Dear Mr. De Gucht,
Our company is a European member of the solar photovoltaic (PV) value chain.
We are very concerned about the outcome of the anti-dumping and anti-subsidy investigations into
Chinese solar products which could very significantly affect our business and future growth. We fully
support the Alliance for Affordable Solar Energy (AFASE)’s vision for a healthy and free Solar PV
Industry in Europe, as detailed below.
I. The Global PV Industry Context
The PV market has moved from a boom to bust cycle previously during the past 30 years – 2010
to today is the latest cycle. As part of the global agenda to tackle climate change, more than 120
countries from around the world have embarked on ambitious plans to develop renewable energy as
a viable alternative to fossil fuels. The EU Member States proceeded in the same way in line with the
ambitious and legally binding EU-wide renewable energy targets for 2020. To achieve these targets,
many if not most governments have set up various support mechanisms to stimulate the growth of all
forms of renewable energy, including solar energy.
The incentive schemes such as feed-in-tariffs (FiTs) and other support mechanisms created by public
authorities accelerated investment in PV production capacity globally. Indeed, as demand for solar
PV grew, investors at the different levels of the PV value chain saw attractive profit margins. This
created a boom cycle whereby production capacity worldwide increased very significantly.

the form of public support and of the financial crisis in the years 2007-09 resulted in the funds for
support schemes being cut sharply. This caused demand for photovoltaic installations to decrease in
the EU overall.
The current difficult situation of PV producers is the result of the growth in global production capacity
and the stagnation of demand, as caused by the financial crisis. As acknowledged by the European
Photovoltaic Industry Association (EPIA), demand is expected to decrease until 2015.
As a result of this bust period, the PV industry is currently in a state of consolidation, with different
players joining forces to obtain maximum cost savings and economies of scale – and others exiting
the PV market. This situation has affected not only the producers of PV products but also our com-
panies along the PV value chain where jobs have been lost not because of imports from China but
because PV is now moving through a bust cycle.
All experts emphasize that photovoltaics will exit from the current bust cycle by continued cost cutting
through cost rationalizations and economies of scale thereby sustaining and increasing demand. We
are convinced that it is precisely this inability to sufficiently cut costs at a crucial stage in the indus-
try’s development which has injured EU producers but it could also be the avenue forward for their
success.
Imposing additional duties is in blatant contradiction with the decrease in costs that is needed for the
industry to survive.
II. Effects of Possible Duties
The imposition of anti-dumping and / or countervailing duties will severely hamper the growth of solar
energy in the EU to the detriment of the entire EU solar PV value chain and without significant positi-
ve effect for the EU solar producers
A. The cost of solar products in the EU
will inevitably increase
If anti-dumping and / or countervailing duties were introduced, two scenarios are possible:
Scenario 1
Chinese PV modules are displaced by modules from other producing countries such as Korea,
Japan, Taiwan or the USA if sold at prices that maintain sufficient demand. The problem is that this
scenario would not help EU producers.
Scenario 2
Following price increases for Chinese products, EU, other non-Chinese modules and Chinese modu-
les will be available only at price levels leading to significantly weakened demand, thereby affecting
the entire global solar PV value chain.
page 2Scenario 1 is not very likely as these producers in these third countries do not offer the same benefit
of cost rationalizations and economies of scale as Chinese producers. Third country producers are
increasingly attracted by growing demand in their regional markets that is significantly stronger than
in the EU. For example, IMS Research has indicated that annual PV installations in Asia have increa-
sed by 70% from 2011 to 2012. In number this increase was from 5669 MW to 10071 MW installed,
and forecasted to increase by over 37%, to 13828 MW in 2013.
Scenario 2 would be the result of the imposition of anti-dumping and / or countervailing duties.
B. With prices for Chinese solar products increasing,
demand for photovoltaic installations decreases
Photovoltaic installations are only an attractive proposition for investors if they generate sufficient
revenue on their installation investment. Commercial investors require a significant return on invest-
ment in comparison to other investors.
Public support through the FiTs has for many years provided the bulk of the revenue generated by
PV installations. With the reduction of incentives such as FiTs, sustaining demand for PV installations
increases the pressure on 1. decreasing the cost of the installations including the cost of the modules
and 2. increasing revenue from on-site consumption of electricity. Revenue from on-site consumption
depends on the cost of electricity, the yield in solar energy depending on each region’s solar radiation
and the type of installation concerned. All of these factors being contingent on a number of condi-
tions, the downward cost pressure on solar PV installations is growing.
Maintaining demand for solar PV installations requires the EU market to host photovoltaic products,
including modules, at price levels where solar energy can compete with traditional fossil sources
without benefiting from any public support. The imposition of anti-dumping and / or countervailing
duties on Chinese origin wafers, cells and modules will prevent this goal from being achieved. Duties
will weigh heavily on the demand for solar energy and photovoltaic installations to the detriment of
the entire EU value chain.
C. Anti-dumping and / or countervailing duties
will not help EU solar producers
Some EU solar producers are less cost-competitive than other producers worldwide. Their own stra-
tegic decisions have burdened them with high cost structures which weigh heavily and make them
especially unable to compete against the backdrop of the overall decrease in prices. Their high costs
can be attributed for instance to their dependence on long-term contracts for polysilicon at prices sig-
nificantly higher than today’s spot market prices, as well as cost inefficiency compared to competitors.
Indeed, Chinese producers of cells, wafers and modules have created highly cost-efficient production
processes, using integrated state-of-the-art production facilities, economies of scale, lower labor and
overhead costs and R&D developments. Independent market research consistently ranks producers
of wafers, cells and modules in China as among the world’s cost leaders, with EU producers cons-
picuously absent. This has been made possible through the use of top-notch production equipment
that Chinese solar producers purchased in the EU.
page 3Many if not most of the EU solar producers have a very small production capacity, below 100 MW,
which not only deprives them of the necessary economies of scale but in addition results in their
inability to deliver the necessary volumes of products within the delivery times set for larger scale
projects.
The imposition of anti-dumping and / or countervailing duties will not change the weaknesses of the
EU producers in terms of cost competitiveness or their scale disadvantage in bidding for larger cont-
racts.
D. The harm to the upstream and downstream suppliers
will far outweigh benefits to EU PV producers
Around 70% of the PV supply chain´s value in the EU market is created in Europe. The value added
created by the upstream and downstream activities in the EU is immense, at € 40 billion euro, provi-
ding employment for 265,000 EU jobs along the solar PV value chain according to EPIA. By contrast,
the employment represented by the complainant, EU ProSun, and its supporters in the ongoing
investigations based on the data they presented is a maximum of 8,000 jobs.
Module manufacturing represents at most 30% of the 70% value added by EU solar industry. Thus,
imposing duties may be beneficial to only perhaps 30% of the industry while harming the remaining
70%.
The economic consultancy, Prognos, has issued a study which shows that each percentage of an an-
ti-dumping and / or countervailing duty immediately translates into decreased demand for PV installa-
tions. This contributes to the decrease of jobs and value added along the PV value chain and related
branches of the EU economy. Even if the EU solar producers could increase the volume of their
production and their sales, the resulting manufacturing jobs impact is dwarfed in comparison with
the impact of the duties for the larger EU PV value chain and related branches of the EU economy.
Having taken by way of illustration, anti-dumping and / or countervailing duties ranging between 20%
and 60%, the Prognos study shows that the EU’s job losses could be between 115,600 and 242,000
jobs whilst the total value added loss could be between € 4.740 billion and € 27 billion even if one
takes into account that EU solar producers could increase production and sales.
Conclusion
For all the above reasons, we sincerely request that the EU Commission refrain from imposing
anti-dumping and / or countervailing duties and allow the EU PV value chain to develop and grow –
thereby making the biggest contribution to EU employment and value added.
