Subject: UPDATE: Orange Tier (Tier 3 – Moderate) Effective April 7, 2021
The Monterey County Health Officer announced today that the County will continue to align with the
State’s framework and allow activities open in Orange Tier counties to resume, effective Wednesday,
April 7, 2021.
This means restaurants are still allowed to welcome guests for indoor dining, with modifications for
Covid-safe operation, subject to the following conditions (Updated Conditions have been highlighted):
Limited to 50% of the Fire Marshall approved occupancy or 200 people, whichever is less.
o Example: 100-person max building occupancy = 50-person allowed indoor capacity.
Employees are NOT REQUIRED to count toward 50% indoor capacity (MCHD recommendation only)
o Indoor performers ARE REQUIRED to count towards 50% occupancy
Indoor dining hours shall be consistent with the approved Use Permit for the business.
Each restaurant must implement and follow an “Operating Control Plan” to ensure safe
operation practices like physical distancing, face coverings, signage, cleaning protocols, etc. A
control plan template from Monterey County Health has been attached to this memo.
o Monterey County Health Department will be continuing site visits to provide support as
needed with the implementation of safety protocols.
Adherence to all other State and County regulations for operating in the “Orange Tier” under
the Governor’s Blueprint for a Safer Economy.
In addition to the above direction for the opening of restaurants, effective April 7, 2021:
Wine tasting rooms are allowed to welcome guests indoors, with modifications for Covid-
safe operation, limited to 25% of the Fire Marshall approved occupancy or 100 people,
whichever is fewer. Employees do not count toward the 25% calculation. Performers do
count toward 25% calculation.
Bars may open for outdoor service in approved areas with modifications for covid-safe
operation.
o Indoor operation will be allowed in Yellow Tier (Tier 4 – Minimal).
Parklet hours/regulations do not change.
Parklet seating does not count towards indoor capacity.
Please see the attached “Full Activity and Business Tiers” document for all activities authorized under
the State’s Orange Tier (Disregard language about counting employees in 25% restaurant occupancy).

This document can be used as a template to help create a control plan for your establishment to operate
in the Red Tier in accordance with Blueprint for a Safer Economy from the California Department of
Public Health. A copy of this Active Managerial Control Plan shall be kept onsite inside the
establishment. Please carefully review what activities and businesses are allowed under Monterey
County’s current assigned tier and keep alert for tier changes.
Important Note: Tier assignments may occur any day of the week and may occur more than once a week.
I AGREE TO FOLLOW THE FACE COVERING REQUIREMENTS AS FOLLOWS:
Face Coverings:
___ Employees and customers shall properly wear a face covering that:
o Covers both the nose and mouth
o Goes under chin and is a secure fit
o Does not have significant gaps around the nose or other parts of face
o Have the ear loops, ties, or straps tight enough to keep the face covering from sliding down the nose
___ Face coverings shall be worn, whether at the workplace or performing work off-site, when:
o Interacting in-person with any member of the public
o Working in any space visited by members of the public, regardless of whether anyone from the public is
present at the time
o Working in any space where food is prepared or packaged for sale or distribution to others
o Working in or walking through common areas, such as hallways, stairways, elevators, and parking
facilities
___ Provide signage at each public entrance of the facility to wear face coverings at all times
___ Employees should wash or sanitize hands before and after using or adjusting face coverings
___ Face coverings must not be shared and should be washed or discarded after each shift
___ Employers can implement additional face covering requirements in fulfilling their obligation to provide
workers with a safe and healthful workplace

Rev. 02/24/2021___ Per California Department of Public Health’s “Guidance for use of Face Coverings,” effective November 16,
2020, persons exempted from wearing face coverings due to a medical condition who are employed in a
job involving regular contact with others must wear a non-restrictive alternative, such as a face shield with
a drape on the bottom edge, as long as their condition permits it. Employers should develop an
accommodation policy for any worker who meets one of the exemptions from wearing a face covering.
I AGREE TO POST THE APPROPRIATE SIGNAGE AS FOLLOWS:
Signage:
___ Signage at each public entrance of the facility to inform all employees and customers that they should:
o avoid entering the facility if they have a cough or fever
o sneeze and cough into a cloth or tissue, or if not available, into one’s elbow
o not shake hands or engage in any unnecessary physical contact
___ Signage posting a copy of the social distancing protocol at each public entrance to the facility.
___ Signage and/or visual cues to maintain six feet of social distance at all times, even while in line.
___ Signage stating your establishment is operating indoors with modifications allowing a maximum 25%
capacity or 100 people, whichever is fewer. This includes employees working inside facility. Please contact
your local building department for additional requirements.
I AGREE TO TAKE THE FOLLOWING MEASURES TO PROTECT EMPLOYEE HEALTH AS FOLLOWS:
Measures to Protect Employee Health:
___ Everyone who can carry out their work duties from home has been directed to do so. If requiring self-
screening at home, which is an appropriate alternative to providing it at the establishment, ensure that
screening was performed prior to the employee leaving the home for their shift.
___ Encourage employees who are sick or exhibiting symptoms of COVID-19 to stay home.
___ Require employees to avoid handshakes and similar greetings that break physical distance.
___ Provide temperature and/or symptom screenings for all employees at the beginning of their shift and any
vendors, contractors, or other workers entering the establishment. Make sure the temperature/symptom
screener avoids close contact with employees to the extent possible.
___ All desks or individual workstations are separated by at least six feet.
___ Break rooms, bathrooms, and other common areas are being disinfected frequently.
___ Physical distancing protocols should be used in any office areas, kitchens, pantries, walk-in freezers, or
other high-density, high-traffic work areas, where possible.
___ Establish directional hallways and passageways for foot traffic, if possible, to eliminate employees from
passing by one another.
___ Disinfectant, soap and water, hand sanitizer, and related supplies are available to all employees at the
