Definitions
ACT (the) - the Commercial Passenger (Road) Transport Act of the Northern Territory of
Australia.
ADR - the Australian Design Rules for vehicle safety, anti-theft and emissions standards for
road vehicles.
Advertising - any advertisement, statement or representation of any kind displayed on a
vehicle, such as lettering, maps, plans, drawings or pictorial images and includes bumper
stickers.
Approved - means approved by the Director.
Authorised Inspector – a person authorised by the Registrar of Motor Vehicles to undertake
vehicle roadworthy and/or cosmetic inspections.
Cosmetic Inspection – an inspection of the vehicle undertaken by a person authorised by
the Registrar of Motor Vehicles in accordance with the comfort and aesthetic standards as
outlined in this Standard.
Decal - a decorative sticker, which can be attached to a vehicle:
1. directly; or
2. via a magnetic backing.
Director - the Director of Commercial Passenger (Road) Transport appointed under
section 5(1) of the Act.
GVM - the manufacturer’s Gross Vehicle Mass.
In-service - means a motor vehicle that is registered under the Motor Vehicles Act and the
vehicle is endorsed against a licence that is granted or renewed under the Commercial
Passenger (Road) Transport Act.
Luggage - any container for a person’s belongings or any individual item.
Modified – any change or alteration from its original condition.
Motor omnibus – an approved motor vehicle fitted, equipped and constructed in accordance
with the Australian Design Rules (within the meaning of the Motor Vehicles Act), or other
standards as the Director determines, to carry more than 8 passengers and used to carry
passengers for hire or reward.
MVR - the Motor Vehicle Registry of the Northern Territory.
OEM - Original Equipment Manufacture.

Operate - in relation to a commercial passenger vehicle, means:
(a) to drive or use; or
(b) to cause or employ another person to drive or use,
that vehicle to carry passengers for hire or reward, otherwise than only in the capacity of
an employee or volunteer.
Registrar - Registrar of Motor Vehicles as appointed under the Motor Vehicles Act in the
Northern Territory of Australia.
Regulations - Regulations applicable to operating motor omnibuses for hire or reward in the
Northern Territory of Australia.
Roadworthy - a standard determined by the Registrar of Motor Vehicles for a vehicle to be
registered as outlined in the “Northern Territory Inspection Manuals for Light and Heavy
Vehicles”.
Subjective Assessment - for the purpose of comfort and aesthetic standards means there
is some discretion given to a person who is inspecting the vehicle to make allowances for the
area of operation and/or allowances for the remaining life of the vehicle.
SUTI - a Single Uniform Type Inspection is an assessment of the internal vehicle dimensions
to determine passenger entry, egress and comfort for the vehicle’s suitability in a specific
Commercial Passenger Vehicle category. SUTI assessments are primarily undertaken by
Transport Inspectors of the Motor Vehicle Registry on new and old models of vehicles by
request from an owner or operator.
Wheel Trim - any item that covers part of or the entire wheel and includes hub caps.

General Requirements
1.1. Applicability
1.1.1. This Standard applies to all motor omnibuses operating for hire or reward.
1.2. Classification
1.2.1. Urban Service – passenger standing capacity
1.2.2. Tour and Charter – no passenger standing capacity
1.3. Vehicle Type
1.3.1. The type of vehicle suitable for the motor omnibus category is determined by the
ADR classification of MD1, MD2, MD3, MD4, ME, or as determined by the Registrar
or Director.
1.3.2. In assessing the suitability of a vehicle, the Registrar or Director or delegate of the
Director may require a SUTI.
1.4. Vehicle Colour
1.4.1. No specific requirements.
1.5. Vehicle Age
1.5.1. No specific requirements.
1.6. Vehicle Inspection Requirements
1.6.1. All motor omnibuses must pass a roadworthy and cosmetic inspection every
6 months.
1.6.2. Inspection requirements may not apply to vehicles nominated in a vehicle
maintenance management scheme as approved by the Registrar of Motor Vehicles.
1.6.3. It is the responsibility of the operator to ensure the vehicle is serviced and
maintained to the applicable roadworthy and cosmetic requirements at all times.
1.6.4. Where a vehicle is inspected (either at the roadside audit or at an approved
inspection station) and is found to have a serious road safety related fault,
appropriate action will be taken to minimise risk of danger to the driver, passenger/s
and other road users.

1.7. Equipment
1.7.1. A current vehicle inspection label issued by the Registrar of Motor Vehicles must be
affixed to the left side of the windscreen outside of any windscreen tint band as near
as practicable to the vehicle’s registration label and not in the field of view of the
driver.
1.7.2. 1.7.1 does not apply to vehicles nominated in a vehicle maintenance management
scheme approved by the Registrar of Motor Vehicles.
1.7.3. Where applicable, a roadworthy spare tyre/wheel assembly with suitable tyre
changing equipment and tools must be available and secured in the vehicle (except
urban route service buses and urban school buses).
1.7.4. Where applicable, a spare wheel assembly, tools and equipment must be correctly
located, secured and covered in line with the vehicle manufacturer’s original design
requirements. If a spare wheel is relocated to the interior of the vehicle as a result
of an approved vehicle modification (such as the fitting of a LPG system), the wheel
must be adequately secured and also covered in a material that matches interior
trim of the vehicle (except urban route service buses and urban school buses).
1.7.5. A fully charged fire extinguisher, complying with Australian Standard AS 2444
“Portable Fire Extinguishers and Fire Blankets – Selection and Location“, must be
securely mounted in the vehicle and not be a hazard or cause annoyance to the
vehicle occupants. It must be easily accessible and must not be obscured. It must
be properly maintained and be certified for operational use in accordance with
Australian Standards AS 1851 “Maintenance of Fire Protection Equipment”. The
frequency and level of inspection, testing, preventative maintenance and survey on
portable fire extinguishers shall apply six-monthly (level 1), yearly (level 2), five-
yearly (level 4), as applicable by the Standard, or after any usage
1.7.6. A vehicle with a GVM up to 3.5 tonnes must have a minimum of one fire
extinguisher of class 1A:5B complying with Australian Standards AS 2444 “Portable
Fire Extinguishers and Fire Blankets – Selection and Location”.
1.7.7. A vehicle with a GVM over 3.5 tonnes operating in urban areas or on short trips
outside urban areas must have a minimum of one fire extinguisher of class 2A:20B
(fitted with hose) complying with Australian Standards AS 2444 “Portable Fire
Extinguishers and Fire Blankets – Selection and Location”.
1.7.8. A vehicle with a GVM over 3.5 tonnes operating outside of urban areas or when
fitted with integral luggage compartment must have a minimum of two fire
extinguishers of class 2A:20B (fitted with hose) complying with Australian Standards
AS 2444 “Portable Fire Extinguishers and Fire Blankets – Selection and Location”
with one fire extinguisher fitted near the under-floor area or engine and one fire
extinguisher fitted in the cabin/occupant space.

1.7.9. Signage indicating the vehicle’s licensed passenger carrying capacity must be
affixed in a conspicuous position inside the vehicle so as not to interfere with any
vehicle safety device or obstruct any vehicle instrumentation or vehicle control. The
sign is to have white lettering on a black background with lettering at least 15mm
high and is to display information in a format similar to the following options:
Option 1: Licensed to Carry xx Passengers
Option 2: Licensed to Carry xx Persons including Driver
Option 3: Licensed to Carry xx Seated Passengers and xxx
Standing Passengers
Option 4: Licensed to Carry xx Passengers including Standing
Passengers
(xx/xxx indicating the actual number of persons/passengers applicable for the licensed
carrying capacity of the motor omnibus)
1.7.10. Unless otherwise specified, vehicles with a seating capacity of 11 or more
passengers, Emergency Exit requirements apply as per the relevant Australian
Design Rules (ADR 44 “Specific Purpose Vehicle Requirements”, ADR 58
“Requirements for Omnibuses Designed for Hire and Reward”).
1.8. Exterior
1.8.1. The vehicle exterior including body panels, paintwork, glazing, glass, fittings and
accessories shall be maintained in a sound condition, clean, correctly aligned, free
of chips, dents, scratches, accident damage, corrosion and dirt, operate as originally
installed and comply with all relevant standards.
1.8.2. All exterior paintwork must be of a similar colour and lustre.
1.8.3. All doors are to be correctly aligned, are to open and close without undue effort or
noise. Hinges, catches and check links must not be excessively worn. All door
seals must be correctly secured and undamaged.
1.8.4. Bumper bars are to be securely attached, correctly aligned and free of dents,
scratches, accident damage and dirt.

1.8.5. Where wheel trims are fitted, wheels must be fitted with matching wheel trims.
Wheel rims and trims must be maintained in an undamaged and clean condition.
1.8.6. Where the vehicle sustains accident damage, if the operator wants to continue to
operate the vehicle, the vehicle is to be presented for assessment to a Transport
Inspector at any MVR Vehicle Inspection Facility no longer than 24-hours or on the
first working day after the accident.
1.9. Interior
1.9.1. All vehicle interior surfaces and panels, including seats, head rests, floor coverings,
trims and seatbelts, are to be in a sound and clean condition, free of dirt, stains and
damage. All equipment and devices fitted shall be maintained so as to operate as
originally designed and installed.
1.9.2. Seats and head rests, including any covering on the seats or head rests, are to be
non-absorbent. All seats must provide adequate support as originally designed.
1.9.3. All interior lighting (dome and courtesy lights) must be operational as originally
designed. The fitment of interior novelty lighting or the carriage of ornaments in the
vehicle is prohibited (e.g. on the dash, interior mirror, rear parcel shelf etc).
1.9.4. All interior fittings and accessories must be in an undamaged sound condition and
match the colour and shade of the existing trim/upholstery.
1.9.5. The interior cabin space of the vehicle must be maintained in a clean and tidy
condition, free of rubbish, loose objects and offensive odours.
1.9.6. An effective ventilation system must be installed in the vehicle appropriate to the
vehicle’s intended operation. Where applicable, air conditioning, heating and
ventilation systems must operate as originally designed and deliver sufficient
quantities of air to maintain acceptable cabin temperatures for passenger comfort.
All ventilation outlets are to be kept clean.
1.9.7. Where fitted, lavatories and wash basins are to be maintained in a clean and tidy
condition to ensure passenger comfort and hygiene.
1.9.8. Where fitted, curtains/blinds must be maintained in a clean and tidy condition.

1.10. Luggage Compartment
1.10.1. Where applicable, a luggage compartment must be in a sound condition, free of dirt,
stains and damage. The luggage compartment cover must be correctly sealed,
secured, aligned and not be damaged.
1.10.2. Luggage or goods must NOT be carried in a location or manner that may cause
injury to a person in the event of an accident or emergency braking manoeuvre.
1.10.3. Luggage or goods must NOT be placed in any location that blocks the use of or
operation of any door or emergency exit.
1.10.4. Where luggage racks are fitted, adequate luggage restraint must be in place.
1.11. Accessories and Modifications
1.11.1. Tow bars, bull bars, driving lights may be fitted providing the installation is in
accordance with the equipment manufacturers’ instructions and the installation
complies with roadworthy and cosmetic/aesthetic requirements.
1.11.2. Media and communication devices such as two-way radios, DVD players, television
screens and mobile phones may be fitted providing the installation is in accordance
with the equipment manufacturer’s instructions and the installation complies with
any legislative requirements and are securely attached.
Note:
Other legislative requirements may apply to the content of
material being viewed or heard on any media device.
1.11.3. Public address microphones used by the driver when the vehicle is in motion are to
be hands-free.
1.11.4. Any accessory/modification that may affect the structural integrity of the vehicle,
occupant protection or the handling characteristics of the vehicle will require
approval from the Registrar of Motor Vehicles.
1.11.5. Any approved accessory/option fitted must be maintained in a sound condition; at all
times meeting the manufacturer’s original design or approved installation
requirements.

1.12. Ride Quality and Comfort
1.12.1. The vehicle’s ride quality and comfort must be maintained to an acceptable standard
without excessive vibrations, squeaks, rattles and noise from the steering,
suspension, drive line or body.
1.13. Trailers
1.13.1. A trailer may be used for carriage of equipment and luggage.
1.13.2. The luggage compartment of the trailer must be fully enclosed/sealed to prevent the
ingress of dust or moisture.
1.13.3. Adequate measures are to be in place to prevent damage to any luggage carried in
the trailer.
1.14. Advertising
1.14.1. The operator must not operate any vehicle endorsed against this licence which
displays an advertisement that has not been approved by the Director.
1.14.2. An advertisement does not include the name of the service operated by the motor
omnibus or the name or trademark of the operator.
1.14.3. Any third party advertising must be approved by the Director.
1.14.4. All exterior signage, identification decals and any advertising decals must not be
damaged, peeling, missing, faded or deteriorated.
1.14.5. Where applicable, advertisements must be secure and safe.
1.14.6. Advertising must not be used for the purpose of covering cosmetic deficiencies.
1.14.7. The wording and any pictorial images represented must not be offensive,
ambiguous or otherwise inappropriate (e.g. have a racial, religious, political or ethnic
overtone).
1.14.8. Advertisements displayed must be static and must not be reflective (e.g. mirror like
reflection).
1.14.9. A sticker maybe considered advertising - irrespective of the size.
1.14.10. Retro-reflective material may be acceptable for advertisements. For more
information on Retro-reflective materials refer to Australian Standard AS1906.1
“Retro-reflective materials and devices for road traffic control purposes”.
1.15. Warning Lights and Signs on Buses Carrying Children
1.15.1. This requirement is outlined in Division 18 of the Australian Vehicle Standards Rule
– refer “Information Bulletin V78 Warning Signs and Lights on School Buses”.

1.16. In-service Passenger Body Module Fitment to New Chassis
1.16.1. Factory new vehicles with passenger body modules require a second compliance
plate known as Second Stage Manufacturer (SSM) plate as evidence of compliance
with all Australian Design Rules for the change in vehicle category from goods-
carrying vehicle to motor omnibus. SSM approval is only offered by the
Commonwealth Transport Department.
1.16.2. In-service vehicles with replacement passenger body modules require a Chartered
Professional Engineer or other suitably qualified person to certify that the modified
vehicle complies with all Australian Design Rules as a motor omnibus and that the
module is fitted in accordance with recognised engineering practices.
1.17. Passenger Standing Capacity Assessment
1.17.1. Passenger standing capacity is only permitted for a motor omnibus operating on an
approved urban route service or urban school bus service.
1.17.2. The number of standing passengers is calculated according to 6.25 passengers per
square metre of available floor space. This includes aisles and other floor areas,
including wheelchair space and fold-down seat areas.
1.17.3. Aisle width must not be less than 380mm.
1.17.4. No part of the floor area of any longitudinal aisle shall have a gradient greater than
8% (4.6 degrees) in areas intended for standing passengers on more than 12.5%
(7.1 degrees) for areas not intended for standing passengers. For the purpose of
this clause, the omnibus shall be considered to be on a flat horizontal surface.
1.17.5. Available floor space must be equipped with suitable hand-holds.
1.17.6. The available floor space does not include step areas, doorways, driver’s space and
200mm in front of any seat cushion.
1.17.7. The sum of the seated positions (including driver) and standing passengers (65kg
per person) plus the tare mass of the motor omnibus shall not exceed the lesser of
the manufacturer’s ratings or the legal mass limits. (Tare mass includes all
operational equipment and full fuel tanks).
