UNITED STATES (FEDERAL)
Informal discussions1 regarding a fourth COVID-19 or “CARES 2” bill continue as the Senate is in the middle of a three week
break. House Speaker Nancy Pelosi stated2 that “CARES 2 must go further in assisting small businesses including farmers,
extending and strengthening unemployment benefits and giving families additional direct payment.” Senate Minority
Leader Chuck Schumer announced3 he would appoint Bharat Ramamurti to a five-person panel tasked with overseeing
the $500 billion in corporate loans distributed as part of the third coronavirus relief package. Senate Majority Mitch
McConnell, Chuck Schumer, Nancy Pelosi and Kevin McCarthy will each select one member of the panel, with McConnell
and Pelosi jointly choosing the fifth member.
On April 6, the Federal Reserve announced4 that it will establish another lending facility to help provide financing to expand
the Small Business Administration's loan program under the stimulus bill.

2020/04 Coronavirus (COVID-19)—Key Financial Services Issues (LexisPSL)5
This Practice Note covers EU and UK regulatory statements and actions in response to the coronavirus (COVID-19)
outbreak and what these mean for financial services, with links to appropriate websites and materials.
2002/04/03 European Data Protection Board to issue guidance on data processing in the fight against COVID-196
The European Data Protection Board (EDPB) has announced that the issuing of guidance concerning data processing will
be brought forward as a result of the coronavirus (COVID-19) pandemic. The EDPB Chair, Andrea Jelinek, has confirmed
that the areas including the use of location and anonymization of data, the processing of health data for research and
scientific purposes and the processing of data by technologies used to facilitate remote working are all being prioritized.
The EDPB also intends to issue general guidance in line with adequate legal bases and pertinent legal principles. The EDPB
has replaced its monthly plenary meetings with weekly remote meetings.
DENMARK
2020/04/06 Regeringen målretter op til 290 millioner kroner til corona-indsatser (Danish)7
Denmark has expanded the Export Credit Program (EKF) to include large export companies--previously, it was only made
available to small and medium-sized enterprises (SMEs). DKK 5 billion will be allocated to guarantee up to 70% of loans to
larger companies. Both programs were set to be valid until October 1, 2020.
GERMANY
2020/04/06 German government adopts more extensive Quick Loan Programme for small and medium-sized
businesses8
The Bundesministerium der Finanzen has introduced a Quick Loan Program (Kfw-Schnellkredit) for small and medium-
sized enterprises (SMEs). The program was run by the government-owned promotional bank KfW. Loans are available to
SMEs with over 10 employees, active on the market since at least January 1, 2019. Eligible businesses can obtain loans at
a maximum of EUR 800,000 for firms with over 50 employees, and EUR 500,000 for firms with up to 50 employees.

Supreme Judicial Council postpones all hearings until further notice and activates e-trials9
16 March 2020, the Saudi Supreme Judicial Council decided to postpone the hearings of all cases at all courts until further
notice. The decision also included rescheduling and prioritizing postponed hearings and notifying parties electronically.
The courts will continue to adjudicate urgent cases, as determined by the judicial panel or the presiding judge. The courts
will implement e-trials, and impose electronic procedures for filing and receipt of briefs, requests for documents, deposit
of draft judgments, and delivery of judgments, appeals and similar motions that do not require appearance in the court.
All electronic filings must be through the systems of the Saudi Ministry of Justice.
SAMA reduces repo and reverse repo rates10
The Saudi Arabian Monetary Authority decided to cut the repo rate by 75 basis points from 1.75% to 1.00% and the reverse
repo rate by 75 basis points from 1.25% to 0.50%.
Suspension of holding assemblies of companies listed in the market11
On 17 March 2020, the Capital Market Authority suspended holding in-person assemblies of the listed companies until
further notice and holding them through modern technology means.
Confirmation that employee consent for unpaid leave is mandatory under Labor Law12
On 19 March 2020, the Ministry of Human Resources and Social Development confirmed that employee consent to go on
unpaid leave is mandatory under the Labor Law and that the Ministry is capable of receiving complaints of Labor Law
violations by companies online or by telephone.
Saudi Government implements economic measures to mitigate the impact of coronavirus13
On 20 March 2020, the Ministry of Finance announced the Saudi government is exempting and postponing various
government dues and fees worth more than SR70 billion to enhance liquidity in the private sector. In addition, the Saudi
Arabian Monetary Authority announced a package of SR50 billion to support the banking sector, financial institutions and
SMEs.

The General Authority for Zakat and Tax introduced an extension of three months for filing tax returns and payment of
zakat, income tax, withholding tax, value added tax (VAT) and excise tax due for the period between 19 March to 30 June
2020.
Saudi government to bear 60% of the salaries of Saudi private sector employees with a total value of SR 9 billion15
On 3 April 2020, King Salman issued a royal decree to cover 60% of salaries of Saudi employees in the private sector.
Business owners may apply for assistance by submitting a request to the General Organization for Social Insurance (GOSI).
The value of the economic assistance is up to SR9 billion and covers 1.2 million citizens who work in private sector
companies.
UK
2020/04/07 FCA sets out priorities for 2020/2116
The Financial Conduct Authority (FCA) has today set out its business priorities for the year ahead – with specific focus on
the challenges presented by the coronavirus (Covid-19) pandemic.
2020/04/06 FCA expectations regarding funds in light of coronavirus (COVID-19)17
Statement regarding the FCA's expectation of funds during the COVID-19 pandemic. The statement considers delay in
publication of annual and half-yearly fund reports, virtual general meetings, ensuring compliance with limits on value at
risk (VaR) and electronic signatures.
2020/03 Transition from LIBOR remains an essential task despite coronavirus (COVID-19)18
The Working Group on Sterling Risk-free Reference Rates, the Bank of England and the Financial Conduct Authority have
issued a statement saying that the end-2021 deadline for firms to transition from LIBOR should remain unchanged. The
Working Group notes that the coronavirus (COVID-19) pandemic will impact the timing of certain aspects of the transition
programme, in particular for firms within the loan market.

6UK Export Finance has today announced it is expanding the scope of its Export Insurance Policy (EXIP) to cover transactions
with the EU, Australia, Canada, Iceland, Japan, New Zealand, Norway, Switzerland and the USA with immediate effect.
Exports from the UK to these markets totaled £499 billion last year, accounting for 74% of all international sales from the
UK.

2020/04/06 The Bank of England’s Term Funding Scheme with additional incentives for SMEs will open to drawings on
15 April 202022
The Bank of England has moved up the opening date of the Term Funding Scheme for Small and Medium-sized Enterprises
(TFSME). It was re-scheduled to open on April 15, 2020. TFSME allowed eligible banks and building societies to access four-
year funding at rates close to the Bank Rate.

2020/04/03 AIIB plans USD 5bn financing facility to battle COVID-19 impact (Inframation)23
The Asian Infrastructure Investment Bank (AIIB) plans to create a crisis recovery financing facility in response to the COVID-
19 crisis. The Beijing-based development bank aims to offer an initial USD 5bn financing to both public and private sector
entities in member countries that are suffering an adverse impact, according to a statement today.

2020/04/07 COVID-19: implications for annual general meetings and other shareholder meetings24
This checklist considers the effect of the 2019 novel coronavirus disease (COVID-19) on shareholder meetings including
annual general meetings (AGMs) due to be held during the COVID-19 outbreak. It sets out the restrictions that apply to
holding AGMs and other shareholder meetings, advice companies should give to shareholders, the regulatory and other
relief that is available and alternative options for companies during the COVID-19 outbreak, including holding a hybrid or
virtual meeting.
INDIA
2020/03/23 Suo Moto Writ Petition: Cognizance for Extension of Limitation25
The Supreme Court has taken suo moto cognizance of the situation arising out of the challenge faced by the country on
account of COVID-19 and the resulting difficulties that may be faced by litigants in filing petitions/ applications/ suits/
appeals within the prescribed limitation period in each case. To obviate difficulties and to ensure that lawyers/litigants do
not have to come physically to file such proceedings in court across the country, the Supreme Court has ordered that the
period of limitation in all such proceedings, irrespective of the prescribed period that applies and whether condonable or
not, shall stand extended with effect from 15 March 2020 until further notice.

The Government announced the Solidarity Budget which complements measures introduced under Budget 2020 and the
Resilience Budget to address the rapidly evolving COVID-19 situation and the impact on Singapore’s economy and society.
As part of the Job Support Scheme, the Government will co-fund the first $4,600 of gross monthly wages# paid to each
local employee for 9 months.

2020/04/06 Comment—delay of global bank capital rules could lead to wider tweaks (LexisPSL)30
MLex: A move from global banking standard setters to delay a mammoth set of new rules for financial institutions around
the world was expected in the wake of the coronavirus (COVID-19) crisis. But the new date might not be the only
amendment. There is a chance the Basel standards will be further delayed, changed beyond recognition, or reviewed in
light of the unforeseen crisis.
2020/04/03 Basel Committee Sets Out Additional Measures to Alleviate Impact of COVID-1931

On 3 April 2020, the International Organization of Securities Commissions (IOSCO) issued a statement on the application
of accounting standards during the COVID-19 outbreak. IOSCO’s statement stresses that “[t]he application of accounting
standards must result in issuers providing clear, reliable, transparent and useful information to allow investors to make
informed investment decisions”. The statement highlights in particular, the application of accounting for expected credit
losses (ECL) in accordance with the principles-based framework set out in IFRS 9 Financial Instruments, and the related
financial instruments principles-based disclosure requirements in IFRS Standards (i.e. IFRS 7, IAS 1).
2020/04/03 ICC Issues Guidance to the Trade Finance Market to Address COVID-19 Disruptions and Calls for Legal

The International Chamber of Commerce (the ICC) has issued two guidance papers to help deal with trade finance market
disruptions caused by COVID-19:
ICC Guidance Paper on the Impact of COVID-19 on Trade Finance Transactions Issued Subject to ICC Rules, April 2020: 37this
paper provides technical guidance, practical advice and best practices on elements to consider in adapting ICC rules for
specific trade finance instruments in response to COVID-19. The paper reviews provisions from several ICC rules, namely
the Uniform Customs and Practice for Documentary Credits (UCP 600) and its eRules (eUCP 600 2.0), the Uniform Rules
for Demand Guarantees (URDG 758), the Uniform Rules for Collections (URC 522) and its eRules (eURC 522), the Uniform
Rules for Bank-to-Bank Reimbursements under Documentary Credits (URR 725) and the Uniform Rules for Bank Payment
Obligations (URBPO 750).
ICC Memo to Governments and Central Banks on Essential Steps to Safeguard Trade Finance Operations, 6 April 2020: this
memo outlines the impact of public health interventions to tackle COVID-19 on the processing of paper-based trade
finance transactions, and calls on all governments to take emergency measures to void all existing legal requirements for
trade documentation to be in hard copy and to adopt the UNCITRAL Model Law on Electronic Transferable Records.

of being infected or coming into contact with someone who is infected with this virus, shall have their medical condition or
incapacity to work presumed to be work-related. Public safety official shall not be required to use sick time, vacation time, or
personal time to cover said period of incapacitation or inability to perform regular duty work.
