORDINANCE# 9-0-2021

 AN ORDINANCE BY THE BOROUGH OF WANAQUE IN PASSAIC COUNTY, NEW JERSEY PROHIBITING
     THE OPERATION OF ALL CLASSES OF CANNABIS BUSINESSES WITHIN ITS GEOGRAPHICAL
           BOUNDARIES AND AMENDING CHAPTER 114 OF THE CODE OF WANAQUE

WHEREAS, in 2020 New Jersey voters approved Public Question No. 1, which amended the New Jersey
Constitution to allow for the legalization of a controlled form of marijuana called “cannabis” for adults
at least 21 years of age; and

WHEREAS, on February 22, 2021, Governor Murphy signed into law P.L. 2021, c. 16, known as the
“New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act” (the
“Act”), which legalizes the recreational use of marijuana by adults 21 years of age or older, and
establishes a comprehensive regulatory and licensing scheme for commercial recreational (adult use)
cannabis operations, use and possession; and

WHEREAS, the Act establishes six marketplace classes of licensed businesses, including:

           •   Class 1 Cannabis Cultivator license, for facilities involved in growing and cultivating
               cannabis;

           •   Class 2 Cannabis Manufacturer license, for facilities involved in the manufacturing,
               preparation, and packaging of cannabis items;

           •   Class 3 Cannabis Wholesaler license, for facilities involved in obtaining and selling
               cannabis items for later resale by other licensees;

           •   Class 4 Cannabis Distributer license, for businesses involved in transporting cannabis
               plants in bulk from on licensed cultivator to another licensed cultivator, or cannabis
               items in bulk from any type of licensed cannabis business to another;

           •   Class 5 Cannabis Retailer license for locations at which cannabis items and related
               supplies are sold to consumers; and

           •   Class 6 Cannabis Delivery license, for businesses providing courier services for consumer
               purchases that are fulfilled by a licensed cannabis retailer in order to make deliveries of
               the purchases items to a consumer, and which service would include the ability of a
               consumer to make a purchase directly through the cannabis delivery service which
               would be presented by the delivery service for fulfillment by a retailer and then
               delivered to a consumer.

WHEREAS, section 31a of the Act authorizes municipalities by ordinance to adopt regulations
governing the number of cannabis establishments (defined in section 3 of the Act as “a cannabis
cultivator, a cannabis manufacturer, a cannabis wholesaler, or a cannabis retailer”), cannabis
distributors or cannabis delivery services allowed to operate within their boundaries, as well as the
location manner and times operation of such establishments, distributors or delivery services, and
establishing civil penalties for the violation of any such regulations; and

WHEREAS, section 31b of the Act authorizes municipalities by ordinance to prohibit the operation of
any one or more classes of cannabis establishments, distributors, or delivery services anywhere in the
municipality; and

WHEREAS, section 31b of the Act also stipulates, however, that any municipal regulation or prohibition
must be adopted within 180 days of the effective date of the Act (i.e., by August 22, 2021); and

WHEREAS, pursuant to section 31b of the Act, the failure to do so shall mean that for a period of five
years thereafter, the growing, cultivating, manufacturing, selling and reselling of cannabis and cannabis
items shall be permitted uses in all industrial zones, and the retail selling of cannabis items to
consumers shall be a conditional use in all commercial and retail zones; and

WHEREAS, at the conclusion of the initial and any subsequent five-year period following a failure to
enact local regulations or prohibitions, the municipality shall again have 180 days to adopt an
ordinance regulating or prohibiting cannabis businesses, but any such ordinance would be prospective
only and would not apply to any cannabis business already operating within the municipality; and

WHEREAS, the Borough Council of the Borough of Wanaque has determined that, due to present
uncertainties regarding the potential future impacts that allowing certain classes of cannabis business
might have on New Jersey municipalities in general, and on the Borough of Wanaque in particular, it is
at this time necessary and appropriate, and in the best interest of the health, safety and welfare of the
Borough of Wanaque’s residents and members of the public who visit, travel, or conduct business in
the Borough of Wanaque, to amend the Borough of Wanaque’s zoning regulations to prohibit certain
classes of cannabis business within the geographic boundaries of the Borough of Wanaque; and

WHEREAS, due to the complexity and novelty of the Act; the many areas of municipal law that are or
may be implicated in decisions as to whether or to what extent cannabis or medical cannabis should be
permitted for land use purposes or otherwise regulated in any particular municipality; and the
relatively short duration in which the Act would allow such decisions to be made before imposing an
automatic authorization of such uses in specified zoning districts subject to unspecified conditions, the
most prudent course of action for the Borough of Wanaque, would be to prohibit certain classes of
cannabis business within the Act’s 180-day period in order to ensure sufficient time to carefully review
all aspects of the Act and its impacts;

NOW THEREFORE, BE IT ORDAINED, by the Mayor and Borough Council of the Borough of Wanaque, in
the County of Passaic, State of New Jersey, as follows:

   1. Pursuant to section 31b of the New Jersey Cannabis Regulatory, Enforcement Assistance, and
         Marketplace Modernization Act (P.L. 2021, c. 16), the following cannabis class license
         businesses are hereby prohibited from operating anywhere in Borough of Wanaque:

       •      Class 1 Cannabis Cultivator License, for facilities involved in growing and cultivating
              cannabis; Indoor farming

       •      Class 2 Cannabis Manufacturer License, for facilities involved in the manufacturing,
              preparation, and packaging of cannabis items;

       •      Class 3 Cannabis Wholesaler License, for facilities involved in obtaining and selling
              cannabis items for later resale by other licensees;

       •      Class 4 Cannabis Distributor License, for businesses involved in transporting cannabis
              plants in bulk from on licensed cultivator to another licensed cultivator, or cannabis
              items in bulk from any type of licensed cannabis business to another;

       •      Class 5 Cannabis Retailer license for locations at which cannabis items and related
              supplies are sold to consumers; and;

       •      Class 6 Cannabis Delivery license, for businesses providing courier services for consumer
              purchases that are fulfilled by a licensed cannabis retailer in order to make deliveries of
              the purchases items to a consumer, and which service would include the ability of a
              consumer to make a purchase directly through the cannabis delivery service which would
              be presented by the delivery service for fulfillment by a retailer and then delivered to a
              consumer.

2.      Chapter 114 of the Code of Wanaque is hereby amended by adding to the list of prohibited
uses, the above classes of cannabis businesses.

3.     Any article, section, paragraph, subsection, clause, or other provision of the Code of Wanaque
inconsistent with the provisions of this ordinance is hereby repealed to the extent of such
inconsistency.

4.     If any section, paragraph, subsection, clause, or provision of this ordinance shall be adjudged by
a court of competent jurisdiction to be invalid, such adjudication shall apply only to the section,
paragraph, subsection, clause, or provision so adjudged, and the remainder of this ordinance shall be
deemed valid and effective.

5.    This ordinance shall take effect upon its passage and publication and filing with the Passaic
County Planning Board, and as otherwise provided for by law.

ORDINANCE OF THE BOROUGH OF WANAQUE, COUNTY OF PASSAIC, NEW JERSEY, AMENDING § 114-
3 OF THE CODE OF THE BOROUGH OF WANAQUE SO AS TO BETTER DEFINE THE TERM “DECK” AND
THEIR USE AND APPLICABILITY, INCLUDING AT ANY PROPERTY THAT IS A “NON-CONFORMING USE”
IN THE BUSINESS ZONE AS DEFINED IN THE BOROUGH CODE AT § 114-3.

WHEREAS, the Municipal Code of the Borough of Wanaque establishes the use and enjoyment of properties
within its boundaries, as established in Section 114-1 et seq of the Code entitled “Zoning”; and

WHEREAS, the Municipal Code at § 114-3 defines various terms to be utilized and interpreted when determining
compliance with the Borough’s Zoning Code, including the following:

“Deck”: An accessory structure consisting of a flat-floored roofless area adjoining a principal structure.
        [Added 12-17-1991 by Ord. No. 26-0-91]

“Non-Conforming Use”: Any use lawful immediately prior to the enactment of this chapter which does not
conform to the provisions hereof”; and

WHEREAS, the Borough Zoning Code establishes a B Zoning District (Business Zone) § 114-12 which establishes
permitted primary uses within the B Zoning District, including but not limited to 1- “Retail sales, service and
eating establishments customarily found in and associated with contemporary centers of shopping and general
business…”, and 2- “Apartments over stores….” (although ground floor apartments are permitted though
limited); and

WHEREAS, the Borough Council has been requested to clarify whether Decks are a permitted accessory use in
the B zone, as the term Deck is defined above and as included in § 114-8 B (4), which is the applicable zoning
authority referenced at § 114-12 A 7 (c) pertaining to the residential use permitted in the B zoning district.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Wanaque as follows:

Section 1.      The foregoing recitals (Whereas paragraphs) are incorporated herein as if set forth in full.

Section 2.      § 114-12 B (1) of the Borough Code stipulating “Permitted accessory uses” in the Business Zone
                shall include Decks as hereinbefore defined so that § 114-12 B (1) is modified to read in full as
                follows:

                    “Permitted accessory uses” shall be as follows:

                    (1) Uses and activities which are customarily associated with and necessary to the operation
                    and maintenance of the uses which are permitted above, including i. one Deck (and for clarity-
                    one patio area) per principal structure having no greater than 450 square feet of area and
                    provided said accessory use(s) comply with all yard setback standards, ii. one shed per structure
                    consistent with § 114-8 B (2), and iii. above ground pools not inconsistent with § 114-8 B (4).”
                    (Notes: 1-the italics represents the modified portion of the Borough Code, 2-§ 114-8 of the
                    Borough Code is the stated authority at § 114-12 B (7) (c) of the Borough Code pertaining to
                    residences in the B Zoning District.)

Section 3.          Applicability. This Ordinance shall be applicable to any Non-Conforming Use or structure
                    situated in the B zone, as defined in Whereas #2 above. Because this Ordinance is intended to
                    clarify a pre-existing condition, it is therefore consistent with N.J.A.C. 19:4-6.1 (b) and any
                    related regulation pertaining to Non-Conforming Uses. If any part of this Ordinance shall be
                    deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the
                    remaining parts of this Ordinance.

Section 4.          This Ordinance shall be in full force and effect from and after its adoption and any publication as
                    may be required by law.

CAPITAL ORDINANCE OF THE BOROUGH OF WANAQUE, COUNTY OF PASSAIC, STATE OF NJ
AUTHORIZING EMERGENCY ROOF REPLACEMENT IN, BY AND FOR THE BOROUGH OF WANAQUE,
APPROPRIATING THEREFOR THE SUM OF $88,320.00 FROM THE CAPITAL IMPROVEMENT FUND

BE IT ORDAINED by the Council of the Borough of Wanaque, County of Passaic, State of New Jersey, (not less
than 2/3 of all members thereof affirmatively concurring) as follows:

SECTION 1
The improvements described in section 3 of this ordinance are hereby authorized as improvements to be made
by the Borough of Wanaque in the County of Passaic. For said improvements or purposes stated in section 3,
there is hereby appropriated the sum of $88,320.00

SECTION 2
For financing of said improvements and to meet the costs and expenses in connection therewith, there is hereby
appropriated the sum of $88,320 from the following source by virtue of its availability for these purposes from
funds provided in a budget or budgets of the Borough of Wanaque heretofore adopted:

                                      Capital Improvement Fund $88,320

SECTION 3
The improvements hereby authorized for which the aforesaid sum is appropriated are as follows:
Roof replacement at the Passaic County Social Services building (1237 Ringwood Avenue) including all labor,
material costs and appurtenances necessary and suitable thereto $88,320.

SECTION 4
Said improvements are lawful capital improvements of the Borough having a period of usefulness of at least five
years. Said improvements shall be made as general improvements, no part of the cost of which shall be assessed
against property specially benefited.

SECTION 5
The capital budget is hereby amended to conform with the provisions of this capital ordinance to the extent of
any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of
the amended capital budget and capital program as approved by the Director, Division of Local Government
Services, is on file with the Borough Clerk and is available for public inspection.

SECTION 6
This capital ordinance shall take effect at the time and in the manner provided by law.

NEW JERSEY, APPROPRIATING $440,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $418,000
BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION

BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF WANAQUE, IN THE COUNTY OF PASSAIC,

NEW JERSEY (not less than two-thirds of all the members thereof affirmatively concurring), AS FOLLOWS:

                The improvement described in Section 3 of this bond ordinance is hereby authorized as a

general improvement to be made or acquired by The Borough of Wanaque, New Jersey.                   For the said

improvement or purpose stated in said Section 3, there is hereby appropriated the sum of $440,000, said sum

being inclusive of all appropriations heretofore made therefor and including the sum of $22,000 as the down

payment for said improvement or purpose required by law and now available therefor in the Reserve for Sewer

Improvements and including any monies received or expected to be received by the Borough from the American

Rescue Plan grant program as a grant-in-aid of financing said improvement or purpose.

                For the financing of said improvement or purpose and to meet the part of said $440,000

appropriation not provided for by application hereunder of said down payment, negotiable bonds of the

Borough are hereby authorized to be issued in the principal amount of $418,000 pursuant to the Local Bond Law

of New Jersey. In anticipation of the issuance of said bonds and to temporarily finance said improvement or

purpose, negotiable notes of the Borough in a principal amount not exceeding $418,000 are hereby authorized

to be issued pursuant to and within the limitations prescribed by said Local Bond Law.

                a) The improvement hereby authorized and purpose for the financing of which said obligations

are to be issued is the improvement of the sanitary sewer mains and sanitary sewer laterals in and by the

Borough including, but not limited to, the installation of new sanitary sewer mains and sanitary sewer laterals on

Jackson Street and Hannibal Place, together with all laterals, services, landscaping, structures, equipment, site

work, work and materials necessary therefor or incidental thereto, all as shown on and in accordance with the

plans and specifications therefor on file or to be filed in the office of the Borough Clerk and hereby approved.

                    The estimated maximum amount of bonds or notes to be issued for said purpose is $418,000.

                    The estimated cost of said purpose is $440,000, the excess thereof over the said estimated

maximum amount of bonds or notes to be issued therefor being the amount of the said $22,000 down payment

for said purpose.

                    The following additional matters are hereby determined, declared, recited and stated:

                    The said purpose described in Section 3 of this bond ordinance is not a current expense and is a

property or improvement which the Borough may lawfully acquire or make as a general improvement, and no

part of the cost thereof has been or shall be specially assessed on property specially benefitted thereby.

                    The period of usefulness of said purpose within the limitations of said Local Bond Law, according

to the reasonable life thereof computed from the date of the said bonds authorized by this bond ordinance, is

forty (40) years.

                    The supplemental debt statement required by said Local Bond Law has been duly made and filed

in the office of the Borough Clerk and a complete executed duplicate thereof has been filed in the office of the

Director of the Division of Local Government Services in the Department of Community Affairs of the State of

New Jersey, and such statement shows that the gross debt of the Borough as defined in said Local Bond Law is

increased by the authorization of the bonds and notes provided for in this bond ordinance by $418,000, and the

said obligations authorized by this bond ordinance will be within all debt limitations prescribed by said Local

Bond Law.

                An aggregate amount not exceeding $75,000 for interest on said obligations, costs of issuing

said obligations and other items of expense listed in and permitted under section 40A:2-20 of said Local Bond

Law may be included as part of the cost of said improvement and is included in the foregoing estimate thereof.

                The funds from time to time received by the Borough on account of the grant referred to in

Section 1 of this bond ordinance shall be used for financing the improvement or purpose described in Section 3

of this bond ordinance by application thereof either to direct payment of the costs of said improvement or

purpose, or to payment or reduction of the authorization of the obligations of the Borough authorized by this

bond ordinance. Any such funds so received may, and all such funds so received which are not required for

direct payment of such costs shall, be held and applied by the Borough as funds applicable only to the payment

of obligations of the Borough authorized by this bond ordinance.

                All bond anticipation notes issued hereunder shall mature at such times as may be determined

by the Chief Financial Officer, provided that no note shall mature later than one year from its date. The notes

shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer.

The Chief Financial Officer shall determine all matters in connection with the notes issued pursuant to this bond

ordinance, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such

determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of

N.J.S.A. §40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes from time to

time at public or private sale at not less than par and to deliver them to the purchasers thereof upon receipt of

payment of the purchase price plus accrued interest from their dates to the dates of delivery thereof. The Chief

Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next

succeeding the date when any sale or delivery of the notes pursuant to this bond ordinance is made. Such

report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and

the name of the purchaser.

                    The full faith and credit of the Borough are hereby pledged to the punctual payment of the

principal of and interest on the said obligations authorized by this bond ordinance. Said obligations shall be

direct, unlimited obligations of the Borough, and, unless paid from revenues of the sanitary sewerage system of

the Borough, the Borough shall be obligated to levy ad valorem taxes upon all the taxable property within the

Borough for the payment of said obligations and interest thereon without limitation of rate or amount.

                    The capital budget or temporary capital budget of the Borough is hereby amended to conform

with the provisions of this ordinance to the extent of any inconsistency herewith and the resolutions

promulgated by the Local Finance Board showing all detail of the amended capital budget or temporary capital

budget and capital program as approved by the Director, Division of Local Government Services, are on file with

the Borough Clerk and are available for public inspection.

                    This bond ordinance shall take effect twenty (20) days after the first publication thereof after

final adoption, as provided by said Local Bond Law.

                    This bond ordinance authorized obligations of the Borough solely for purposes described in

paragraph (h) of section 40A:2-7 of said Local Bond Law, and the said obligations authorized by this bond

ordinance are to be issued for a purpose which is self-liquidating within the meaning and limitations of section

Local Bond Law, from the gross debt of the Borough.

                The funds from time to time received by the Borough on account of the grant referred to in

Section 1 of this bond ordinance shall be used for financing the improvement or purpose described in Section 3

                                       RESOLUTION #106-0-2021
 AUTHORIZE TAX COLLECTOR TO PREPARE AND ISSUE ESTIMATED TAX BILLS FOR 3RD QUARTER 2021 TAXES

WHEREAS, in light of the disruption caused by the coronavirus outbreak, the State delayed the
municipal certification of the 2021 Wanaque Municipal Budget adopted on June 14, 2021; and

WHEREAS, the delay requires the Borough of Wanaque to prepare and issue estimated property tax
bills for 2021;” and

WHEREAS, N.J.S.A 54:4-66.3, pursuant to Section 3 of P.L 1994 c. 72 and 54:4:4-66.2, the governing
body has determined that the Tax Collector will be unable to complete the mailing and delivery of the
tax bills due to the absence of a certified tax rate; and

WHEREAS, the Tax Collector in consultation with the Chief Financial Officer has computed an
estimated tax levy in accordance with N.J.S.A. 54:4-66.3, and has signed a certification showing the tax
levies for the previous year, the tax rates and the range of permitted estimated tax levies; and

WHEREAS, in accordance with Chapter 72, P.L. 1994, the Tax Collector requests the Council to approve
the estimated tax levy; which is between the mandated estimated range proposed by the Local
Government Services. Approval will enable the Borough to meet its financial obligations, maintain the
tax collection rate, provide uniformity for tax payments and save the unnecessary cost of interest on
borrowing,

NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of the Borough of Wanaque, County of
Passaic, State of New Jersey, hereby authorizes that:

1.     The Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for
       the Borough for the third installment of 2021 taxes.

2.     The entire estimated tax levy for 2021 is hereby set at $45,315,748.15. The estimated tax rate
       for 2021 is hereby set at 4.060.

3.     In accordance with law, the third installment of 2021 taxes shall not be subject to interest until
       the later of August 10 or the twenty-fifth day after the date the estimated tax bills were mailed.
       The estimated tax bills shall contain a notice specifying the date on which interest may begin to
       accrue.

                          (CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS)

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may
approve the insertion of any Special Item of Revenue in the Budget of any County of Municipality when such
item shall have been made available by law and the amount thereof was not determined at the time of adoption
of the Budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount.

NOW, THEREFORE, BE IT RESOLVED that the Borough of Wanaque, in the County of Passaic, New Jersey, hereby
requests the Director of the Division of Local Government Services to approve the insertion of an Item of
Revenue in the Budget for the year 2021 in the amount of $615,555.77 for Coronavirus Recovery.

BE IT FURTHER RESOLVED, that a sum of $615,555.77 is hereby appropriated under the caption of:

                                CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS

BE IT FURTHER RESOLVED, that the Borough Clerk forward two certified copies of this Resolution to the Director

WHEREAS,       the Borough of Wanaque, pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-7.29(c), may by
resolution and without advertising for bids, purchase any goods or services under the State of New Jersey
Cooperative Purchasing Program for any State contracts entered into on behalf of the State by the Division of
Purchase and Property in the Department of the Treasury; and

WHEREAS,        the Borough of Wanaque has the need on a timely basis to purchase goods or services utilizing
the Educational Services Commission of NJESC Coop #G5MCESCCPS - ESCNJ 20/21-09; and

WHEREAS,      the Borough of Wanaque has the need for a 2021 Dodge Charger (LDDE48) Police RWD for the
Wanaque Police Department; and

WHEREAS,       the Borough of Wanaque intends to enter into a contract with Beyer Fleet, 31 Williams Parkway,
East Hanover, New Jersey 07936 through the Educational Services Commission of NJESC Co-Op #G5MCESCCPS -
ESCNJ 20/21-09 for an amount of $39,542.69; and

WHEREAS,      the Borough of Wanaque Municipal Budget has the required appropriation to make this
purchase; and

BE IT RESOLVED that the Borough Council of the Borough of Wanaque, New Jersey hereby authorizes the
Borough Administrator to enter into an agreement with Beyer Fleet, 31 Williams Parkway, East Hanover, New
Jersey 07936 through the Educational Services Commission of NJESC Co-Op #G5MCESCCPS - ESCNJ 20/21-09 for
an amount of $39,542.69
