Squaring privacy rules with measures to combat child sexual abuse online

                           subject to the strict confidentiality requirements of the e-Privacy Directive, providers' deployments of specific
                           technologies to detect, report and remove child sexual abuse material online now appear unlawful. To accommodate
                           such practices, the European Commission proposed a regulation that would temporarily exempt them from certain
                           provisions of the e-Privacy Directive, without, however, stipulating the legality of these practices with respect to the
                           wider EU data protection framework. During its July plenary session, the European Parliament is due to vote at first
                           reading on the final text resulting from interinstitutional negotiations.

               Riassunto Directive 2008/48/EC on credit agreement for consumers (the CCD) is part of the legal framework tackling consumer
                          protection and the development of the internal market. Despite improvements in enforcing consumer protection policy,
                          there are shortcomings in particular regarding the scope of application of the directive and the uneven regulatory
                          choices made in the 27 EU Member States for implementing it. Moreover, there are new challenges – such as
                          digitalisation and data collection, use and processing – that require immediate attention. This implementation appraisal
                          looks at the practical implementation of the CCD in light of the expected Commission proposal for its revision.
                          According to the Commission work programme 2021, the proposal will be submitted in the second quarter of 2021,
                          after having been initially part of the 2020 refit programme (see Legislative Train Schedule, EPRS).

               Riassunto Two decades after the entry into force of the General Product Safety Directive, the internal market is witnessing an
                          increasing presence of products made with the use of or involving new technologies, online marketplaces are
                          mushrooming, and a growing amount of products are entering the internal market from outside the European Union
                          through these online marketplaces. Since the General Product Safety Directive does not have any provisions to
                          guarantee that these products are safe for use, there are concerns that consumer protection on the internal market
                          might be compromised. In order to keep guaranteeing the safety of all products, the European Commission's
                          forthcoming proposal will aim to deal with these new challenges for product safety and to find a balance between
                          ensuring unhindered trade and guaranteeing the safety of all products on the internal market.

Biodiversity protection: Where do we stand?

               Riassunto Based on Member States' reporting under the Birds and Habitats Directives, the backbone of European Union (EU)
                          nature conservation policy, the latest assessment on the state of nature by the European Environment Agency shows
                          that despite some encouraging developments, the overall picture remains bleak. Only 15 % of habitats and around 27
                          % of species protected under EU legislation have a good conservation status. An EU-wide assessment of terrestrial,
                          freshwater and marine ecosystems found that, overall, the condition of ecosystems in the EU is unfavourable.
                          Worldwide, most indicators of ecosystems and biodiversity show rapid decline. Targets set to tackle biodiversity loss
                          by 2020, at both EU and global levels under the United Nations Convention on Biological Diversity (CBD), have not
                          been met. Under the EU biodiversity strategy for 2030, part of the European Green Deal, the EU has therefore set
                          itself new targets for the next decade. These include enlarging the current network of legally protected areas to cover
                          at least 30 % of the EU's land area and 30 % of the EU's seas; and setting legally binding EU nature restoration targets
                          to restore degraded ecosystems. The recent zero-pollution action plan for air, water and soil proposes additional
                          commitments relevant to biodiversity protection. Parties to the CBD, including the EU, are due to meet on 11-24
                          October 2021 in China to agree on a post-2020 global biodiversity framework. The EU intends to push for global 2030
                          targets in line with the commitments set out in its biodiversity strategy and for a much stronger implementation,
                          monitoring and review process. The issue of resource mobilisation will be an important one, especially in the context of
                          the coronavirus crisis, affecting the funding available for biodiversity. On 28 May 2021, Parliament's Committee on the
                          Environment, Public Health and Food Safety adopted an own-initiative report with recommendations to strengthen the
                          EU biodiversity strategy for 2030. The vote in plenary is scheduled for the June I plenary session.

               Riassunto Critical Infrastructures (CIs) provide vital economic and social functions to European Union (EU) citizens. However,
                         they are challenged by a diverse range of threats, not only natural and accidental but also intentional. CIs’ increasing
                         reliance on technological advancements adds another element of complexity and vulnerability. Whilst their protection
                         to date has been regulated by Directive 2008/114/EC, its scope of application has proved to be inadequate against an
                         evolving landscape of security threats. Consequently, it is currently under revision. A careful analysis of CIs’ status in
                         the EU, covering the challenges to their functioning and measures in place for their safeguard, is therefore necessary
                         to provide recommendations for the adoption of further instruments so as to equip CIs with increased protection and
                         resilience.

                Riassunto The Return Directive is the main piece of EU (European Union) legislation governing the procedures and criteria to be
                            applied by Member States when returning irregularly staying third-country nationals, and a cornerstone of EU return
                            policy. Taking into account the decrease in the EU return rate (from 45.8 % in 2016 to 28.9 % in 2019) and following
                            European Council and Council calls to review the 2008 legal text to enhance the effectiveness of EU return policy, in
                            September 2018 the Commission proposed a targeted recast of the directive aiming to 'reduce the length of return
                            procedures, secure a better link between asylum and return procedures, and ensure a more effective use of measures
                            to prevent absconding'. In the 2014-2019 parliamentary term, whereas the Council reached a partial general approach
                            on the proposal, the European Parliament did not reach a position. A draft report was presented to the Committee on
                            Civil Liberties, Justice and Home Affairs (LIBE) but was not adopted. After the 2019 elections, Parliament decided to
                            resume work on the proposal. A new draft report was published on 21 February 2020, but it was not presented in the
                            LIBE committee until 10 September 2020 on account of delays caused by the Covid-19 pandemic. The deadline for
                            tabling amendments expired on 23 September 2020 and the LIBE committee is currently considering the 754

Unfair terms in Swiss franc loans: Overview of European Court of Justice case law

                Riassunto In the first decade of the 21st century, loans denominated in or indexed to foreign currencies, in particular the Swiss
                           franc, became very popular in a number of EU Member States, including Greece, Croatia, Hungary, Austria, Poland,
                           Romania, and Slovenia, and also in two non-EU countries, Montenegro and Serbia. For a certain period, in some
                           Member States these loans became the most popular type of loan issued to consumers. By pegging loans to a stable
                           foreign currency, banks could lend more money to the same consumer by virtue of interest rates being lower than
                           those for the same type of loan expressed in the national currency. However, when, as a result of the global economic
                           crisis, the rate of exchange between the Swiss franc and these national currencies (zlotys, forints, kunas, etc.) soared,
                           consumers found themselves trapped. Often, they had to repay as much as twice the value of the loan taken, and
                           could not escape the unfavourable contract by simply selling the property they had bought, as this would cover only a
                           fraction of their debt. While certain Member States implemented mechanisms aimed at protecting consumers and
                           bringing the situation under control, the case law of the European Court of Justice (ECJ), based on dynamic
                           interpretation of the Unfair Terms Directive (93/13), has proved to be a significant factor in securing effective consumer
                           protection. This briefing explains the legal significance of the relevant ECJ judgments, against the backdrop of the
                           Swiss franc loan situation in Europe.

                Riassunto Council Directive 2008/114/EC is part of the EU framework for critical infrastructure protection. While embracing an all-
                            hazards approach, its scope is limited to the sectors energy and transport. This is widely considered a shortcoming.
                            Calls for broadening its scope and for refocussing the directive on resilience rather than just protection, and
                            interconnectivity of critical infrastructures resulted in a new legislative proposal the Commission presented in
                            December 2020.

                Riassunto On 1 February 2018, the European Commission published a proposal for a recast of the Directive on the quality of
                           water intended for human consumption (the Drinking Water Directive). The proposal responded to the European
                           Citizens' Initiative, Right2Water, and built on a fitness check which concluded that the 20-year old directive is fit for
                           purpose, but needs updating. The main elements of the proposal consist of updating the water quality standards,
                           introducing a risk-based approach to the monitoring of water, improving information provided to consumers,
                           harmonising the standards for products in contact with drinking water, and improving access to water. In the European
                           Parliament, the Committee on Environment, Public Health and Food Safety (ENVI) adopted its report in September
                           2018. The Parliament concluded its first reading in plenary in March 2019. A new rapporteur was appointed at the
                           beginning of the new parliamentary term, and agreement was reached on the text in trilogue negotiations on 18
                           December 2019. The Parliament voted to adopt the text at second reading on 15 December 2020. The directive was
                           published in the Official Journal on 23 December 2020, and the Member States have until 12 January 2023 to
                           transpose it into national legislation. Fifth edition. The 'EU Legislation in Progress' briefings are updated at key stages

                           workers at company level. They facilitate the information, consultation and participation of employees with a focus on
                           transnational issues. In times of crisis, including the COVID 19 crisis, relatively few workers lost their job in EU Member
                           States with well-developed industrial relations systems where workers and their representatives have relatively strong
                           rights.

               Riassunto The Airports Charges Directive 2009/12/EC is the main legislative act regulating the essential features of airport
                          charges. Airport charges are the charges that the airlines pay to the airports for using their infrastructure and facilities.
                          The two main issues that the directive aims to tackle are the risk that some airports might set prices and terms that are
                          not in line with a competitive market, and the diverging and non-transparent charging systems in the Member States. If
                          the evaluation of the directive revealed positive effects of the regulation, it also identified problematic issues, which
                          hampers the full achievement of its objectives. The European Commission is expected to submit a new proposal by the
                          end of the year.

               Riassunto New plant genetic modification techniques, referred to as 'gene editing' or 'genome editing', have evolved rapidly in
                          recent years, allowing much faster and more precise results than conventional plant-breeding techniques. They are
                          seen as a promising innovative field for the agri-food industry, offering great technical potential. Consumers could
                          benefit from enhanced nutritional quality or reduced allergenicity of food, for example, such as gluten-reduced wheat.
                          There is, however, considerable debate as to how these new techniques should be regulated, and whether some or all
                          of them should fall within the scope of EU legislation on genetically modified organisms (GMOs). Those who take the
                          view that the new techniques should be exempt from GMO legislation generally argue that the end product is very
                          similar to products generated using conventional breeding techniques, or that similar changes could also occur
                          naturally. Those who consider that the new techniques should fall within the scope of GMO legislation contend that the
                          processes used mean that plants bred using the new techniques are in fact genetically modified. In July 2018, the
                          Court of Justice of the European Union ruled that genome-edited organisms fall under the scope of European GMO
                          legislation. While welcomed by some, the judgment also sparked criticism and calls for the new European Commission
                          to amend EU GMO legislation. In November 2019, the Council requested that the Commission submit a study in light
                          of the Court of Justice judgment regarding the status of novel genomic techniques (NGTs), by 30 April 2021. This is an

                Riassunto This study examines the implementation of the European Union (EU) defence package, which consists of the Defence
                          Procurement Directive 2009/81/EC and the Intra-Community Transfers Directive 2009/43/EC, during the period from
                          2016 to 2020. It is organised in two parts. The first part of the study, prepared internally, examines the evaluations
                          carried out on the implementation of the two directives to identify persisting challenges. It surveys institutional and
                          policy novelties in the field of EU defence cooperation so as to place the implementation of the two directives in
                          context, and then examines Parliament's oversight work. It goes on to lay out the main elements that are likely to affect
                          the future of EU defence industrial cooperation, and provides options for moving forward. The second part of the study,
                          which was outsourced, is based on primary research (a survey and interviews) and aims to assess the effectiveness,
                          efficiency, relevance and added value of the Defence Procurement Directive and the Intra-Community Transfers
                          Directive. It also seeks to identify limitations and challenges, and explore – where possible – the links between the
                          implementation of the two directives.

                Riassunto The EU should create a competitive and sustainable battery manufacturing industry. The EU needs, therefore, a
                           regulatory framework fit for purpose. However, this briefing shows that the design and implementation of the Batteries
                           Directive, which is the main legal act regulating batteries and accumulators at EU level, suffer from deficiencies that
                           makes it impossible for this piece of EU law to adequately respond to new policy challenges. Some of the most
                           pertinent shortcomings of the directive relate to its incapacity to incorporate technical innovation, problems with certain
                           definitions, the performance of Member States as regards the collection of waste batteries, as well as the insufficient
                           recovery of materials from used batteries. Therefore, the Commission has scheduled a revision of the legal framework.

                Riassunto In November 2019, the European Parliament's Committee on Civil Liberties, Justice and Home Affairs (LIBE) launched
                          an implementation report on Directive 2008/115/EC on common standards and procedures in Member States for
                          returning illegally staying third-country nationals (the 'Return Directive'). The Return Directive aims at ensuring that the
                          return of non-EU nationals without legal grounds to stay in the EU is carried out effectively, through fair and
                          transparent procedures that fully respect the fundamental rights and dignity of the people concerned. Tineke Strik
                          (Greens/EFA, the Netherlands) was appointed as rapporteur. Implementation reports by European Parliament
                          committees are routinely accompanied by European Implementation Assessments, drawn up by the Ex-Post
                          Evaluation Unit of the European Parliament's Directorate-General for Parliamentary Research Services (EPRS). This
                          EPRS European Implementation Assessment finds several protection gaps and shortcomings regarding the four key
                          measures of the Return Directive – return decision, enforcement of the return decision, entry ban, and detention –
                          which may lead to fundamental rights violations for irregular migrants. Moreover, EU return and readmission policy has
                          increasingly resorted to informal cooperation in the external policy dimension. There have been, and continue to be,
                          rule of law, fundamental rights, budgetary and external affairs implications flowing from the pursuit, conclusion and
                          implementation of EU readmission agreements and agreements having equivalent effect with third countries.

               Riassunto The European Union is expected to revise the liability regime for online intermediaries in the forthcoming digital
                          services act. This publication describes the current liability regime set out under the 2000 E commerce Directive,
                          highlights the implementation gaps that have been identified, and presents the main proposals for reform that have
                          been discussed so far. Technology has evolved in the last 20 years and new societal challenges, such as the
                          increasing use of platforms to access and distribute products, services and information have arisen. As a result, policy-
                          makers will have to address a range of questions, including the extension of the scope of the liability regime and the
                          revision of the liability exemption conditions.

                Riassunto This briefing discusses the possible reactions of the European Union’s larger trading partners to carbon border
                           measures. Section 1 discusses experiences of carbon border adjustment-like regimes prior to the European
                           Commission’s announcement of the Green Deal. It focuses on the EU Aviation Directive, the US policy debate, and the
                           Californian CBA for electricity. Section 2 considers reactions to the Green Deal announcement, based on informal
                           discussion with officials from major trading partners to the EU. It identifies positive and negative reactions to the
                           principle of an EU CBA, concerns about its design, criticisms and potential policy responses by these partners. Section
                           3 discusses the implications of our findings. It points to several features in the design and introduction of an EU CBA
                           mechanism that we believe will importantly affect how partners will react to such mechanism.

                Riassunto In this study we execute an in-depth analysis of the evolution of market concentration, competition and costs in the EU
                          market for statutory auditing before and after the Audit Reform. Based on data from archival databases and a survey,
                          we present evidence suggesting that rivalry between the largest audit suppliers increased, as did audit costs, non-Big
                          4 audit market share, and joint audit rates. Non-audit services (NAS) fees earned by the incumbent auditor decreased.

               Riassunto The Return Directive is the main piece of EU legislation applied to return procedures. Under this directive, Member
                          States shall generally issue a return decision (an administrative or judicial decision imposing and obligation to leave
                          the territory of Member States) against every third-country national (TCN) found to be irregularly present in their
                          territory. A proposal to recast the EU Return Directive is currently being discussed within the European Parliament and

                Riassunto On 12 September 2018, the European Commission published a proposal for a recasting of the 2008 Return Directive,
                          which stipulates common standards and procedures in Member States for returning irregular migrants who are non-EU
                          nationals. Effectively returning irregular migrants is one of the key objectives of the European Union’s migration policy.
                          However, Member States currently face challenges: national practices implementing the EU rules vary and the overall
                          return rates remain below expectations. The proposal was not accompanied by a Commission impact assessment.
                          The European Parliament's Committee on Civil Liberties, Justice and Home Affairs (LIBE) therefore asked the
                          European Parliamentary Research Service to provide a targeted substitute impact assessment of the proposed recast
                          Return Directive. The assessment considers the main expected impacts of the key provisions of the Commission
                          proposal, focusing on the social, human rights and financial impacts, as compared to the current situation (status quo).
                          On the basis of the legal and economic studies carried out for this impact assessment, it appears that the Commission
                          proposal for a recast Return Directive has significant legal, social, human rights and economic implications, which in
                          principle would have deserved consideration in the context of a proper impact assessment process conducted ex-ante
                          by the Commission.

                Riassunto Despite a comprehensive normative international framework that prohibits child labour, it persists in many areas of the
                            world, particularly in developing countries. In sub-Saharan-Africa, it has even increased in recent years. More efforts
                            are therefore needed to combat child labour. However, not all work performed by children is harmful to their health and
                            development. The first task is therefore to distinguish child labour – which entails harmful forms of work – from other
                            forms of children's involvement with work that are acceptable and have an educational component. While international
                            conventions provide a broad definition of child labour, they leave the task of defining more precise criteria, such as the
                            acceptable number of working hours per week or what constitutes hazardous work, to national legislation. Child labour
                            is a complex phenomenon that has a multiplicity of causes, among which poverty usually features first. It requires a
                            comprehensive approach to fight it, including awareness-raising among families and local communities, due diligence
                            by companies involved in global supply chains, and action by governments, international organisations and civil
                            society. The European Union protects children's rights through both its internal and external policies. It has deployed
                            measures to fight child labour through cooperation with international organisations and has funded development
                            projects whose aim is to counter it. The human rights conditionality enshrined in the EU's trade arrangements provides
                            another path for tackling child labour. Nevertheless, there are numerous calls from civil society and the European
                            Parliament to impose binding legal obligations on EU-based companies, to make sure their imports of goods from
                            developing countries are free of child labour.

                Riassunto Value added tax (VAT) is a consumption tax borne by the final consumer. It is an important source of revenue for
                            national governments and the European Union (EU) budget. However, the existing rules governing intra-Community
                            trade are 25 years old and the current common EU VAT system is still ‘transitional’. This framework presents problems
                            such as vulnerability to fraud, compliance costs for businesses and also a heavy administrative burden for national
                            authorities. It is under review along the lines of the April 2016 VAT Action Plan. The reform of the VAT framework
                            towards a definitive VAT system for intra-Community business-to-business (B2B) transactions is planned in several
                            consecutive steps. The first step focuses on B2B transactions in goods, while the second one in services. Directive
                            2018/1910, adopted on 4 December 2018, was put forward by the Commission in October 2017 as part of the
                            ‘definitive VAT system package'. The directive amends the VAT Directive (Directive 2006/112/EC) so as to introduce
                            the basic features of the definite VAT system for business-to-business (B2B) goods transactions. Second edition of a

                Riassunto This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional
                           Affairs at the request of the PETI Committee, aims to update the 2016 study “Fit for purpose? The Facilitation Directive
                           and the criminalisation of humanitarian assistance to irregular migrants”. It takes stock of and examines the latest
                           developments that have taken place since 2016, specifically the legislative and policy changes, along with various
                           forms and cases of criminalisation of humanitarian actors, migrants’ family members and basic service providers. The
                           study uses the notion of ‘policing humanitarianism’ to describe not only cases of formal prosecution and sentencing in
                           criminal justice procedures, but also wider dynamics of suspicion, intimidation, harassment and disciplining in five
                           selected Member States – Belgium, France, Greece, Hungary and Italy. Policing humanitarianism negatively affects
                           EU citizens’ rights – such as the freedom of assembly, freedom of speech and freedom of conscience. When civil
                           society is effectively (self-)silenced and its accountability role undermined, policies to combat migrant smuggling may
                           be overused and give rise to serious breaches of the EU’s founding values, notably the rule of law, democracy and
                           fundamental rights. Moreover, policing humanitarianism negatively affects wider societal trust and diverts the limited
                           resources of law enforcement from investigating more serious crimes.

                Riassunto Mediation Directive 2008/52/EC defines the procedure of environmental impact assessment. It intends to facilitate
                            access to alternative dispute resolution mechanisms and to promote the amicable settlement of disputes, while
                            encouraging the use of mediation. The directive applies to cross-border disputes in civil, including family law, and
                            commercial matters. This note provides a brief overview of its implementation.

                Riassunto The study presents the results of evaluation of the implementation of the Directive 2009/128/EC establishing a
                          framework for Community action to achieve the sustainable use of pesticides. The study was outsourced and prepared
                          by a consortium led by ÖIR GmbH, in collaboration with Arcadia International, t33 and external experts. The study
                          covers the implementation of the directive as a whole. Furthermore, it concentrates on the implementation of the
                          integrated pest management principles in the individual Member States. In addition, it also provides an analysis
                          concerning of a the development of harmonised risk indicators, the imposition of limitation and bans of on the usage of
                          pesticides in sensitive specific sensitive areas, and the impacts that of the use of pesticides has on drinking water. The
                          analysis is accompanied by recommendations on how to improve the implementation processes.

                Riassunto    Nel febbraio 2018 la Commissione europea ha adottato una proposta di rifusione della direttiva sull'acqua potabile, che
                             aggiorna gli standard di qualità dell'acqua e intende migliorare l'accesso all'acqua potabile per tutti. Durante la tornata
                             di ottobre II, il Parlamento voterà in merito alla relazione della commissione per l'ambiente, la sanità pubblica e la
                             sicurezza alimentare (ENVI) e all'avvio di negoziati interistituzionali di trilogo.

                Riassunto Posting of workers plays an important role in the internal market, particularly in the cross-border provision of services.
                            While the number of posted workers continues to increase significantly, problems such as unfair practices and unequal
                            remuneration persist. In addition, the correct balance between the freedom to provide cross-border services and the
                            social rights of workers is needed, and moreover, needs to be adapted to today's labour market situation. The targeted
                            revision of the Posting of Workers Directive (96/71/EC) proposed by the Commission intended to bring changes in
                            three main areas: the remuneration of posted workers (making it equal to that of local workers, even when
                            subcontracting), more coherent rules on temporary agency workers, as well as long-term posting. The agreement
                            reached in trilogue negotiations states that long-term posting (with labour law provisions of the host country to be
                            applied) starts after 12 months (with a possible extension of six months). The overall amount of remuneration received
                            by a posted worker must meet the level of remuneration in the host Member State (without the reimbursement of the
                            worker's expenses) which must be published on a single national website. Host Member States can accord to posted
                            workers the coverage of representative collective agreements in all sectors, and they must protect them against
                            fraudulent posting. The Parliament approved the text on 29 May 2018, the act was adopted by the Council on 21 June
                            2018 and the final act was signed on 28 June 2018. Member States have until 30 July 2020 to transpose the measures
                            of the directive and apply them in their national law. Sixth edition. The ‘EU Legislation in Progress’ briefings are
